    The obstruction of justice charge stems from Cincinelli allegedly destroying two cell phones and the records that they contain as a way to impede the investigation, according to the indictment.

    Cincinelli’s attorney, James Kousouros, of Manhattan, told the Herald after her plea that there was more to the story than the details that have been brought to light.

    “Our investigation has begun,” he said, “and as the facts really emerge here as to what occurred, we believe that it will become clear that Ms. Cincinelli never would and never did participate in the conduct that she’s charged with. She’s entitled to the presumption of innocence and we should not forget that she’s a decorated veteran of the Police Department with no criminal record.”

    A key person who led to the FBI’s charges against Cincinelli was labeled “CS,” meaning confidential source, according to court documents. He was later identified as John DiRubba, 54, of Howard Beach, Queens, who is the defendant in a separate grand larceny case, according to the Daily News

    Cincinelli’s alleged plan began in February, when she asked DiRubba to hire a hitman to kill Carvalho and his own daughter, according to the FBI. Carvalho filed for divorce from Cincinelli in January after four years of marriage, and the two were in the middle of a custody battle. The reason Cincinelli wanted DiRubba’s 15-year-old daughter out of the picture was because she impeded her spending time with him, according to the New York Post.

    Cincinelli was assigned to the 106th Precinct in Queens in 2007. She has been working modified assignments since 2017, according to police, such as being assigned to a unit that monitors surveillance feeds in public housing developments after several domestic incidents — including one in which she lost her badge and gun after visiting an ex-boyfriend’s house while on duty. Cincinelli has two ex-husbands, each of whom filed restraining orders against her, and she filed one against Carvalho.

    DiRubba has his own legal issues to worry about, as he has been accused of allegedly threatening to shoot a man over a $54,000 diamond ring on Jan. 15. The case is pending.

    On Friday, Federal Magistrate Gary Brown ordered that Cincinelli remain in prison without bond, where she has been held since her arrest on May 17 and deemed a danger to the community. She is due to appear in court again on June 26.

    “I am in therapy three times a week just to make sense of all of this," the 54-year-old DiRubba wrote in one of a series of soul-baring texts to the Daily News about his relationship with the twice-married Cincinelli. “My heart will never be the same. Mentally emotionally physically I am not myself ... NO ONE IS A WINNER!!!”

    The NYPD cop accused of plotting to murder her estranged hubby — as well as her boyfriend’s teen daughter — was denied bail because of her “lack of impulse control” and her “defensiveness.”

    A federal judge ordered Valerie Cincinelli, 35, to remain behind bars at the Metropolitan Detention Center in Brooklyn until her trial, according to court documents filed Friday.

    The Oceanside mom was arrested in May on charges that she hatched a plan with her boyfriend John DiRubba to arrange hits on both her husband, Isaiah Carvalho, and DiRubba’s 15-year-old daughter.

    She has pleaded not guilty to two counts of murder for hire and one count of obstruction of justice.

    U.S. District Court Judge Sandra Feuerstein ruled against Cincinelli on Friday, saying the defendant displayed “lack of impulse control” and “defensiveness” in a psych evaluation. The court also noted that the defendant allegedly destroyed two iPhones to cover up the plot.

    “The court finds by clear and convincing evidence that defendant poses a danger to the safety of the allegedly intended victims and the community, particularly in light of the serious risk that defendant would attempt to obstruct justice, as evidenced by her alleged conduct in destroying and/or attempting to destroy evidence prior to her arrest and her disobedience of court directives while in custody,” wrote Feuerstein.

    The bizarre tale of an NYPD cop accused of hiring a hitman to kill her estranged hubby — and her current boyfriend’s daughter — may become a Lifetime movie.

    Isaiah Carvalho is eager to make the surreal murder-for-hire case against his ex, Valerie Cincinelli, into a film, his attorney Matthew Weiss told the Daily News Wednesday. NBC’s “Dateline” plans to run a segment on the case once it has concluded and Carvalho hopes that it could yield a made-for-TV movie on Lifetime, Weiss said.

    “We’re talking to ‘Dateline,’ who said they have connections with Lifetime,” Weiss said. “(Carvalho) doesn’t have a lot of money … All I will say is that this story reads like a movie script."

    He spoke following a hearing in Nassau County on Carvalho’s divorce from Cincinelli.

    A federal judge Tuesday set April 20 for the trial of a veteran New York City police officer from Long Island accused of plotting to kill both her estranged husband and the teenage daughter of her boyfriend.

    The trial of the police officer Valerie Cincinelli, 35, of Oceanside, should take two weeks, Eastern District federal prosecutors Catherine Mirabile and Lara Treinis Gatz told U.S. District Judge Sandra Feuerstein at the federal court in Central Islip.

    Cincinelli, dressed in prison blues, sat composed through the brief hearing without showing any emotion.

    Cincinelli faces up to 10 years in prison on conviction for each of the two counts of murder for hire; as well as 20 years on the obstruction charge.
