Lane has defended multiple people facing the possibility of the death penalty. He agreed to a court request to represent the Walmart shooting suspect.

"EL PASO, Texas — Denver attorney David Lane – who has represented multiple people facing the death penalty and a host of controversial clients in Colorado – has been appointed as a defense attorney for a man accused of gunning down 22 people at an El Paso Walmart, 9Wants to Know has learned.

Lane confirmed to 9Wants to Know that the federal court in El Paso had requested that he represent Patrick Crusius, 21, in anticipation of federal domestic terrorism charges being filed in the wake of the Aug. 3 attack.

“All I can say is that under the Sixth Amendment of the United State Constitution, every human being in America is entitled to the best defense they can get,” Lane said Tuesday....

In a 2009 Denver Post profile, Lane said that he saw redeeming value in every person – a belief formed during that time in New York.

“When you’re working as a public defender, and you see the things that your clients do, you can’t help but understand – not necessarily excuse what they do – but understand how they got to where they got, and that’s a life-changing insight,” Lane told The Post. “When you see the problems of poverty and race and just the despair in the ghettos of Brooklyn for seven years, you come away with different insights into the world that people who are not exposed to those things.”..."

District Attorney Jaime Esparza said he is seeking the death penalty in the case against Crusius, who remains in jail without bond.

"The District Attorney’s Office will continue to work hard to ensure that justice is done and is committed to assisting the victims through the judicial process," Esparza said in a release.

Authorities are investigating the attack as domestic terrorism. Crusius told police he targeted Mexicans, according to a warrant. Most of those killed had Hispanic surnames and eight were Mexican citizens.

Prosecutors believe Crusius was the author of a screed published shortly before the shooting that said it was, “in response to the Hispanic invasion of Texas" according to court documents.

Attorney Mark Stevens said he will use “every legal tool available” to prevent Crusius from being executed.

Judge Barrill was assigned the case Tuesday afternoon during a random automation process. At the request of the District Attorney’s Office last week, the District Clerk agreed to allow state prosecutors and defense attorneys to be present when Crusius’ indictment was entered into the District Clerk’s system Tuesday, which then randomly assigned a case number and judge.

"EL PASO, Texas -......The one-page indictment against Crusius lists the names of the 22 victims who were killed in the Aug. 3 mass shooting and it suggests that victim Maria Legaretta Rothe was the first person to be shot in the attack....

A previously released arrest warrant prepared by police said Crusius told officers, "I'm the shooter," and that he was targeting Mexicans. In court documents, prosecutors allege that Crusius published a screed shortly before the shooting that said it was "in response to the Hispanic invasion of Texas."

It cited another mass shooting in Christchurch, New Zealand, that killed scores of Muslims as inspiration for the attack....

Crusius drove more than 10 hours from his grandparents' house to carry out the attack, according to police.

Most of the dead had Hispanic last names, and eight were Mexican nationals. Federal prosecutors have said they're weighing hate-crime charges against Crusius that could also carry the death penalty."

Judge Recuses Self From El Paso Walmart Shooting Case

"EL PASO, Texas (CBSDFW.COM/AP) — The judge presiding over the case of a man accused of killing 22 people at an El Paso Walmart has recused herself, saying she knew one of those killed.

State District Judge Angie Juárez Barill announced her recusal from the capital murder case of Patrick Crusius in a statement issued Wednesday, a week after her assignment to the case.

“First, I knew one of the deceased and family,” Barill said.

She also noted that her term of office ends in December 2020 since she’s running for chief justice of the 8th Texas Court of Appeals and not her present seat. She said the case could go to a judge reasonably sure of seeing it through to completion.

The 21-year-old Crusius, of Allen, remains jailed without bond charged with capital murder of multiple persons. Prosecutors say they will seek the death penalty."

Crusius, of the Dallas suburb of Allen, has been indicted on capital murder of multiple persons charges and prosecutors are seeking to have him sentenced to execution if convicted.

Crusius remains held without bond in the El Paso County Detention Facility. The judge's order requires that Crusius be transported from the jail to court to appear in person at his arraignment...."

Mother of El Paso shooting victim who died sues Walmart

"EL PASO, Texas (KFOX14) — The mother of Leonardo Campos, who died in the Aug. 3 mass shooting at the Walmart store in east El Paso, is suing Walmart, alleging the retailer failed to provide adequate security.

The Zambrano Law Firm of the Rio Grande Valley is representing the mother of Campos.

The lawsuit was filed Monday....

The lawsuit claims Walmart was responsible for protecting its customers. The lawsuit states Walmart failed in doing so because it did not employ security guards to patrol the store, among other security measures. The lawsuit states that particular Walmart did not have security, while other Walmart stores do.

Campos was shopping with his wife at the store when Patrick Crusius entered the building with an AK-47 and began shooting. Campos and his wife Maribel Hernandez died...."

Crusius, 21, who wore a suit and glasses, only spoke to enter his plea and responded "Yes, Sir" to questions from Judge Sam Medrano Jr. on the pronunciation of his last name and if it was spelled correctly on paper.

His arraignment in Judicial District Court in El Paso was his first court appearance since the Aug. 3 massacre....

"...El Paso lawyer Joe Spencer and San Antonio lawyer Mark Stevens make up the defense team. They wouldn’t speak about Crusius’ not-guilty plea.

“The lives of countless people in this area in Texas and Mexico have been impacted tragically. It’s our feeling that if we talk too much about it in the press, it’s libel to make there pain worse,” Stevens said.

However, they say everyone needs to hear both sides of the story.

“People who were nowhere near this place have already made up there mind about what should happen,” Stevens said...."

"EL PASO, Texas (CBSDFW.COM) – The wife of U.S. Army veteran and retired school bus driver, Arturo Benavides hired attorneys to file a wrongful death lawsuit against Walmart and Patrick Wood Crusius, after her husband died during the Walmart mass shooting in El Paso on August 3, 2019.

On the morning of the shooting, Benavides, 60, and his wife, Patricia, 63, were running errands at the Walmart Supercenter located at 7101 Gateway Boulevard.

After wrapping up their shopping, the couple entered the checkout line to pay for their items. Mrs. Benavides left the checkout line to find a place to sit and rest, when Crusius entered the store and began to open fire, shooting customers inside.

She was pushed into a bathroom where she was able to escape the gunman. But her husband, who was still standing in line at the time the shooter entered, was shot and is among the 22 people killed during the mass shooting that day....

The lawsuit, which was filed in El Paso County claims that the Wal-Mart Defendants, which have known about shooting incidents at their other stores in Texas and around the nation, had a duty to have security guards and other security measures at its stores, to discourage such shootings and to engage any shooter that may attempt to harm their employees or customers. Although the Wal-Mart Defendants have security guards at some of their stores, the location in El Paso where Mr. Benavides and others were gunned down did not appear to have any."
