    Woman in missing baby case can no longer afford her lawyers

    The lawyers who represented a woman in the case of missing baby Gabriel Johnson since February no longer will be representing her in future court proceedings because they stated in court documents that she no longer can afford to pay them.

    Kimerer and Nguyen also tried to negotiate a plea agreement for Smith without success as the case go to trial, the court documents stated.

    Defendant in Baby Gabriel case gets court-appointed attorney

    Tammi Smith, 38, charged in the case of missing Baby Gabriel, will receive a court-appointed attorney.

    Monday, Maricopa County Superior Court Judge Paul McMurdie allowed Smith's previous lawyer, Amy Nguyen, who recently left the office of Kimerer and Derrick of Phoenix, to withdraw from the case.

    Elizabeth Johnson, Gabriel's mother, recently submitted a request to change her lawyers, Nicholas Alcock and Associates of Phoenix. She provided a list of reasons, including that she was unable to reach him personally but was referred to an associate. She also said he spoke to a member of her family without her permission.

    In the handwritten letter from jail, Johnson asked to have her former public defenders re-appointed.

    She then filed a motion to withdraw this request, and last Friday, McMurdie approved it.

    Attorneys For Baby Gabriel's Mother File For Dismissal

    CBS 5 News has learned that attorneys for the mother of an Arizona baby missing since December are filing a motion to have the case against her dismissed.

    According to court papers, Elizabeth Johnson's attorneys claim her right to an attorney was violated by an unauthorized police interview in May.

    Attorneys representing the Tempe mother of missing baby Gabriel Johnson say they are moving forward with a motion to dismiss a case against her, claiming her constitutional rights were violated when a San Antonio police detective interviewed her in May in a Maricopa County jail.

    The attorneys claim their relationship with Johnson has been damaged beyond repair because of the interview and they no longer could ethically represent her.

    “This is outrageous,” Alcock told the Tribune on Friday. “This was an exhausting interview, and by the end of it, she was clearly disturbed."

    According to the motion, the Maricopa County Attorney's Office had already turned down the detective's request for an interview, but he managed to gain access to Johnson. He spoke to her for at least three hours outside the presence of her attorneys and tape-recorded statements that he refused to disclose, some of which may have been incriminating.

    According to the motion and to the defense lawyers' account of events, the San Antonio detective contacted the Maricopa County Attorney's Office and asked to interview Johnson and an informant against her in the Estrella Jail. The attorneys claim that the Maricopa County Attorney's Office denied the request to talk to Johnson.

    But on May 10, a prosecutor and a Tempe detective accompanied the San Antonio detective to the jail to talk to the informant. After that interview, the Tempe detective and the prosecutor left, but the San Antonio detective stayed behind.

    There, according to the motion, he was able to meet with Johnson and convinced jail personnel to remove her shackles. Then, according to the defense team, the two sat knee to knee and the detective even touched Johnson's thighs as he told her details about his own personal life.

    Elizabeth Johnson's Attorney Alleges Unlawful Questioning

    "What happened here is outrageous, what happened here is completely unusual," says Alcock. "This detective was told don't go there, don't go visit Miss Johnson and he did."

    According to court paperwork, Johnson was on lithium during the questioning. The detective allegedly removed her shackles, held her hand and touched her thigh, asking her about the whereabouts of baby Gabriel.

    "The mood went from touchy-feely to very aggressive, and back to crying together. That's an outrageous set of circumstances and to not have your attorney present is unheard of."

    Alcock says MCSO jail staff confirm that Tempe Police set up the interview for San Antonio. He claims both departments are working together and violated her rights by interviewing her without an attorney.

    Missing toddler's mom wants charges against her dropped

    Alcock claims there is a tape recording of the interview, but admits he has not heard it. His arguments are based on a prison guard's account of what happened.

    San Antonio Police Chief Bill McManus could not confirm or deny a recording exists.

