"NEW YORK — It was the battle of the expert witnesses Wednesday as the defense rested in the trial of Officer Daniel Pantaleo.
The defendant's team called on a former police academy instructor and a medical examiner to try and prove Pantaleo's actions the night Eric Garner died were justified.
"This police officer went out and did what he was asked and how he was trained," said Pat Lynch, President of the Policeman's Benevolent Association at a press conference outside the trial.
Dr. Michael A. Graham, the chief medical examiner in St. Louis, said he was being paid $500 an hour to consult and testify by the defendant's attorneys.
"None of our witnesses are being paid, because you don't need to be paid to tell the truth," said Gwen Carr, Eric Garner's mother.
Dr. Graham said after watching the video and reviewing the autopsy that he believes Garner's death was caused by "heart disease that was exacerbated by the interaction with law enforcement." This testimony directly conflicts with the city's medical examiner, who testified that a chokehold started the fatal chain of events.
"His heart was twice the size of what it should've been, he was emotional, he was upset and that's why he died," said Stu London, Pantaleo's attorney.
Retired Detective Russell Jung also took the stand today. He taught Officer Pantaleo in the police academy. When asked "Did you see any improper techniques in the takedown of Eric Garner," Jung replied, "No" and in his opinion this was not a chokehold.
"The maneuver that was used was proper and taught in our police academy," said Lynch.
The biggest bombshell came at the end of the court day when the defense said that Pantaleo himself would not testify. His attorneys told PIX11 they didn't want anything he said used against him should he face federal criminal charges.

An executive assistant U.S. attorney was spotted at the hearing on Wednesday. The U.S. Department of Justice declined to comment....
Deputy Commissioner Rosemarie Maldonado will determine within 90 days whether the evidence presented at the hearing equates to criminal charges of first-degree strangulation and third-degree reckless assault.
Based on Judge Maldonado's decision, Pantaleo faces losing his job or vacation days. Ultimately, it's NYPD Commissioner James O'Neill or New York City Mayor Bill de Blasio who will determine Pantaleo's future with the NYPD.
"CCRB recommends a penalty of termination without his pension. ... Officer Pantaleo forfeited his right and privilege to be a police officer in the city of New York," said Suzanne O'Hare during her closing arguments for CCRB.
"I expect an expedited schedule," said Stuart London, the lead attorney on Pantaleo's defense team. "And we have another two weeks to respond to that decision from the police commissioner...in this case."...

In a stunning and emotional bombshell, a retired NYPD spokesman blasted cops over the chokehold death of Eric Garner, calling it a “horrible injustice” on his Instagram page.
“We killed Eric Garner,” Michael DeBonis, 40, an ex-detective who worked for the deputy commissioner for public information, posted last week.
But he admitted he said nothing in 2014 following the Staten Island man’s fatal arrest, infamous for Garner’s final, videotaped words, “I can’t breathe.”
“In writing this post I’m fully aware that some of my cop friends may call me a traitor, a hypocrite or even un follow me,” DeBonis wrote.

A review of newly obtained disciplinary records of the former police officer who held Eric Garner in a chokehold before he died shows the officer had seven misconduct cases investigated against him in the five years before Garner's 2014 death.
The release of the records comes on the heels of the New York State legislature repealing a law known as 50-a, which shielded police disciplinary records from being viewed by the public for years.

And over the weekend, a New York City man appears to have been held in a chokehold by another NYPD officer, who has been suspended without pay. The interaction was caught on video and happened less than two weeks after lawmakers placed chokehold bans at the state and city level.
