The #DanielPantaleo departmental hearing continues this morning. The defense case continues. Unclear if Pantaleo will take the stand. Stay tuned.

The trial testimony is expected to end tomorrow with summations. An administrative judge will render a verdict before Commissioner O'Neill makes the final decision.

A former New York City police sergeant who oversaw Officer Daniel Pantaleo's tactical training said officers use "a million maneuvers'' on the street that they're not trained on in the Police Academy. That raises a big question: Should they?

Ashley Southall 2020 ‏ @AshleyAtTimes Jun 5
The officer was testifying at a disciplinary hearing stemming from the death of Eric Garner that could cost Officer Pantaleo's his job.
The police administrative judge made a crucial ruling today

Ashley Southall 2020 ‏ @AshleyAtTimes Jun 5
Judge Rosemarie Maldonado agreed with Stuart London, the defense lawyer, that he does not need to prove Officer Pantaleo learned a seatbelt hold in the Police Academy, only that it was approved at the time he used it to subdue Mr. Garner.

Ashley Southall 2020 ‏ @AshleyAtTimes Jun 5
Her ruling calls into question how important she thinks official training is. If Officer Pantaleo did not learn the maeuver in the academy, how does he know when and how it's okay to use it on a civilian?

It's an unprecedented decision, and Judge Rosemarie Maldonado said she will have to consider trustworthiness as a factor in deciding how heavily to weigh it.

Officer Daniel Pantaleo will not take the stand to testify during disciplinary trial. Instead, the NYPD judge overseeing the case will accept the officer’s testimony from 2014

THREAD ALERT After 6 days of testimony and almost 5 years after #EricGarner death, the departmental trial has concluded. #DanielPantaleo did not take the stand, instead his attorney submitted Pantaleo's Dec. 2014 interview with superiors about this case.

Christina Carrega‏Verified account @ChrisCarrega Jun 5
The CCRB "vigorously objected" being denied the opportunity to cross-examine #DanielPantaleo but his attorney argued: "It would be malpractice to put my client on the stand...the court needs to hear my client's side and this interview should be accepted."

Christina Carrega‏Verified account @ChrisCarrega Jun 5
The CCRB may put on a rebuttal case tomorrow morning based on testimony from a doctor who testified for #DanielPantaleo to challenge the city medical examiner's findings of the cascade that cause #EricGarner death

Christina Carrega‏Verified account @ChrisCarrega Jun 5
"We cannot treat respondents differently from civilian witnesses. ait would open the flood gates that all respondents could submit a GO15 instead of testifying when the witness is available," said CCRB about not being able to cross-examine #DanielPantaleo

Christina Carrega‏Verified account @ChrisCarrega Jun 5
Also a witness for the defense today with retired NYPD Detective Russell Jung who trained #DanielPantaleo in 2006 but not on the seat belt maneuver.

Christina Carrega‏Verified account @ChrisCarrega Jun 5
The seat belt method wasn't taught until 2011. "There's a million maneuvers we aren't trained that we use in the streets," said Jung. This admission brought gasps in the courtroom.

Christina Carrega‏Verified account @ChrisCarrega Jun 5
Tomorrow we'll see if a rebuttal case happens or summations. On June 14, the attorneys have to submit motions to suggest to the Deputy Commissioner how to use #DanielPantaleo 2014 interview with her decision. The decision will not be made public.

For the first time since last year, I laid eyes on Esaw Garner, #EricGarner widow. She came to court in a wheelchair. Keep her in your thoughts Twitterverse.

Christina Carrega‏Verified account @ChrisCarrega Jun 5
After court thoughts: Why didn't CCRB request to adjourn the hearing until July 18, the day after we'll officially know if the feds will or won't indict/charge #DanielPantaleo? That way, if the feds don't, put him on the witness stand.

NYPD Trial of Daniel Pantaleo Resumes with Medical Expert Testimony

"NEW YORK - The NYPD departmental trial for officer Daniel Pantaleo resumed Wednesday after two weeks off.
The defense was waiting on testimony from a medical expert, who wasn't available until this week...."

Defense rests in Daniel Pantaleo trial after calling expert witnesses (with clip)

JUNE 5, 2019

"NEW YORK — It was the battle of the expert witnesses Wednesday as the defense rested in the trial of Officer Daniel Pantaleo.

The defendant's team called on a former police academy instructor and a medical examiner to try and prove Pantaleo's actions the night Eric Garner died were justified.

"This police officer went out and did what he was asked and how he was trained," said Pat Lynch, President of the Policeman's Benevolent Association at a press conference outside the trial.

Dr. Michael A. Graham, the chief medical examiner in St. Louis, said he was being paid $500 an hour to consult and testify by the defendant's attorneys.

"None of our witnesses are being paid, because you don't need to be paid to tell the truth," said Gwen Carr, Eric Garner's mother.

Dr. Graham said after watching the video and reviewing the autopsy that he believes Garner's death was caused by "heart disease that was exacerbated by the interaction with law enforcement." This testimony directly conflicts with the city's medical examiner, who testified that a chokehold started the fatal chain of events.

"His heart was twice the size of what it should've been, he was emotional, he was upset and that's why he died," said Stu London, Pantaleo's attorney.

