Yes, if only the state police had conducted a thorough investigation after having been called there in the first place.

State police first responded to the Xtra Mart around 3:50 a.m. Nov. 27 after receiving a report of a baby crying outside, said Troop K public spokeswoman Melissa McMorris, at the time of the incident. However, the baby was not found until about five hours later when at least one more 911 call and additional information led police to search the dumpster, Columbia County District Attorney Paul Czajka after Tomlin’s arrest.
Five hours. No wonder they lowered the charges.

Register-Star:

HUDSON — Tara Tomlin pleaded guilty to first-degree manslaughter in Columbia County Court on Friday morning in connection with causing the death of her newborn son last November.

The guilty plea comes two days after Tomlin entered a not guilty plea and after Columbia County District Attorney Paul Czajka and Tomlin’s defense attorney, Columbia County First Public Defender Michael Howard, met Friday morning to discuss the case.

Tomlin will be held without bail in county jail until her sentencing Dec. 7, Czajka said.

The charge, a class B violent felony, carries from five to 25 years in state prison, according to state sentencing guidelines.

You mean because it took them so long to find the baby?

Yes. Inept. The child might have been found alive. The offer and acceptance of guilt on reduced charges didn't come about because they were giving this young woman a break.

Police left without finding anything, and it was five hours before the deceased child was found, according to a timeline established by Czajka and state police.
