GUILTY NY - Joseph Comunale, 26, Manhattan, 12 Nov 2016 - #3

Dont believe everything you read from this site. Look at the bottom of the article. It says they put Dilione on the phone with Comunale's father which made him confess. Wrong person. No fact checking or at least proof reading before sending out. And how would she get the last 4 of his social??? Sounds bogus. If she knew him like that, she wouldnt need to send a pic of him to her friend.

Agreed about DM. However, that story about the ss# was in other msm.

I’m not seeing anything in the news. Does anybody know what happened in court?

Is it significant that both Rackover and Dillione have both gone from being eligible for bail and are now listed as remanded?

Manhattan Supreme Court Justice James Burke is expected to decide Monday whether incriminating statements murder suspects made to New York Police Department detectives in the hours after Joseph Comunale’s death will be admissible in court and if the defendants will be tried separately.

4/13/18 hearing continued to today April 23rd. Manhattan Supreme Court Justice James Burke is expected to decide Monday whether incriminating statements murder suspects made to New York Police Department detectives in the hours after Joseph Comunale’s death will be admissible in court and if the defendants will be tried separately.

The prosecution contended Dilione’s statements in particular were admissable because law enforcement officers would have eventually found Comunale’s body on their own.
Additionally, the prosecution argued that at the time they were questioning the suspects, police were trying to find a missing person, making the situation an emergency, therefore detectives were allowed to keep pushing for answers.
Justice Burke said he’d allow certain statements in at trial, and specified that Dilione’s recounting of where he and Rackover allegedly dumped Comunale’s body would be allowed. The judge then promptly sealed his written decision, barring attorneys from discussing its content and preventing media access to the document.

Rackover’s attorney, Maurice Sercarz, said after two years in jail, he and his client are eager to go to trial.
“As long as everything is filed in a timely manner, we will definitely be ready in five months,” he said.
When asked if there has been any discussion about working out a deal with the District Attorney’s Office, he said “none whatsoever.”

Horrible decision to sever the cases. These men should not have the opportunity to play the game and make deals if they'll turn on the others.

Rackover is the biggest loser in this based on what we know about Dilione & Gemma's friendship. I anticipate that Gemma will cut a deal in exchange for his testimony. His testimony will likely push the Dilione narrative (which has some significant factual issues) and attempt to paint themselves as victims of Rackover.

Awful decision by the judge.

I have 9/24 as trial starting for Rackover, so don't understand "why" the other 2 are listed as appearing. Witnesses??
