I actually believe that JA contacted BN for his "expertise" regarding the computer. She must have been very impressed with his "ninja in the eye" work. I also believe it was him who wanted the "expert" work but had to get someone else to do the actual report for him and that he was going to try to fudge it until he realized he was in way over his head.

These computer experts aren't very professional when we laypeople know more about Spybot and ZLOB Trojans than they do!

I think what happened is that Sue did some work and that was supposed to be the end of his involvement - he never expected to testify. Then we had the fun and games where BN was accusing Juan of not knowing computers - which ended up with Juan proving that BN didn't know diddly squat, so he had to bail and they had to browbeat Sue into taking the stand. But of course that gave them the opportunity to screw with Juan and waste a week or so of his time chasing ghosts.

And then it seemed like KN realized how devastating to his lies the whole Incinerator business was, so he moved to keep that out. And of course he was successful in that regard. Certainly we shouldn't introduce any evidence that the defense tinkered with the evidence and then used that tainted evidence to accuse the state of destroying evidence. What relevance could that possible have?

I have no doubt Sue never expected to testify, albeit I question why one would think they would never have to testify to something they were reviewing for a court case (even if they don't know what the case is like Sue testified he didn't). I would have to assume it's always a possibility, but that's beside the point. I do think that BN blew the defense plan to pass it all off as his work by deciding to try to go head to head with Juan accusing him of not understanding computers (guess BN didn't learn his lesson despite the smack down how received during the ninja in the eye hearing). Maybe JA hired BN and BN hired Sue or maybe JA hired both, either way Sue's identity is germane to the credibility of his testimony in my opinion, especially so given the timeline of when he was hired coinciding with the dates JA was pro se.

Of course we wouldn't introduce evidence of the defense shenanigans! Why that would simply be preposterous and certainly wouldn't be relevant to the case in the least. After all, didn't we all get the memo that the defense can say absolutely anything they want with zero proof and zero repercussions because clearly delicate flower JA deserves nothing but the whole kitchen, including the sink, even when the case is only about the garage.

I just cant believe the "shady games" that ALL parties, except Juan are doing in this trial.

1-The judge herself totally ignored 1 higher court (COA) and now she is stalling on the Supreme Court ruling. She needs to immediately obey the higher courts. Period.
She may not have had valid concerns of appeals before now, but she sure is causing her own by disobeying higher courts.

2-The DT lawyers. They have been playing dirty stalling games all along, so no surprise here as that will continue to the bitter end.

3-Mr. Smith, Neumeister, and Co. If they ever pulled this stunt (1 claiming he did computer work but it was another person) in past cases that helped convict anyone, then ALL those previous cases will darn sure have a legal "out" to have the cases overturned and prisoners freed. And if that happens, then someone needs to have purjery charges brought against them and victims should be able to sue them as well for allowing their perpretrators to go free. If any previous cases were lawsuits, then large sums of money may have had to be forked over in a judgement and that may be overturned as well.

4-Juan is the only party in this case that is not doing "shady", immoral, or illegal things. WTH.

I see stuff like the defense asking the judge to tell JM what to ask or not ask and I can't help but wonder what the heck they are hiding? If it's something the defense can ask about in direct then JM has every right to follow up on it within his cross.

I think BN felt (and his other cohorts agreed) that he was the best person capable to handle being grilled on the stand and so he just claimed he did all the computer analysis too until Juan tore that apart.

If that is what happened, I truly wonder how many other cases they pulled this stunt on.

If that is what happened, I truly wonder how many other cases they pulled this stunt on.

I really do think BN needs to be looked at in regards to allowing him to be an "expert" in any trial. I certainly hope after this fiasco that the state does not use his services again. It's all just way too fishy. And of course it appears it's all going to be swept under the rug even though JM seemed to REALLY want to bring it all to the surface.
