Sentencing and beyond- Jodi Arias General Discussion #3

I don't see any reason she would consent, unless she were sharing in the profits. It would be legal for her to share in the profits unless the book depicted the CRIME itself rather than the trial--and it sounds like it's about the trial. On the other hand, I saw on Nurmi's Twitter account that he says she's not getting a dime. In that case, I am puzzled why she would consent to his public discussion of the representation.

I don't get the appeal strategy theory, sorry.
BBM - Can she use the fact that her lawyer wrote about the trial (and about her by proxy) to get a new trial? Can she claim ineffective assistance of council due to anything he writes in his books? I really doubt she gave her consent for him to write a book because she hates Nurmi almost as much as she hates Juan.

AZL left.

Feels like being in a life raft after the ship sank and a rescue plane flew over, but didn't see the SOS flares. Come baaaaaack, AZL....

...:D

The pedophilia lie was the nexus of Nurmi & Arias Inc.'s defense. Being his "dirty little secret" couldn't explain why she killed him in self defense, and Slime Inc. needed to explain why it is was that Travis beat her up and degraded her and lashed her verbally but demonstrably was huggy and warm and kind and respectful towards every other girl he had ever met since he was in diapers.

Enter the pedo lie. Travis abused her because THAT was his dirty little secret, not her, and she was the only one who knew about it. Which is why he began abusing her the very next day after her grim discovery which made her vomit and reach for God and beg Travis to drop what he was doing to answer her calls.

The broken finger lie was to cover for any residual tendon damage she sustained when she slashed him so viciously. Ryan Burns reported she came with bandaids over her fingers.

This trial was interesting the way she twisted so much. There was so much "Jodi Baggage" and side stories that it confused a lot of people. Most of it involved flat out lies that originated with JA.

One thing I found interesting was how so many people believed TA had to have done something pretty bad to her in order for her to have killed him. They couldnt accept that she killed him so violently without having a real good reason to. They couldn't accept it was just due to him simply not wanting to be with her anymore.

A lot of people believed he treated her terribly like a sex slave and then threw her out on the street and treated her like trash for no good reason. They couldn't accept that JA was the real sexual aggressor in the relationship with using sex as a weapon.

I had so many discussions with people that had not followed the case and where they would tell me that he had to have done something bad to her for her to have killed him so violently. I tried to explain , NO, there really was nothing he did wrong except to try to get her out of his life once he finally realized what a possessive freak of nature she was.

I tried to explain how he was very nice to her for the longest time and a very forgiving person. It was only when JA couldn't accept the relationship was ending that JA herself began slitting tires and playing dirty tricks to him and his friends with his text messages and phone.
It was only after she had done some very bad things to him that he started to talk mean to her on some of the messages.

The crazy thing about it was even if TA would have been much more meaner to her and was the mean person some made him out to be, then those same people would somehow think its ok to kill someone over it?

What a bizarre person she is. Definitely ill in the mind and that is what a lot of people did not realize was how sick in the mind she truly was. She hid it well and fooled lots of people.

Okay. I can’t help myself; off I go, down a rabbit trail. I earlier posited that KN might be trying to distance himself from criminal charges being pursued by the AG’s office. Thanks to AZL (my hero!), found the following reference in AZ Bar Ethics Rules: 1.6

(a) A lawyer shall not reveal information relating to the representation of a client unless the client gives informed consent, the disclosure is impliedly authorized in order to carry out the representation or the disclosure is permitted or required by paragraphs (b), (c) or (d), or ER 3.3(a)(3).

(b) A lawyer shall reveal such information to the extent the lawyer reasonably believes necessary to prevent the client from committing a criminal act that the lawyer believes is likely to result in death or substantial bodily harm.

(c) A lawyer may reveal the intention of the lawyer's client to commit a crime and the information necessary to prevent the crime.

(d) A lawyer may reveal such information relating to the representation of a client to the extent the lawyer reasonably believes necessary:

[EDITED OUT 1-3]

4) to establish a claim or defense on behalf of the lawyer in a controversy between the lawyer and the client, to establish a defense to a criminal charge or civil claim against the lawyer based upon conduct in which the client was involved, or to respond to allegations in any proceeding concerning the lawyer's representation of the client (bbm)

BBM. On that point, we have to give Nurmi credit- he didn't defend her because she sexually manipulated him. He's got that over Samuels...

