Slightly OT, but one of the guys doing work at my house this morning had Boondock Saints tattoos. Veritas and Aequitas. Interesting. I didn't comment on it or ask questions, but was friendly.

I feel like they are just waiting to see if they can get more evidence on at least one defendant. Seems unlikely there would be a settlement but anything might be possible.

Would they be waiting until GW3's trial is complete, in case more evidence or testimony is revealed? Perhaps there's a chance Jake or Angela or another witness will testify about anything Billy might have said about his mother or events at FWF.

Billy lived at FWF before and after the murders.
 
On August 3, 2023, Attorney Owen filed a Motion for Summary Judgment on behalf of his client, Fredericka Wagner. At the time of the filing, Attorney Owen failed to request from the Court leave to file, and in open Court made a Motion for Leave to file Summary Judgment, which the Judge granted from the bench. Parties will be given until Thursday, September 7, 2023, being twenty-eight (28) days from the date of this hearing to respond to Defendant, Fredericka Wagner's Motion for Summary Judgment.

Seems FW's defense out-lawyered the plaintiff here and they risked losing the defendant carrying the purse so requesting dismissal was the better route to take than risk the Court not granting the plaintiff's Motion to stay the Summary Judgment.

My best thoughts are always with the extended Rhoden family.

Before the judge stamps that request of Duncan's, Owen may still file a response to ask for dismissal with prejudice for FW. I would if I was a defense lawyer.

Relative to Wrongful Death claims, I'm wondering if Ohio follows the practice of South Carolina where a co-defendant can be forced to carry the entire burden of any judgment (award ordered by the court) versus pro rata share.
