Defense delay tactic IMO.

As individual questioning continues Monday for the jury in the LeMaricus Davidson trial, the defense has asked for more DNA testing on evidence that recently came under the microscope.
The defense predicted the testing called Y-STR, that may be approved for panties belonging to murder victim Channon Christian, would delay the trial.

What will the defense say if this DNA turns out to be Davidson's?

The judge just delayed the trial for one week. This is presumably for the DNA testing to be completed.

The trial of LeMaricus Davidson will be delayed for a week so special DNA testing can be conducted, the judge ruled Tuesday before jury questioning began.
The trial's start date is pushed back from October 5 to October 12.

The medical examiner, who was the key prosecution witness in the Cobbins trial, will be out of the country. The judge pushed the trial back another week to October 19.

A jury was seated Friday for the trial of LeMaricus Davidson, the alleged ringleader in the murders of Channon Christian and Christopher Newsom.
The jury is made up of seven women and five men. Eleven of them are white. One is a black man.
Six alternates, three white men and three white women, were also chosen for the jury in the racially-charged case.
The defense was hoping for more black jurors, basing that choice on the stereotyped belief that many African Americans are against the death penalty.
6 News legal expert Greg Isaacs said the defense isn't surprised with the jury makeup.
"If you wanted and fought to have a jury from Knox County, you know from the beginning that your choices are limited," said Isaacs.
The judge said the jurors will be sequestered the night before opening arguments, which are due to start on October 19. They have a wait of a little more than two weeks.

So why weren't these pics used at Cobbins trial?

(snips)
The state filed notice Friday that it plans to use photos of murder victims Channon Christian and Christopher Newsom during the sentencing phase of the LeMaricus Davidson trial.

The state says introducing the photos "is in full accordance with the guidance provided by the Tennessee Supreme Court and United States Supreme Court..."
The state also says excluding photos of the victims if the defense introduces photos of Davidson during the sentencing would "strike an unfair balance between the accuser and the accused."

Right after the Cobbins trial I heard a radio interview with Channon's parents. They said photos of the victims were not allowed by the judge.

But the convicted killers can bring in their families to show what fine 'boys' these guys were at some point and how their family will miss them if given the death penalty :furious: ... Geez, but no pictures of the victims before they were MURDERED!!!

I had heard that too. I just don't get why in Cobbins trial it was denied but a possibility at Davidson's trial. IMO, the prosecution makes a good argument to allow it.
