Torres and Maestas reportedly have a son together. Court records revealed that Maestas had filed for custody in early August, leading to a child support hearing being scheduled for November 7. The records also showed that a Family Court Services “consultation continuation appointment” was scheduled for Wednesday— the same day Calzada’s body was found, according to the News Journal.

MURDER IN NEW MEXICO
Murder can then be further divided into two categories:

  1. First-degree Murder – any unlawful killing that is both willful and premeditated.
  1. Second-degree Murder – the crime of murdering in the heat of passion, which can involve situations where a person’s actions take place during a period of intense fear, rage or anger.
Penalties and Sentences for Murder

Whoever commits murder in the first degree is guilty of a capital offense that shall be punished by imprisonment for life or life without the possibility of parole.

Whoever commits murder in the second degree is guilty of a second-degree felony and shall be punished by up to fifteen years in prison and a fine of up to $12,500. For second-degree murder of a child, the punishment is up to life in prison and a fine of up to $17,500.

Pisses me off he is given 2nd degree. So his excuse is he was so angry that he couldn't control himself so he killed a 5 yr old innocent child?

We were in federal court today for the initial appearance of Malcolm Torres. He’s accused of killing 5-year-old Renezmae Calzada. An Amber Alert went out for her in September, they found her body 3 days later. The latest on Torres tonight on @KOB4.

Torres past includes a 2018 arrest for driving while intoxicated in Albuquerque. In the same year, he was charged with beating up a household member. However, the charges were eventually dropped.

ETA: probably not, on 2nd thought--because they charged him with 2nd degree murder. It would be 1st degree if there was a rape, I am sure.

The only thing I wonder is if it's some sort of "protect the minor's identity". Which is useless at this point.

Malcolm Torres of Española, New Mexico, was arrested Sunday, October 27, 2019, on a federal indictment charging him with second-degree murder in the death of 5-year-old Renezmae Calzada.

The FBI with the assistance of the Española Police Department arrested Torres in Pojoaque Pueblo, New Mexico, without incident.

Torres appeared in Federal Court on Monday on second-degree murder charges. The case is being heard in federal court as investigators say Renezmae was killed on Pueblo land just outside of Española.

Monday in court, federal prosecutors didn’t share anything new about the case. He was simply advised of his rights and the charges he faces.

Some of Torres’ family members were also in court but declined to speak with KRQE News 13. Torres is expected back in federal court on Tuesday for a detention hearing.

'Dangerous' Española murder defendant went free
A federal judge determined on Tuesday that Malcolm Torres – who’s charged with murder in the September death of 5-year-old Renezmae Calzada – was too dangerous and too much of flight risk to be allowed out of federal prison pending trial.

Torres was released from the Metropolitan Detention Center in Bernalillo County on Sunday, where he had remained for a month on unrelated minor charges.

While he was being held in that case, a grand jury indicted him on the murder charge – charges the public knew nothing about because the indictment was sealed.

Candace Hopkins, a spokeswoman for the MDC, said that Torres was released from the jail at 10:03 a.m. Sunday.

She said in an email that “MDC did not notify any agency that Mr. Torres was being released, because we did not receive a federal warrant or detainer.”

Torres was indicted for the little girl’s death on Sept. 24, and court records show a federal arrest warrant was issued the same day. But both documents had been kept under seal until after he was arrested Sunday in Pojoaque.