Re the LV guy, she must've gone out of her way(see map below) for a reason that day and just for the cell thing just doesn't make enough sense to me. Otoh, perhaps she had someone waiting for her in LV with a place to clean up properly, feed her, possibly willing to help her dispose of stuff, etc.

ALV said on the stand "why yes, when she holds it a certain way". Along with her saying Jodi told her the knife was on the nightstand , and that the gun went off in the closet. The next day ALV says she "misspoke" the day before.

Transcript of Jodi's interview with Det. Flores;

19:31
DF: And which route did you take home from there?

19:34
JA: I was supposed to get on the 15 and go all the way up,

19:39
DF: Uh huh…

19:40
JA: and I somehow got off of 15.

19:43
DF: Where did you end up?

19:45
JA: Umm for awhile I was lost, and I’m not above sleeping in the car so I slept for awhile. I’m a heavy sleeper and I sleep a lot, so.

19:53
DF: But you were on the 15 for awhile and you ended up getting off the 15 somewhere?

19:57
JA: Yeah, I looked at a map but I’m pretty sure I know where I went. Can I draw you a map?

(Detective Flores tears off a sheet of paper)

20:02
DF: Sure.

20:07
JA: ‘Cos I eventually started seeing signs umm for Phoenix, and I was like… and it was several hundred miles away still, like that’s weird, where am I going, ummm… (JA begins to draw a map on paper). So you have California, Los Angeles, and … ummm Nevada... Arizona…Utah, and I was supposed to go somewhere right up here… oops.. I’m a lefty…so 15 kinda' does one of these

20:33
DF: Yeah… goes through let’s say Las Vegas right here…

20:37
JA: Oh yeah. I’m sorry. My map is so wrong.

20:40
DF: No… that’s okay… that’s okay. So we’ll just put…just put…

20:42
JA: I know it cuts through Arizona on the corner... Las Vegas... umm…St. George is somewhere here… and then… the 40 runs somewhere this way, ‘cos somehow I ended up on the 40, and when I saw the 40, I’m like… the only thing I associate with the 40 is Flagstaff, and Flagstaff is somewhere Utah... I mean northern Arizona, and so ummm… I was going east, and I was like this isn’t, what’s going on here? I wasn’t going the right way. I’ve had for the last 2 years, I’ve had a car that has a GPS system in it and it’s really good, and umm…it…I think it hasn’t served me as far as getting a sense of direction when I moved to Palm Desert…

21:36
DF: Yeah, you kind of rely on it a little too much.

21:37
JA: Too much. In fact, when I moved, when I moved in with the last place I lived in Arizona I did not know how close it was to Travis. I didn’t realize. Ummm…I have a very bad sense of direction and it wasn’t until I began to… I used my GPS the whole time I was there pretty much just to find things, Umm anyway, so I got back… I looked at the Mapquest that I had Mapquested a bunch of places…I was (unintelligible) Death Valley…I was

22:08
DF: Did you actually cross over into Arizona? Is that how far you went?

22:11
JA: I crossed over twice, I think. My map is wrong because the 93 goes North, and then I hit the 15 again, and then I got here, and then I hit Arizona, and then I’m here… but somehow I got north on the 93

22:27
DF: Okay

22:27
JA: and then I hit the 15. So, I mean I don’t know where Phoenix is, Mesa, it’s gotta’ be over here. I didn’t go anywhere near there.

22:35
DF: So you took this trip and you left on…was it Monday the 2nd? Right? And you didn’t get to Utah until Thursday, you told me.

22:52
JA: Yeah, I got to Utah on Thursday.

22:54
DF: So Thursday, that’s the 5th.

22:59:
JA: Uhh yeah… I think so.

23:01
DF: Monday, Tuesday, Wednesday, Thursday. Okay so we have 48 hours there but well, obviously 3 days, but there’s 48 hours... This trip took you a little over 48 hours. Umm…I have a problem with this trip.

23:22
JA: Well I went first to…

23:24
DF: Yeah, I know you went down here. But obviously, Yreka right there, beautiful little place here except it’s kind of smoky. I was hoping to see some mountains, but…

23:38
JA: You really should see Mt. Shasta, if you get a chance.

23:41
DF: Okay. I’ve gone over this trip over and over in my mind and on paper and even if there’s still 20 some odd hours, even if you pulled over to sleep a couple of times.

