In a nine-page, 19-count indictment unsealed in state Supreme Court Monday morning and released by the Monroe County District Attorney's Office on Tuesday, the Cash cousins and Pluviose are all facing numerous felony charges. The breakdown is as follows:

Dimitri Cash, Joenathan Cash and Kimara Pluviose were all charged with two counts of first-degree burglary, one count of second-degree robbery and two counts of fourth-degree conspiracy, all felonies.

Dimitri Cash was also charged with two counts of first-degree kidnapping, one count of second-degree reckless endangerment, two counts of second-degree custodial interference, two counts of second-degree criminal contempt, all felonies. He was also charged with two counts of endangering the welfare of a child, a misdemeanor.

Joenathan Cash and Pluviose were both charged with two counts of second-degree kidnapping and three counts of unlawful imprisonment, all felonies.

Cash returned to court Tuesday, but left the courtroom when he was told he could not take notes.

The rest of the hearing focused largely on Cash’s statements to New York State Police. His attorney claims Cash was not allowed to leave his interview with police, even when he requested to do so.

The hearing also involved a bail application for Joenathan Cash. The prosecution argued he would be a flight risk.

Tuesday was a Huntley Hearing, which reviews how police got statements from the defendants, along with a probable cause hearing. The defendants, Dimitri Cash who is the children's father, Joenathan Cash who is Dimitri's cousin, and Kimara Pluviose, are all being charged with the kidnapping.

Prosecutors questioned Greece and New York State Police detectives about their phone interviews and interrogations with the defendants.

Right as court was about to adjourn, there was new information submitted. Prosecutors said that Joenathan allegedly smuggled a letter in a bag of chips at the jail to a co-defendant offering that one of the three should “take the fall" and that person would “be taken care of".

Prosecutors would not say which co-defendant it was sent to, but told the court it outlines multiple steps already underway to stage an escape.

"I don't know if it came from my client," said Paul Guerrier, Joenathan Cash's attorney. "I don't know anything. Those are the allegations. They did show me some kind of letter. I wasn't able to go through it."

A grand jury handed up an indictment Friday charging Dimitri Cash and Joenathan Cash with conspiring to murder Monroe County Family Court Judge Stacey Romeo.

According to court papers, Dimitri Cash conducted "background searches and a background investigation" of Judge Romeo.

Joenathan Cash is alleged to have conducted surveillance at the judge's residence last November, recording observations on his cell phone.

He also allegedly surveilled the judge to learn about which vehicle she drove to work and where she parked.

In December, Dimitri Cash is alleged to have made online searches about purchasing uniforms worn by FedEx or US Postal Service delivery drivers.

Earlier this month, the two were accused of trying to plot a jail escape.

On the conspiracy charge, Dimitri and Joenathan Cash were arraigned in front of New York State Supreme Court Justice Victoria Argento. Both defendants are being held without bail with the opportunity to make future bail applications.

On the previous kidnapping indictment, Dimitri Cash and Joenathan Cash are being held on $150,000 cash, $450,000 bond and $1,000,000 partially secured bond.

Two convicted in kidnapping of children from Greece foster home

The father accused of arranging the kidnapping of his two young children and his cousin, one of the kidnapping suspects, have been convicted. Dimitri Cash hadlost custody of his four children after an extensive investigation into corporal punishment involving the oldest two. The youngest two...

The jury deliberated less than three hours Monday, finding both men guilty. Dimitri Cash was convicted of kidnapping: specifically, of arranging for his cousin, Joenathan Cash, to break in and kidnap the children. He was also convicted of kidnapping Monday.

Another suspect, Kimara Pluviose, is accused of breaking in with Joenathan Cash and taking the children. Her case is pending.

Both are also accused of conspiring to murder Monroe County Family Court Judge Stacey Romeo. The case has yet to be heard.