Retired Detective Russell Jung also took the stand today. He taught Officer Pantaleo in the police academy. When asked "Did you see any improper techniques in the takedown of Eric Garner," Jung replied, "No" and in his opinion this was not a chokehold.

"The maneuver that was used was proper and taught in our police academy," said Lynch.

The biggest bombshell came at the end of the court day when the defense said that Pantaleo himself would not testify. His attorneys told PIX11 they didn't want anything he said used against him should he face federal criminal charges.

"He's still target of a federal investigation," said London...."

Ex-NYPD instructor at Garner trial: Cops use tactics without training all the time

June 5, 2019

"A former Police Academy instructor testified Wednesday that NYPD cops routinely employ physical tactics against suspects without undergoing training — sparking outrage from spectators at the departmental trial over the deadly arrest of Eric Garner....

During cross-examination, Jung rejected a prosecutor’s assertion that, “Officers should not perform a maneuver that they are not trained to do, correct?”

“Where does it say that?” Jung said.

“There are a million maneuvers we use in the streets that we are not trained to do.”..."

Today is the last day of Officer Daniel Pantaleo's disciplinary trial over his role in the death of Eric Garner.
Before summations, prosecutors will rebut Pantaleo's statement to internal affairs, after the judge made an unprecedented decision to allow the interview in evidence.

Lawyers have until June 14 to submit post-trial motions on how much weight the judge, Deputy Commissioner Rosemarie Maldonado, gives his statement.
She will then render a verdict for Commissioner O'Neill, who will make the final decision whether Pantaleo will keep his job.

Ashley Southall 2020 ‏ @AshleyAtTimes 8h8 hours ago
It's a wrap. There are a few post-trial procedural steps, but it's decision time for Commissioner James P. O'Neill, who has the final say on Officer Daniel Pantaleo's future. Lawyers expect a ruling timed around the 5th anniversary of the July 17, 2014 death of Eric Garner.

After 15 witnesses over 7 days of proceedings, the administrative trial of NYPD Ofc. Daniel Pantaleo ended today. The judge will recommend a discipline that could include termination. These rulings have historically been confidential covered under 50a.

Judge to determine future for NYPD cop accused of killing Eric Garner with chokehold

Jun 6, 2019

"...The feds have until the fifth anniversary of Garner's death on July 17, 2019, to announce their whether they will proceed before the statute of limitations clock expires. An executive assistant U.S. attorney was spotted at the hearing on Wednesday. The U.S. Department of Justice declined to comment....

Deputy Commissioner Rosemarie Maldonado will determine within 90 days whether the evidence presented at the hearing equates to criminal charges of first-degree strangulation and third-degree reckless assault.

Based on Judge Maldonado's decision, Pantaleo faces losing his job or vacation days. Ultimately, it's NYPD Commissioner James O'Neill or New York City Mayor Bill de Blasio who will determine Pantaleo's future with the NYPD.

"CCRB recommends a penalty of termination without his pension. ... Officer Pantaleo forfeited his right and privilege to be a police officer in the city of New York," said Suzanne O'Hare during her closing arguments for CCRB.

"I expect an expedited schedule," said Stuart London, the lead attorney on Pantaleo's defense team. "And we have another two weeks to respond to that decision from the police commissioner...in this case."...

"[CCRB] did their job and have proved their case," said Garner's mother, Gwen Carr, at a press conference outside of the police headquarters."

NYPD fires officer for 2014 death of Eric Garner

After five years of investigations and protests, New York City's police commissioner on Monday fired an officer involved in the 2014 chokehold death of an unarmed black man whose dying cries of "I can't breathe" fueled a national debate over race and police use of force.

Police Commissioner James O'Neill's announced at a midday news conference that he had fired Officer Daniel Pantaleo, who is white, based on a recent recommendation of a department disciplinary judge. He said it was clear that Pantaleo "can no longer effectively serve as a New York City police officer."

In a stunning and emotional bombshell, a retired NYPD spokesman blasted cops over the chokehold death of Eric Garner, calling it a “horrible injustice” on his Instagram page.

“We killed Eric Garner,” Michael DeBonis, 40, an ex-detective who worked for the deputy commissioner for public information, posted last week.

But he admitted he said nothing in 2014 following the Staten Island man’s fatal arrest, infamous for Garner’s final, videotaped words, “I can’t breathe.”

“In writing this post I’m fully aware that some of my cop friends may call me a traitor, a hypocrite or even un follow me,” DeBonis wrote.

A review of newly obtained disciplinary records of the former police officer who held Eric Garner in a chokehold before he died shows the officer had seven misconduct cases investigated against him in the five years before Garner's 2014 death.

The release of the records comes on the heels of the New York State legislature repealing a law known as 50-a, which shielded police disciplinary records from being viewed by the public for years.

A Small Needful Fact
Ross Gay

Is that Eric Garner worked
for some time for the Parks and Rec.
Horticultural Department, which means,
perhaps, that with his very large hands,
perhaps, in all likelihood,
he put gently into the earth
some plants which, most likely,
some of them, in all likelihood,
continue to grow, continue
to do what such plants do, like house
and feed small and necessary creatures,
like being pleasant to touch and smell,
like converting sunlight
into food, like making it easier
for us to breathe.
