PIKE COUNTY, Ohio —

A town woke up one morning to the horror that eight people were brutally killed. The Rhoden family suffered an unthinkable loss eight times over on one late April night in 2016. And years would go by before an arrest was made, and the massacre of an entire family still haunts Pike County, Ohio to this day. On April 22, 2021 Edward Jake Wagner pleads guilty and agrees to testify against family members.

Event: HEARING ON MOTION FOR JURY VIEW Date: 05/16/2022 Time: 01:00 PM

Although there is relatively little case law addressing the do’s and don’ts of jury views, it has been held that parties and their counsel are not permitted to communicate with jurors during a jury view. It has also been held that it is improper for the jury to be shown properties other than the subject, although the jurors are permitted to see other property in the immediate vicinity of the subject.

Ohio law provides that the jury view is solely for the purpose of helping the jury understand the evidence that will be presented in the case. The jury view is not evidence in its own right.

Prosecutors said George Wagner will “try to distance himself from the heinous crimes.” George has another motion hearing scheduled May 16. George and his father Bill have both pleaded not guilty and are awaiting trial. Both are being held without bail.

Prosecutor Angie Canepa said the evidence will show the Wagners decided together in their kitchen to kill the Rhoden family. Canepa painted a picture of the Wagners as a controlling, insular family unit.

“This is obviously one of the highest-profile cases in the history of this community. It was a 2 and a half year investigation. There were news conferences held by the Attorney General, by the local sheriff, different members of law enforcement, updating the community on the status of the investigation,” defense attorney John Parker said.

“This was subject to great social media discussion in the community. Every pre-trial, including this one is broadcast live on the internet. It’s garnered tremendous media attention. It is our position a jury couldn’t be selected here that is fair to our client given all the publicity and notoriety of this case,” said Parker.

The defense learned for the first time in talking recently with a jury commissioner that there is a very low turnout rate in Pike County.

“Approximately 20-25 percent turnout is typical of those summonsed for jury duty. That is simply not acceptable
if we are going to have a fair cross-section of the community. And when you factor in how notorious this case is and if you combine with how turnout. Of course we don’t know until people show up or don’t show up,” said Parker.

*Motions to Suppress Hearing (@ 1pm ET) - OH - Pike County 8 people dead: Christopher Rhoden, Sr. (40), his ex-wife, Dana Manley Rhoden (37), their three children, Clarence "Frankie" Rhoden (20), Christopher Jr. (16), Hanna Mae (19); Frankie's fiancée, Hannah Hazel Gilley (20), Christopher Rhoden Sr.'s brother, Kenneth Rhoden (44), & a cousin, Gary Rhoden (37). Hanna Rhoden's baby girl (5 days old), another baby (6 mos.) and a young child (3) were unharmed. (April 21-22, 2016, Pebbles) – for *George Washington Wagner IV (27/now 30) (Jakes’ bro) indicted (11/12/18), arrested (11/13/18), charged (11/15/18) & arraigned (11/28/18) with 8 counts aggravated murder, (plus gun specifications on each), 1 count of 1st degree conspiracy, 4 counts of 1st degree aggravated burglary, 1 count of 5th degree unlawful possession of dangerous ordnance, 3 counts of 3rd degree evidence tampering, 1 count of 5th degree forgery, 1 count of 5th degree unauthorized use of computer or telecommunications, 1 count of 4th degree interception of wire, oral or electronic communication, 1 count of 5th degree obstructing justice, 1 count of 1st degree engaging in a pattern of corrupt activity. (Det. Scheiderer: We know the three calibers of firearms that were used to commit these murders. a 22 caliber long rifle, a 40 caliber, and a 30 caliber). Plead not guilty. Held without bond. DA will seek the DP. Per Jake’s plea agreement, DP is off the table if his testimony is truthful.
Trial set to begin on 8/29/22 with general voir dire for the jury, opening statements, evidence, etc. (Trial is scheduled for 30 days).
5/16/22
at 1pm - Hearing on Motion to Suppress. To be heard: Defendant's Motion #80, entitled "Defendant's motion to suppress testimony of Jake & Angela Wagner and to dismiss the death specifications & Defendant's Motion #81, entitled "Defendant's motion to suppress audio recordings.
7/5/22 through 7/8/22 & 7/11/22 through 7/15/22, beginning each day at 9am - completion of jury questionnaires by summoned prospective jurors.
8/8/22 through 8/12/22 - each day beginning at 9am - individual voir dire.
8/15/22 through 8/19/22 - each day beginning at 9am - individual voir dire.
8/29/22 at 9am - beginning of trial, including general voir dire for the jury, opening statements, evidence & so forth. The jury trial is scheduled for 30 days.

5/2/22 Update: The defense is complaining that many prosecution witnesses do not have addresses. The prosecutor doesn't want to reveal information about Elizabeth Wagner, Jake's EX because she was running for her life & had to get a new identity due to possible retaliation & she was able to get her social security number changed. According to Other Acts they stalked her & invaded her computer & social media devices & threatened to kill her family. She fled them & filed harassment & identity theft charges against Jake according to Discovery.

Also post #880 on page 40. Judge Randy Deering denied a change of venue motion filed by the defense. He said they'd try to seat a jury. Next Motion to suppress hearing on 5/16/22.

5/6/22: Journal Entry: The clerk of Courts shall hold the contents of the envelope (1 motion & 1 entry) under seal & that the envelope shall not be opened & the contents of the envelope shall not be disclosed, except upon order of this court or upon the order of a court of jurisdiction superior to this court. 5/12/22: Warrant for removal from Montgomery County jail on 5/16/22.
*George Washington Wagner III (47/now 50)Pretrial hearing on 2/1/22.
*Edward Jacob “Jake” Wagner (26/now 29) – Plead guilty (4/22/21) to all charges & will testify in the trials.
*Angela Jo Wagner (48/now 51) – 9/10/21: Plead guilty to a plea deal to Counts 9 thru 22, Counts 1-8 were dismissed. Will be sentenced to 30 years in prison with no early release & has to testify against others at trial.
*Rita Jo Newcomb (65/now 69) – Last Motions hearing on 12/2/19 entered a plea of guilty. Expected to testify in the trials.
*Fredericka Carol Wagner (76/now 80) – 6/26/19 Charges were dismissed without prejudice.

When are the sealed envelopes opened? Anyone know?
Is it at trial, or during a hearing?
Do the Defense attorneys know what is in the sealed envelopes?
I think the sealed motions/envelopes can be the defense or prosecution filing it. Not sure if both sides have access to the sealed document but it seems they would. I think there may be a date on which a sealed document can be unsealed, when either side moves the court to unseal, to unseal it after a certain time period or specific part of a trial has been concluded. These are just guesses on my part.
