DNA results expected soon in case of Clegg couple’s deaths

District Attorney Jose Aliseda of the 156th Judicial District confirmed Sunday that his office is expecting reports related to DNA tests in a high-profile homicide case to be in his office by the end of this month.

The case against Alejandro and Treviño was set for a status hearing in Live Oak County District Court April 11. According to Assistant District Attorney Tiffany McWilliams, it was announced in court that the DNA test report was being generated. The case now is scheduled for a pretrial hearing May 9.

The Texas Department of Public Safety’s crime laboratory in Corpus Christi has not yet submitted a report related to the completion of its DNA testing on various pieces of evidence in the investigations of the deaths of Sandra Ann Garcia and her husband, William “Bill” Hammit.

“We have been told by the lab that we will get the report by the end of this week, or the beginning of next week,” Assistant 156th Judicial District Attorney Tiffany McWilliams told Judge Patrick Flanigan May 9 in Live Oak County District Court.

As a result, Alejandro and Treviño were ordered to return to court July 11 for a pretrial hearing, followed by announcement July 25. Jury selection ahead of their trial is scheduled for July 30.
 
Defense seeks change of venue
Alleging that their client will not be able to receive a “fair and impartial trial” in Live Oak County, attorneys for Aniseto Alejandro Jr. have filed a motion asking that his trial be held elsewhere.

The motion, filed July 10, was not mentioned when attorneys for Alejandro and his co-defendant – Desiree Icis Treviño – appeared in court July 11 for a pretrial hearing. The pair are charged with capital murder of multiple persons in connection with the Dec. 23, 2015, slayings of husband and wife William “Bill” Hammit and Sandra Ann Garcia at their Camco Store in Clegg.

The pretrial hearing for both defendants was rescheduled to Aug. 31, with announcement set for Sept. 26. A jury trial currently is slated to begin Oct. 1.