23:49
JA: But, did I tell you that I got stranded?

24:01
DF: Yeah.

24:01
JA: Okay.

24:02
DF: You mentioned that. If you slept for 10 hours.

24:06
JA: I only slept for like an hour.

24:07
DF: here and here… it would still leave 18 somewhat hours or something else. This is what people are focusing on. This trip that you took. She left. She took Thursday. Wednesday. This was when Travis was killed.

24:38
JA: I did not go near his house. Isn’t there… aren’t there…

24:42
DF: I pulled your cell records. Your cell phone was turned off between here and here. Okay. But… the last place that pulled it was here. The next place it turned on was here. What does that show me?

25:04
JA: Oh… well I began… Oh no, no, no...

25:07
DF: Is there plenty of time for you to do that? Yes! And do I believe that you had come to visit Travis? Yes. I truly believe it. Did you have the opportunity? Yes. You were traveling alone. There are no other witnesses. Your phone just happened to turn off from here to here.

25:27
JA: Well, I didn’t turn it off physically, but it died.

25:31
DF: And then it magically…you found your charger here?

25:34
JA: It was… it was under the …packed (??) under the seat of the passenger side, and it was when I was…

25:40
DF: When you were lost you couldn’t have maybe pulled over and found it or…?

25:43
JA: Well, I did finally start looking when I was stranded. I wouldn’t have pulled over when I was lost.

25:49
DF: Okay. I’ve been focusing on this and going over and over in my mind why this happened… why your phone turns off here outside of Los Angeles…

26:02
JA: What city is that because I got…

26:03
DF: going towards…

26:04
JA: as far as ummm

26:05
DF: It’s not cities, there are towers.

26:06
JA: Oh, okay.

26:07
DF: There are towers dotted all over this place. One tower hit here, the other tower here on the 93. There’s no way somebody can get on that 15 and magically get on that 93, 'cos that 15 goes right through Las Vegas. Right there. It continues this way. It never goes through Arizona.

26:28
JA: I got off before Las Vegas.

26:31
DF: Okay.

26:34
JA: I didn’t get back on.

26:35
DF: To 15, you didn’t have to go through Las Vegas and then come down south, go through Boulder City…

26:41
JA: I went through Boulder City going north?

26:45
DF: Did you cross over the dam?

26:49
JA: Uh huh

26:51
DF: And you didn’t think that was odd you were crossing over Arizona?

26:53
JA: Well, after…I figured out I was lost by then and I found 93 and found my way back to 15.

26:59
DF: And this tower here, it’s not just over the border in Arizona, it’s quite a distance inside of Arizona that it hit, because there’s a mountain range all along here, and if you’re on this side of the mountain range, pretty good distance, that signals not going to hit or power to Utah or Nevada or California. It’s only going to hit in Arizona.

27:26
JA: Well, I had somehow gotten off of the 15 and got onto the 40… is what happened.

27:32
DF: Well, the only way you can get onto the 40 is if after you cross the bridge, or the dam…

27:41
JA: I think I got on the 40 in California.

27:46
DF: From the 15?

27:49
JA: Well, like…’cos I had actually gotten… I actually began to drive the10 west.

27:53
DF: But do you see what I’m saying… the confusion we’re having? And we’ll come back to this…

28:00
JA: Well, I got on the 40 somewhere over here.

28:03
DF: In California.

28:04
JA: Yeah, and continued to drive this way. Realized I was not in the right place at all, and then I got onto the 93 North and then I hit the 15 again and then I went through Las Vegas and then St. George and then onto Utah.

28:17
DF: Okay. That still doesn’t make any sense to me. And I can pull the maps and show them to you and you can go over and over again, but I don’t think you’re being completely honest with me about that trip.

28:31
JA: I honestly got lost. It’s… it’s bad timing.

28:40
DF: Were you at Travis’s house on Wednesday?

28:42
JA: Absolutely not! I was nowhere near Mesa. I was nowhere near Phoenix.

DF: (Sighs)

28:53
JA: I wasn’t even close to him. Umm

28:58
DF: What if I can show you proof you were there?
Would you change your mind?

29:05
JA: I wasn’t there!

DF: Be honest with me, Jodi.

