12/4/19 Update: Penalty phase to begin next Tuesday, 12/10.
12/10/19 Penalty Phase Day 1: The judge read jurors the explanation of aggravating/mitigating factors. During the penalty phase, jurors will hear additional evidence & from more witnesses called by the defense & prosecution. Then the jury will have to decide if they should sentence Sievers to death or life in prison without the possibility of parole. Judge tells jurors they must unanimously agree one aggravating factor has been proven beyond a reasonable doubt to sentence Sievers to death. Assistant State Attorney Cynthia Ross did the state's opening statement. Defense Attorney Gregory Messore did the defense's opening statement. State witnesses: Mary Ann Groves (Teresa's mother). DA showed video of Teresa. The State rests. Defense witnesses: Bonnie Sievers (Mark's mother). Showed pictures of Mark & the girls. Scott Sievers (Mark's younger brother). Assistant State Attorney Hamid Hunter presented the state's closing argument. Defense Attorney Gregory Messore presented the defense's closing arguments. The Judge read the jury instructions to the jurors. The jury can recommend a death sentence in Florida but the final decision comes from a judge. Jury headed back to begin deliberations (~ 3:10pm ET). Jurors each want a copy of instructions. Jury sends a second note: They want a transcript of CWW's testimony. They cannot send back transcripts, but can have the court reporter read it back to them. Jury writes back another note declining to hear Wright's testimony at this time. The jury has reached a verdict. (~6pm ET). The jury's verdict came back recommending a death penalty sentence for Sievers. The judge is talking about scheduling a Spencer Hearing. The state & defense said they will each need two hours in this hearing. A Spencer Hearing is an opportunity for attorneys to present additional evidence to the judge before a sentence is entered. 11/27/19 Update: Circuit Judge Bruce Anderson heard a lot about Mott throughout the sentencing phase of his murder trial. He heard about his drinking, his depression and – as one doctor testified today – his “sadistic” tendencies. But Wednesday was the first time the judge heard from Mott himself. In a halting and tearful voice, he apologized for fatally shooting and stabbing his grandmother. Mott’s father Eric Mott also addressed the court. Judge Anderson says he has volumes of testimony to review, including “three legal pads full of notes.” He set a court date of Dec. 19 at 8:30 a.m. to pronounce Mott's sentence.
