New thread for a new day. Please remember the rules
    :tos:

    discuss here.

    --------
the crown will present its' case in chapters:

Chapter 1: The day of the kidnapping. The surveillance video showing Rafferty driving up the street outside Tori's school and McClintic walking Tori up the street. Witnesses from and around Oliver Stephens public school will talk about seeing Tori.

An identification officer will use photographs and maps to show the route from Woodstock to Guelph.

Tori's mother, Tara McDonald, will testify about the frantic hours the family spent looking for Tori.

Chapter 2: Terri-Lynne McClintic. "She was an essential part of all that happened," Gowdey said. "I expect her credibility will be a major issue in this case."

Chapter 3: Guelph -- video surveillance and bank records detailing the events there.

Chapter 4: the Mount Forest death scene, which the jury will visit. "It will be difficult to go to the very place where this happened, I know that, but understanding the crime scene is crucial to understanding the crime," Gowdey said. Photographs, some of them graphic, will be used to explain "exactly how the killing happened."

"Unfortunately it is only through them that you can fully understand (the) evidence," Gowdey said.

Chapter 5: Police interaction with Rafferty.

Chapter 6: The searches of Rafferty and McClintic's residences and the evidence found.

Chapter 7: The Honda Civic. What was found inside.

Chapter 8: Rafferty's connection to the Mount Forest area.

Chapter 9: Comments Rafferty made to friends after April 8. "He had some interesting things to say to other people about Terri-Lynne McClintic and about the kidnapping itself," Gowdey said.

Chapter 10: The May 15 weekend and Rafferty's actions.

Chapter 11: The BlackBerry. The BlackBerry allowed police to track his movements April 8 and after.

Chapter 12: A recap of the surveillance video.

Thank you nursebeeme for the reminder as well. I am certain the "facebook poster" did not mean to bring the trial to a halt with their "post" on the web.

    Good Morning! :seeya:

There was discussion about MR's family on the other thread and whether or not they were attending the trial. Do we know anything about his family? Did he live with his parents? Mom? Dad? Does he have siblings?

It was so long ago but for some reason I recall a family member saying how much he was good with children and he would never hurt a child. Well, we know we've heard this before in other cases.......

Just curious about his family dynamics. Thanks to anyone who knows.

I believe I read that TLM is testifying on Friday and her testimony will last for a few days.

I don't think much is known about his family. If memory serves me, I believe he lived at home with his mother, and not sure if his father was even in the picture. HTH

At London courthouse for the third day of Michael Rafferty's trial in the kidnapping, sexual assault and murder of #ToriStafford

Tara McDonald, Tori's mother, will likely testify today. She arrived a few minutes ago, accompanied by her father, Jim

Mr. McDonald, #ToriStafford's grandfather, was asked if he was worried about the pain of his daughter testifying: "She's a pretty tough kid.

After #ToriStafford disappeared, Tara McDonald and her partner, James Goris, held frequent vigils and other public appeals for her return

A small purple plastic box of ribbons, labelled "Justice for Tori" with a picture of the little girl, sits on the concrete courthouse plaza

Since then, however, they have kept a low profile and moved away from Woodstock for a while. #ToriStafford

    Just my own thoughts here:
MTR is pleading "not guilty" on all charges, one being of kidnapping. Now there is a significant difference in sentencing between kidnapping and abduction. As per: http://www.nugget.ca/PrintArticle.aspx?e=1589152 and http://en.wikipedia.org/wiki/Kidnapping#Kidnapping_versus_abduction which makes sense then why defense has asked only few pointed questions so far: such as of Tori's teacher whether Tori had placed the retrieved earrings in her ears before leaving the school. (implies that she felt comfortable enough to place them afterwards). Also commented during teacher's questioning that there was no audible confrontation heard from the schoolyard. The parent on the sidewalk was asked if there was any physical contact or signs of aggression while TLM and Tori passed them on the sidewalk. Methinks this is to attempt to dispute the claim of kidnapping by inserting that Tori went willingly and of her own free will.
    MOO and purely conjecture

Im tending to think thats where this is going to head also. That he did not know that the events that unfolded would lead to murder. Kidnapping and rape vs Abduction and murder ( Did i get that right )

Looking at the surveillance video, I think we can clearly see that Tori was not forced. She followed the <modsnip>. Poor Tori probably got into MR's car without being forced. She thought she was going to go look at a puppy. One similar to the one she had. We've all heard it before....kidnappers using puppies to lure children. Lost puppies, etc. Cedrika Provencher was lured the same way. She's still missing.

Tori was murdered. One <modsnip> confessed. The other one will get convicted!

    (BBM)

I don't think that makes a difference as far as Canadian law is concerned. Think of all the parental abductions where the non-custodial parent has been charged with abduction. I believe that, even if the child went willingly, if the person taking her had no right to do so, they can be charged with kidnapping/abduction.

"Child abduction or Child theft is the unauthorized removal of a minor (a child under the age of legal adulthood) from the custody of the child's natural parents or legally appointed guardians."

    [ame="http://en.wikipedia.org/wiki/Child_abduction"]Child abduction - Wikipedia, the free encyclopedia[/ame]

"Stranger abduction/ kidnapping and foul play missing – this term refers to an abduction by anyone other than the subject's parent or guardian . In other words, the abductor may be a stranger an uncle, sister, cousin, grandfather, neighbour or close friend etc."

#Rafferty - Rodney Stafford just arrived - wants to hear Tori's mother's testimony.

    @CityCynthia
#Rafferty - Tara's father, Tori's grandfather here as well, wants to support Tara. Says she's strong.
