NY limo crash: Nauman Hussain pleads guilty, avoids jail time


But the NTSB also criticized a pair of inspection shops — including a Mavis Discount Tire in Saratoga County — that inspected the stretch limousine without proper authority to do so, as well as the state of New York for failing to seize the vehicle's license plates before the crash.

Bartlett cited both of those issues in accepting Hussain's plea, noting that they could have complicated the chances of a guilty verdict at a jury trial.

The plea agreement calls for Hussain to forfeit his Fifth Amendment rights in any civil proceedings, requiring him to testify under oath in the various lawsuits filed by family members of the crash's victims.

Several families also have lawsuits pending against the Mavis tire shop, as well as the state of New York.

The plea deal also will prevent Hussain will also be prohibited from owning or operating a commercial transportation company during his probation, according to the agreement.

I just saw this and I am so appalled, so disgusted: someone, please tell me how and why this P--got no jail time- I just don't it


Well, not saying this had anything to do with the outcome, but Hussain’s father was a former FBI informant. His life as an informant began after he was arrested in an FBI sting that caught him working with a DMV employee to obtain drivers licenses for immigrants through the use of false identities.

Nauman Hussain, 31, will be free thanks to a deal made in exchange for his guilty plea even though the National Transportation Safety Board (NTSB) concluded that the crash was likely caused by his company's 'egregious disregard for safety' that resulted in brake failure.

The crash, which was also blamed on lack of state oversight by the NTSB, led to former New York Gov. Andrew Cuomo signing limousine safety bills requiring more seatbelts in limousines and further licensing for drivers."
 
A bit of info on the upcoming but delayed civil trial of defendants: Nauman Hussain and his father, Shahed, also Nauman Hussain's uncle Malik Riaz Hussain, described as "one of Pakistan's most successful real estate tycoons." The other defendant is Mavis.

Mavis also provided the Excursion with a Department of Motor Vehicles inspection sticker, a violation of state regulations that require limos that size to go through state-regulated bus inspections."

In the criminal case Nuaman H admitted guilt but wasn't given jail time. For the civil case, there is what the article describes as a roadblock: "The Long Island insurance company that provided liability coverage to Hussain's small limo operation has gone out of business. The state is liquidating the company's assets.

The Hussains had bought a $500,000 policy with the company, Global Liberty Insurance Co. The firm paid out the proceeds from the policy in October, just days after Global Liberty was taken over by the state. Each of the estates of the victims will receive roughly $24,000 after accounting for the insurer's court-approved legal expenses."

Earlier this month, Hussain, 32, was questioned via Zoom

Hussain didn't speak at all about his responsibility in the crash — the Feb. 11 video deposition was limited to questions about whether or not his wealthy uncle in Pakistan, Malik Riaz Hussain, had financed his family's limo business.

Hussain is expected to face longer and more in-depth questioning during a deposition that will be held later.

But Hussain did reveal for the first time interesting details about the role he played managing the businesses of his father, Shahed Hussain, a longtime undercover informant for the FBI's anti-terrorism task force who operated a small limousine service out of a ramshackle motel in the town of Wilton.

Shahed Hussain started the limo operation, Prestige Limousine and Chauffeur Service, in 2012. Shahed Hussain would often travel overseas for his FBI work and for personal business, often leaving his two sons to take charge.

Nauman Hussain also started two additional limo companies of his own (Saratoga Luxury and Hasy Limousine). "We didn't own any vehicles," Nauman Hussain testified. "We had, like, it was a call-in service. It was just a website, and it was almost like a brokerage service I would say, like, to offer rides to companies, um, either to Prestige or to other companies in the area. So, it was a call-in service."

in the wake of the crash, it was Hasy Limousine that refunded the credit card account of Axel Steenburg of Amsterdam, who had rented the Excursion for his wife's 30th birthday celebration with 15 of their friends.

Nauman Hussain's explanation of Saratoga Luxury and Hasy Limousine is interesting because, until now, prosecutors and state and federal investigators have said that it was Nauman Hussain who ran Prestige Limousine for his father, who left the country in March 2018, seven months before the crash.






 
The only man to be charged and convicted in connection with the 2018 Schoharie limousine crash has rejected a judge's sentencing of four years prison and vacated a plea deal that originally had him expecting to serve five years probation.