    "I don't know that that happened," McManus says. "The visit was in reference to Texas criminal charges as opposed to what they were looking at in Arizona. So I don't know if you could say that it was unauthorized."

    Alcock says he and his colleague Adam Feldman plan on withdrawing as Johnson's lawyers.

    Elizabeth Johnson Confident She Will Soon Be Set Free
    Johnson Told Grandfather She Is Happy, Hopeful

    Elizabeth Johnson hadn't talked to her grandfather in months, but she called him from behind bars last Friday in good spirits, happy and confident that she will soon be set free.

    He also told CBS5 News that she seems much more stable now that she is taking anti-anxiety medicine. But he said she would still rather stay in jail than see Gabriel safely returned to his biological father, Logan McQueary.

    CBS5 News has also learned that after the interrogation, that lasted more than three hours and involved crying, praying, touching and hand-holding, San Antonio Detective Jesse Salame went straight to the Tempe Police Department to debrief local investigators.

    CBS5 News spoke with Logan McQueary, Gabriel's father. He said he talked with Detective Salame on the phone for more than an hour Monday.

    McQueary was not happy that Salame may have damaged the case against Johnson, but after the call, he said Salame convinced him that the interview with Gabriel's mother was proper.

    McQueary said of Johnson's attorney, "I think Alcock is talking it up. This is all a show because he knows this is the only way she will get out of jail anytime soon. We are still looking for Gabe. We don't know what happened to him, and she shouldn't be let out until we know the truth."

    Attorneys representing Elizabeth Johnson, the Arizona mother charged with kidnapping in the case of the missing 8-month-old baby Gabriel Johnson, have accused a San Antonio Police detective of wrecking her defense by conducting an unauthorized interview with her.

    Police Chief William McManus said the detective did conduct the interview May 10, three months after a police investigation here led to a landfill search on the possibility that the baby was killed and thrown in the trash.

    But McManus called the defense claims unsubstantiated and said the detective has not been removed from the case.

    Baby Gabriel's Mother Gets Trial Delayed

    Missing Baby Gabriel Johnson's mother and the Scottsdale woman who was trying to adopt him had their trial dates postponed on Wednesday.

    The judge was ready to set a trial date but defense teams for both women requested more time to prepare their cases, which delayed the courts again.

    A trial date for the Tempe mother of a missing baby is expected to be set by a Maricopa County Superior Court judge on Tuesday. He also will decide whether to dismiss the high-profile case.

    During a hearing held in Judge Paul McMurdie’s courtroom on Wednesday, McMurdie set the hearing to determine when the trial of Elizabeth Johnson and Tammi Peters Smith will begin, stemming from a case of Johnson’s missing son, Gabriel, who was last seen Dec. 26 at a motel in San Antonio when she took him there in the midst of a custody battle.

    The mother of missing baby Gabriel Johnson and the Scottsdale woman who was trying to adopt him waived their scheduled court appearances Tuesday.

    Elizabeth Johnson, Gabriel's mother, and Tammi Smith will next appear in court Nov. 22, where their court-appointed attorneys will be assigned, according to court documents.

    The state has alleged that a Scottsdale woman charged in the disappearance of Baby Gabriel Johnson discussed adopting his mother as a way to gain custody of the child, according to a defense motion.

    The state says Tammi Smith, 38, who wanted to adopt Gabriel, and Elizabeth Johnson, 24, of Tempe, the baby's mother, also discussed seeking a change of venue to Tennessee in the custody case.

    In addition, the state alleges, the two talked about using child-support payments to pressure the baby's father, Logan McQueary, into surrendering his rights, according to the motion.

    But Smith's lawyers filed a defense motion Dec. 1 saying that "the discussion of an adult adoption or a change of venue ... cannot be made criminal under a vague conspiracy law."

    Plea talks are no longer continuing for Smith, her attorney said. Johnson's motion to dismiss the case has not yet been heard.

    A status conference on the case is scheduled for Thursday.
