DA, troopers clash over shooting probe: 'We don't do things like we did in the 1950s'

The decision by state police is prompting criticism from a highly unusual source: Northampton County District Attorney John Morganelli, the man who will ultimately rule whether the troopers' use of force was justified. Morganelli said he wanted the investigation to be led by detectives in his office, only to be told by state police they were keeping it in-house.

"Essentially, they refused to relinquish the investigation to our office," Morganelli said. "I don't think it's a good practice. I'm not happy at all."

Morganelli added: "I think it is wrong."

The dispute has Morganelli considering whether to open an probe of his own into the shooting, using the subpoena power of the county's grand jury. Morganelli said he knows little of the facts surrounding Ardo's death, but believes it is important the public have confidence in any findings.

"We don't do things like we did in the 1950s," Morganelli said. "There's more transparency. There's more attention in these matters."

DA launches independent probe of Slate Belt man's fatal shooting by troopers

The fatal shooting of a suicidal Slate Belt man by state troopers will be the subject of an independent probe, Northampton County District Attorney John Morganelli said Tuesday, a day after he sharply criticized state police for insisting on investigating itself.

Morganelli said he authorized a county detective to begin gathering evidence on Saturday's shooting death of 47-year-old Anthony P. Ardo of Lower Mount Bethel Township. Morganelli said he anticipates state police will cooperate in the effort, but may tap the subpoena power of the county's grand jury if they do not.

Ardo's sister, Gina Ardo, said Tuesday her family is experiencing "the worst pain in the world."

"My mother was advised to call police by the suicide hotline. So she did that in order to get my brother the help he needed," the sister said.

"And in return, he got killed. We are all devastated," she said, calling Ardo "a threat to no one but himself."

'They rushed too quickly': Mother of man slain by police backs independent probe

She had called for police that morning with hopes they could get Anthony P. Ardo to a hospital or into a program that would help him overcome his drug addiction and anger.

"And they opened fire on him," Monaghan said Thursday afternoon in the shade of a tree on her rural property south of Bangor, a few feet from where Tony, as Ardo was known, was killed. He was 47.

On May 19, the day before Ardo was killed, Monaghan obtained a temporary protection-from-abuse order against her son over his violent, drug-fueled outbursts.

"He is very disrespectful," she told county officials, according to court records. "When he is high he gets very violent and abusive. I'm afraid of him."

Monaghan never stopped wanting to help her son.

"I got him back here for help and now he's just ...," she said, breaking off in tears. "It's a freaking nightmare."

State troopers cleared in fatal shooting of suicidal man

A Northampton County grand jury has found Pennsylvania State Police were justified in fatally shooting a man with a powerful aerial firework tied around his neck after he had been threatening suicide.

Anthony Ardo, 47, was shot six times by Troopers Eddie Pagan and Jay Splain, who responded May 22to the Lower Mount Bethel Township home of Ardo’s mother where he’d been living. Ardo arrived there while police were on scene and refused commands to get out of his car, as police could see him trying to ignite the mortar with a lighter, according to grand jury findings.

State police have also completed their investigation into what occurred and are close to approving the two troopers’ return to patrol from administrative duty, said Capt. Richard D’Ambrosio, commanding officer for the state police Bethlehem-based Troop M that covers Lower Mount Bethel Township.