29:09
JA: I was not at Travis’s house. I was not…

29:15
DF: You were at Travis’s house. You guys had a sexual encounter, which there’s pictures, and we know there are pictures, because I have them. I will show them to you. Okay? So… what I’m asking you is for you to be honest with me. I know you were there.

29:46
JA: Are you sure those pictures aren’t from another time?

29:48
DF: Positive. Absolutely positive.

29:57
JA: The last time I had any sexual contact with Travis was in April.

30:09
DF: Remember I told you about the camera. That camera was damaged. Someone put it in the washing machine. Ran it through a wash cycle with some clothes of Travis’s, but the card is intact. Remember I told you that card was destroyed? I didn’t want to tell you the truth, because I wanted to make sure those photos were accurate and we can pull deleted photos. I don’t care if you delete ‘em six months ago, we can pull every photo that was on there… pull the little pixels together, get the time stamps, and we can verify those time stamps, and I have pictures of you in Travis’s bedroom with Travis, pictures of him, and it’s obvious you guys are having sex, taking photos of each other, and they’re dated and time stamped on the day he died.

31:17
JA: Are you sure it’s me? I mean…’cos I was not there…

31:20
DF: Jodi. It’s you…and you know it’s you…

AZL!!!

Is it at all possible that JSS, in a sealed hearing about KN's requests to be released from the DT, would have granted post-trial latitude to KN's talking re: strategy. I mean, good Lord. His client basically insisted he allow her to lie under oath. As much as I disliked his demeanor, he DID rally the only argument with which he was left.

Hum. I'm beginning to feel a leeeeetle sympathy for 'ole KN. Talk about a rock and a hard spot ...

I have long suspected that JA used Vegas as a way to make some quick money whenever she desparately wanted to make some quick cash.

I don't think she ever wanted to be a hooker but I do think she would do that as a last resort when she needed funds.

Remember the hair salon that was out of the way and seemed a strange side trip. I think that place would doll her up real nice and she knew about that place because she would go there to get prepared for a Vegas money run. So when she needed to disguise herself she went to the place she knew could do the job on her hair real good.

This little side trip on her way home tells me she may have done a one night hooker stand to make some cash since she was in the area.

All speculation of course.

I can see how excessive publicity could harm a person's ability to get a fair trial but have not seen many actual cases where that has occurred.

For Arias I can't see it being given much weight by any court. Most of her publicity was of her own doing.

She wanted people to look at her and listen to her. Until she didn't. Then she wanted secrecy.

I trust the courts that will be involved in the appeals process to use common sense.

I trust that AZ courts from bottom to top have not only common sense but a sense that it is past time to close this show down at long last. .

Beyond AZ, if it goes that far, "common sense" is irrelevant if judges are open to trying to make a constitutional point.

In fact, I think it is legitimate to worry about how social media can affect how high profile trials are conducted, especially for long trials with unsequestered juries.

Yes, it certainly is a legitimate concern for justice in general.

However, in THIS case, social media was used by the defense, the defendant, her litigation specialist, her family, her fundraisers, her witnesses who were too scared to appear in court but had no qualms about doing so on twitter and facebook...

I just think that people have to be held accountable for their actions and no one should be able to come back later and blame anything on the firestorm that they started.

I expect that in time we will see some sort of legislation in a variety of states and even on the federal level at some point that governs the social media of those involved in any legal action. With free speech being a potential factor with such legislation I suspect it will have to deal with everyone being duly warned and if they don't heed the warnings they will have to reap what they sow.

Arias' case was highly publicized but would it have been to that degree had she not started that ball rolling?

Butcheress #281129 should be real proud of herself, not only did she steal from her grandpa, she literally broke his heart. May his soul rest in peace. She will never be able to say goodbye to a family member all because of jealousy, rejection, and the fear of being exposed for what Travis knew about her... it must have been something pretty bad for her to silence him. Who will be left to claim her body when she takes her last breath?

http://www.azcentral.com/community/...ve-video-jodi-arias-verdict-murder-trial.html

While Alexander’s supporters cheered the verdict, the news was a blow for Arias’ relatives.

“I’m very upset about it, but I have to live with it. There’s nothing I can do about it,” said Jodi Arias’ grandfather, Sonny Allen, by phone from his home in Yreka, Calif. “I don’t think she deserves death.”

