GUILTY TX - 22 killed, 26 injured at Walmart, Cielo Vista, El Paso, 3 Aug 2019 *GUILTY federal* #2

After an extensive renovation, Walmart Store No. 2201 near Cielo Vista Mall will reopen at 9 a.m. (local time), minutes after the American flag is raised to full-staff and an #ElPasoStrong banner is placed at the store's front.

The changes around the store have been visible since earlier this week. The white crosses honoring the 22 victims, banners and flowers at the makeshift memorial blocking the street behind the store have been relocated. A series of new security cameras were installed on the store's roof and the 6-foot green, covered fence that enclosed the building and its parking lot was removed.

One of the biggest changes to the store are automated security gates installed past the glass doors on both of the store's entrances. Customers will now have to pass through a checkout line to exit the store. Walmart began installing this type of security gate in stores throughout the country prior to the shooting, said Delia Garcia, the company's senior director of communications.

A fleet of workers wearing their navy blue vests have been working for about a month putting shelves together, hanging up clothing and shelving toiletries and food.
When employees returned to the store, the building was completely empty as construction workers finished major renovations.

"Well, I can tell you, walking into the store ... it was a little bit intimidating. A lot of mixed emotions," store manager Robert Evans told CNN. "And through this process of rebuilding and getting the store put back together, you can see the laughter, the smiles and the applause between each other and support. That's what really makes it a good recovery."

Feds won't seek death penalty for El Paso Walmart shooter Patrick Crusius

Federal prosecutors won't seek the death penalty for Patrick Crusius, the man accused of killing 23 people in a racially-motivated shooting at an El Paso Walmart in 2019.

The U.S. Department of Justice disclosed the decision not to pursue capital punishment against Crusius in a one-sentence notice filed with the federal court in El Paso Tuesday.

The 24-year-old is accused of targeting Mexicans during the mass shooting and is charged with federal hate crimes and firearms violations and has pleaded not guilty.

Crusius is expected to be in court on Feb. 8 at 10 a.m. for a motion for re-arraignment hearing.

Last week, federal prosecutors filed they will not seek the death penalty. Crusius could still face the death penalty if convicted on a state capital murder charge.

His case is set for trial in federal court in Jan. 2024.

They sure cleaned him up to look like a good, wholesome, young man. *eyeroll*

He's lucky they aren't seeking the DP. After all, he killed 23 people, 1 more would make an even 2 dozen. I like even numbers. ;)

The sentencing hearing dates for the man who killed 23 people and injured 22 others in a shooting at the Cielo Vista Walmart were set by a federal judge on Wednesday.

The hearings for Patrick Crusius, 24, will start on June 30 at 9 a.m. MT in courtroom number 812 on the eighth floor of the United States Courthouse, 525 Magoffin Ave. in El Paso, U.S. District Judge David C. Guaderrama determined Wednesday.

It begs the question why the Federal government brought its own charged but didn't seek a death penalty. What the was the point?

The El Paso Walmart gunman was formally sentenced to 90 consecutive life sentences for the racist 2019 massacre that killed 23 people and injured nearly two dozen others.

Judge David Guaderrama handed down the sentence on Friday after hearing two days of emotional impact statements from victims and the family members of victims.

“We are still going to be prosecuting the Walmart shooter and we are still going to be seeking the death penalty," said Hicks.

However, Hicks said it will be an El Paso jury to decide if Crusius gets the death penalty.

Hicks had originally said Crusius would be in state custody around October or November but Crusius will be handed over to the state sooner than expected, Hicks said.

"When he comes back to our custody he will be going to trial and we will seek the death penalty," said Hicks.

Hicks said He doesn't know when the trial will begin and said Judge Medrano will set a trial date.

“We hope it will be somewhere in 2024 or 2025," said Hicks.

A scheduling conference is planned for Monday, Sept. 11, in the state of Texas' case against Patrick Crusius, who is accused of fatally shooting 23 people and injuring dozens more during a racially-motived shooting on Aug. 3, 2019, at an El Paso Walmart.

the shooter was turned over to state custody as the state case against him remains pending. The gunman is being held at the El Paso County Jail in Downtown El Paso.

Crusius pleaded guilty in February after federal prosecutors took the death penalty off the table. But Texas prosecutors have said they will try to put Crusius on death row when he stands trial in state court. That trial date has not yet been set.

Under the agreement between Crusius and the government, Crusius will pay $5,557,005.55.

The restitution amount is pointless. Its not like he will be able to pay it.
