I think perhaps Masipa, the former social worker/journalist, could identify with her.

That was my thought as well.

It's obviously difficult for Joe Citizen who does a public service job day in day out to suddenly find themselves under cross examination by the toughest defence lawyer in South Africa, who then wants to rake over some mundane details from months ago.

The Judge correctly did not allow Roux to put words in the witnesses mouth.

Hi Mr Fossil

Are you "back in black"?

I had an interesting debate on the Mollett's site in relation to timeline.

They are still sticking to the idea that the shots happen after Mike N's phone call and somehow Mike N and his wife don't hear them.

I am not sure they are being entirely logical about that!

I hope you don't mind me pasting this "reality checker" post on here Mr Jitty?

Mr Jitty: Hospitalisation: Pistorius is not going to escape a custodial sentence merely on the basis of some defence expert. If the Court takes this seriously he will be ordered to be fully examined by independent doctors.

Let me know, if issue ....will edit it. Thought it was useful over here.

i was wondering whether to do the same thing! I found it both informative and comforting. And the clarification that there is now no house arrest option as his sentence, whatever it is, will be more than five years. I guess occasionally we do venture into the realms of fear and fantasy but in 'our' defence, I have heard conflicting reports from journos and lawyers. I still don't know whether parole possibility kicks in after 50 or 75% of sentence served having read both cited. And in the original trial there were many conflicting statements re SA law issued by various legal commentators.

So, wonder who today's witness will be. If it is Gina Myers (?) then I hope the 'How do you sleep at night?' comes in. Doesn't prove much of anything other than what a #$%^ Pistorius is but if it makes him squirm a little, that's no bad thing IMO.

I'm off to work now and won't be back till about 1pm. Hopefully I'll catch some of the last witness if they're still on. As always, depending on you guys for the fab updates!

While we're waiting for hearing to start here's some old post extracts on sentencing guidelines for serious crimes eg. murder.

http://www.saflii.org/za/cases/ZASCA/2001/30.html
state vs malgas ( this is the key case that explains substantial & compelling)

"Unless there are, and can be seen to be, truly convincing reasons for a different response, the crimes in question are therefore required to elicit a severe, standardised and consistent response from the courts. D The specified sentences are not to be departed from lightly and for flimsy reasons.
Speculative hypotheses favourable to the offender,
undue sympathy,
aversion to imprisoning first offenders,
personal doubts as to the efficacy of the policy underlying the legislation,
and marginal differences in personal circumstances or degrees of participation between co-offenders
are to be excluded."

OTOH we have seen other murder cases where judges have taken "first offence" into account

Also brought over from DS:

Erin Bates on Twitter:

MT: We've confirmed @reevasteenkamp's cousin Kim Martin will testify for the State today in aggravation of sentence @News24 #OscarPistorius

I don't quite get the 'why' as she testified last time so unless she has something new to add, what would be the point? Not that her testimony wasn't powerful but it didn't seem to have any impact on the sentence then so ...

Here's the Guardian link if anyone needs it ...

UL - Same here. When I read it I thought - Der! Of course, that makes sense. Can you imagine though, it dragging if he were again assessed at a MH hospital FGS! ( If that's true I'll take Paul Connolly's joke as true and there's a :baby: involved. ( Apols for the levity but i din't know that emoji existed til just now!)

BIB I tried to look for you Lithgow but my connection was so poor. It was also in the threads months ago,but you know how hard it is to find your old posts.
I'm having a go, whilst we wait.

Yes , I notice on DS, that a poster says there's a flimsy rumour of Kim Martin - I'm not convinced, only because she was up before, in other respects she would fit. ( And because Mr J said that Nel can use his summing up to summarise what witnesses said in the previous hearing for CH - I didn't know that , with it being a different conviction. ) Of course Reeva had other half-siblings etc

I want Masipa to be quick with her sentencing decision and not drag this on for weeks after Friday . Hope Barry finds some relief with a prompt decision.

ETA _ just seen you post Lithgow - K.Martin. There you go.

Have a good day, I will give it a go, connectivity permitting.

This week so far:

Defence have had 6 months to work towards this hearing but hand over the psych report to the prosecution the morning of the hearing. WTF no 1
Judge gives no reprimand whatsoever to the defence for this late service. WTF no 2
Scholtz provides one sided assessment of OP based on his sessions with him and disregards all episodes of violent behaviour in his past WTF no 3
Defence produce an Icelander (did they fly her in specially for this?) to recount contact with OP from over ten years ago WTF no 4
Roux allowed to introduce OP testimony on his 'injured' hand when cross examining Mashabane WTF no 5
Repeated questions from Masipa about what the time is - can't she wear a watch or have a damn clock in court? WTF no 6
Pastor giving testimony says he doesn't want to be screened but is shown taking the oath and cameras are not switched until Roux starts questioning him WTF no 7

Unbelievable! Can it get worse today?

have you noticed how OP always makes a big show ob=f being the last to sit after Masipa enters, he waits for her! Urgh

Can you help me? I don't remember this witness. Who is she?

I suspect Oscar remembered the pretty blonde mother from Iceland and insisted she be brought in to talk about what a "nice" guy he is.

Kim Martin, RS' cousin. Gave evidence at the trial.

Good morning everyone.

Kim is doing really well. Ugh, Roux to XX.