Allen’s daughter, Jodi Arias’ aunt, Sue Ann Halterman, called him about the verdict shortly after it was read, he said. Allen added that it had come as a complete shock to him when police came to his house to arrest his granddaughter in July 2008.

“To tell you the truth, I would never have believed she’d have done it if she hadn’t confessed. She didn’t want to kill anything; she wouldn’t even kill a damn yellowjacket,” he said.

I've been reading voluminous texts and besides most of the stuff we are already, JA DID dye her hair back to brunette on March 20, 2008. She even texted to TA on how much her mom does not like it. Her mom was in AZ because JA was moving at the end of the month.

So, maybe the pics are from another day, maybe late March? Nah... what I am thinking!

Also, I think TA is mad at her when he freaks out is because JA makes a fake profile on Facebook or MySpace and befriends (Elena - Lisa's bestie and roommate) and starts saying things about TA perhaps that he is not a virgin as this "Michelle K" had sex with him?

This is the when he says "you either fess up or you will feel the wrath with your imaginary friend I will tell everyone that matters to you what you have done ..."

The name is The Official,*Super Duper, Actual, Authentic, Original JA Defense Fund. It's a parody of JA's site.

Jodi's Hair Color
Re: Hair color

On direct Nurmi shows a picture of Jodi with the dog, supposedly taken May 15, 2008:

http://www.youtube.com/watch?feature..._E3V-o#t=2376s

Her hair looks blond to me, although Nurmi describes it as brown. He asks if her hair was similar when she rented the car, and she says yes.
Nurmi asks if she changed her hair color from that pic above until she was at Travis' June 4, and she says she died it brown while she was in Mesa and died it darker brown later, but doesn't say when:

http://www.youtube.com/watch?feature...N6WxOs#t=1861s

She later testifies that she dyed it brown on March 20, 2008, even though Ryan first met her in April 2008 and it was blond:

http://www.youtube.com/watch?feature...N6WxOs#t=2246s

Later, Nurmi asks Jodi what color her hair was when she left Pasadena for Mesa, and she says auburn brown.and she says she did not stop to dye it along the way.

http://www.youtube.com/watch?feature..._E3V-o#t=3930s

So it was blond in Redding, auburn brown when she was in Pasadena, but she didn't stop to dye it?

In testimony a couple days prior, Nurmi asked when she died her hair, her testimony sounds contradictory, as she says she died it before Convention and also that she waited until after Convention to dye it:

http://www.youtube.com/watch?feature...M2qT4k#t=2249s

She then identifies these pics that were taken after she moved back to Yreka, and her hair was "various shades of brown"

http://www.youtube.com/watch?feature...N6WxOs#t=1598s

On murder day, June 4, 2008, her hair was clearly dark brown, with no blond highlights --but she thought she had deleted that evidence.

Here's a pic of her mugshot, a little more than a month after killing Travis. This is the picture that the car rental guy ID'd her from but said that her hair was different when she rented the car -- it was blond at that time.

She was blond when she met Ryan in April 2008, She was blond when she rented the car on June 2, 2008, and she was brunette when she arrived at Travis' on June 4, 2008, and she was brunette when she met Ryan on June 5, 2008

CONCLUSION: She died her hair darker brown after she rented the car on June 2, 2008 but before she arrived at Travis' house on June 4, 2008. There is no other way to make sense of this.
----------------------------

Not to mention the fact that the picture identified as being taken on May 15, 2008 was likely taken in 2007 as it appears to be taken at the same time as this picture in Jodi's myspace album that was last edited in February 2007:

She was so upset when she wrote that 12 page letter that she referred to herself as an inmate. I loved it. Then she writes about how he didn't impeach Deanna Reid like he was supposed to. She really hates Deanna. Personally I thought he was horrible to Deanna and did try to impeach her but he couldn't because she did not say under oath that she did not have relations with Travis.

And what about that business with Chaitanya Lay? I don't remember a text between TA and Chaitanya about them having sex. CMJA refers to it as a conversation between them but there would be no evidence of a conversation so it had to be a text she was referring to. Then claims TA bragged about how good he was in bed with Chaitanya. The only one that brags is JA. Just read her journal. She talks about singing and how she really nailed it.

Does anyone know what books were confiscated in her jail cell she referred to? She said she had written some notes in the margins and the LE confiscated them but later found out it was nothing but Nurmi refused to get them back for her. More code to you think????
