SANTA FE, N.M. -- Two firearms charges were dismissed Thursday amid preparations for a trial against an extended family arrested in a 2018 law enforcement raid on a ramshackle desert compound in northern New Mexico and the discovery of a young boy's decomposed body.

The changes narrow the case to terrorism and kidnapping charges against five defendants in a trial scheduled to begin Monday with jury selection at U.S. District Court in Albuquerque.

All five defendants — including Subhanah Wahhaj, sister Hujrah Wahhaj and Lucas Morton — are charged with conspiracy to commit an offense against the United States, providing material support to each other as potential terrorists and conspiracy to kill U.S. government personnel amid tactical drills at the New Mexico compound.

Kidnapping charges are pending against four of the defendants but not Siraj Wahhaj because of his legal status as the father of the deceased boy. Morton also plans to act as his own legal counsel at trial.

The Court finds Steven R. Watt qualified to render his proposed expert opinion in this case. The Court similarly finds Joost Janssen qualified to testify under Rule 702. The Court will limit the scope of Watt & Janssen's testimony to issues relevant to the offenses charged. A grand jury indictment alleges Jany Leveille, a Haitian national, and partner Siraj Ibn Wahhaj instructed people at the compound to be prepared to engage in jihad and die as martyrs, and that another relative was invited to bring money and firearms.



Potential jurors are being surveyed on their opinions about the Islamic religion, Muslims and alternatives to traditional medicine.

ALBUQUERQUE, N.M. (AP) — Jury selection began Monday in federal court as members of an extended family confronted kidnapping and terrorism charges stemming from the search for a missing 3-year-old boy by agents who raided a squalid New Mexico encampment in 2018.

Leveille also was initially charged with kidnapping and terrorism-related charges but she agreed to accept a reduced sentence on weapons charges.

Neither Leveille nor her attorneys appeared at the defense table in court Monday. Leveille came to the U.S. in 1998 on a visa and work permit that later expired and immigration authorities denied an application for permanent residency.

ALBUQUERQUE, N.M. -- Federal prosecutors presented tearful testimony Tuesday from the mother of a sickly toddler who was whisked away from his Georgia home by relatives without her permission to a remote desert encampment in northern New Mexico where he died.

Abdul-Ghani’s mother, Hakima Ramzi, recounted her love and devotion to a cheerful son who lived with severe developmental disabilities and frequent seizures — and her shock when husband, Siraj Ibn Wahhaj, and his sibling accused her of casting spells on the boy.

Prosecutors plan to present evidence that Siraj Ibn Wahhaj and his partner Jany Leveille, a Haitian national, took Abdul-Ghani in December 2017 to resettle in New Mexico, where they performed daily prayer rituals over the boy as he cried and foamed at the mouth. They also allege the child was deprived of medication as his health failed. Leveille was initially charged with kidnapping and terrorism-related charges but she has agreed to accept a reduced sentence on weapons charges. She has not appeared at the trial.

Defense attorneys for sisters Hujrah and Subhanah Wahhaj told the jury Tuesday that terrorism allegations against the mothers and New York City natives are largely based on a fantastical diary written by Leveille about her belief that Abdul-Ghani would be resurrected.

I’m very surprised about their decision to represent themselves! I wish I could see footage.

Given the seriousness of the charges, especially federal terrorism- which seems credible imo- I am truly flummoxed by the minimal news coverage. I suppose the lack of reporting may account for what appears to me as lack of interest in the case. I mean I have to really dig to find anything.

*Trial continues for all (Day 6) (Federal Case) (@ 9am MT) – NM – 11 children (ages 1 to 15 found August 3, 2018 in filthy NM compound, Amalia) - *Siraj Ibn Wahhaj (39/now 45), Laqman Lucas Allen Morton (40/now 45), Subhannah Wahhaj (35/now 40) (8 mos. pregnant back in 8/31/18) (wife of Morton) & Hujrah Wahhaj (35/now 40) (sister of Siraj) arrested (8/31/18) & indicted (9/12/18) & re charged & indicted (3/14/19) & arraigned (3/21/19) by FBI with 2 counts of conspiracy to provide material support to terrorists, 2 counts of conspiracy to murder an Officer or employee of the U.S. (except Subhannah & Hujrah only 1 count), possessing a firearm while unlawfully in the U.S., conspiracy to commit kidnapping (except Siraj) & kidnapping (except Siraj). The these four defendants are charged with aiding & abetting Leveille & conspiring with her to commit the offense. (Violating federal firearms & conspiracy laws). All plead not guilty.
*Maryam Jany Leveille (35/now 40) (wife of Siraj) charged, a Haitian national, with being in the U.S. illegally & unlawfully in possession of firearms & ammunition from Oct. 2017 thru Aug. 2018 & 2 count of conspiracy to provide material support to terrorists, 2 counts of conspiracy to murder an officer or employee of the U.S., conspiracy to commit kidnapping & kidnapping. Possessing a firearm while unlawfully in the U.S. & 1 count of the conspiracy charges have been dismissed for all defendants on 9/21/23. Plead not guilty.
The U.S. Attorney’s Office announced it would not seek the death penalty against the four facing kidnapping charges.
*Maryam Jany Leveille plead guilty to a federal firearms charge & a conspiracy charge & faces up to 15 years in prison. She admitted acting with her four co-defendants to transport firearms from Georgia to New Mexico “for use in establishing a firearms & military tactics training range,” according to the plea agreement. Under the agreement, prosecutors agreed to drop the remaining charges against Leveille following sentencing, which has not been scheduled.
Trial began on 9/25/23 with jury selection which was completed. Jury: 7 men & 5 women.
Trial began on 9/26/23 & expected to last about 4 weeks.

Oct. 2—The first bulletin went out in December 2017 announcing the disappearance of a child in Georgia, but nearly eight months passed before law enforcement raided a remote Taos County compound where they found the boy's remains, witnesses said Monday in the federal terrorism and kidnapping trial of four people.

On Aug. 2, 2018, Taos County Sheriff's Office deputies received information from "a credible source" that children were "starving" and "malnourished" at the ramshackle compound near the Colorado border, Taos County Undersheriff Jerry Hogrefe told jurors on Monday.

The National Center for Missing and Exploited Children published a bulletin on Dec. 22, 2017, that included photos of Wahhaj, 45, and his son, Abdul Ghani, a Georgia police officer testified Monday.

A Georgia judge issued a warrant for Wahhaj's arrest and a pick-up order for the child on Jan. 9, 2018, Clayton County, Georgia, police Capt. Scott Stubbs testified. Georgia officials also provided information that Morton owned property in Taos County in an area called Castillo Meadows, Stubbs said.

Muhammed Wahhaj testified that Morton hand-delivered a letter to him at his Atlanta-area home in late December 2017 urging him to "bring my guns and join whatever it was they were doing." The letter, written by Lavielle, predicted that the boy would return as the messiah in about April, he said.
