The trial of the suspect accused of kidnapping and murdering a 10-year-old girl in the city of Bullard in November 2016 could be rescheduled to a later date due to a delay in DNA testing.

Addressing the court, Smith County District Attorney Matt Bingham said that there was a delay in the results of DNA testing from the Texas Department of Public Safety’s DNA analysis.

Currently, the next pre-trial date in the Zavala- Garcia trial is slated for Thursday, Jan. 4. According to Skeen, a motion for continuance may be requested by either the State or the defense to change the date of the upcoming pre-trial hearing or the start of the trial, currently scheduled for Monday, March 19.

Previously, Bingham had hoped all items sent to DPS for DNA testing would be completed at the end of December. However, he informed Judge Skeen that testing, including items such as hair, fibers, soil, and pollen, now should be completed at the end of January 2018.

According to Skeen, DPS works on all types of cases across the state of Texas and performs forensic analysis, while prioritizing evidence quickly for capital murder trials in which the State of Texas is seeking the death penalty.

Bingham and the Smith County Attorney’s Office announced in April that the death penalty would be sought in Zavala-Garcia’s trial.


He also said that the DPS crime lab has moved the Zavala-Garcia DNA testing to the front of the list, citing that forensic scientists are working hard to complete the testing.

The March 2018 trial for the man accused of killing 10-year-old Kayla Gomez-Orozco has been postponed because of delays in DNA testing.

Judge Jack Skeen said he would issue a new scheduling order Thursday afternoon in the capital murder trial of Gustavo Zavala-Garcia. He outlined the updated schedule saying the court would summon a central jury panel for Aug. 30, 2018, and start individual questioning of each potential juror on Sept. 10. Presentation of evidence would begin Oct. 8.
 
Of course that article didn't say if the pretrial hearing for 1/18 is still good. I'll just keep it on my list, just in case!
 
Always postponing of trials frustrates me for the families. Just pray they get it right.
 
Bingham is on his way out. He isn't seeking re-election as DA, so his term is up at the end of this year. Let's hope he gets his act together here and sees that justice is done.

Couldn't find anything that happened yesterday, so I guess next hearing will be April 26th.
 
I wonder if this psychopath realizes he’s being given more time and consideration than he gave to poor little Kayla.

Judge Jack Skeen of the 241st District Court said in a pretrial hearing Wednesday he will not sign the defense's motion for continuance, which is unopposed by the state, until he hears if the additional DNA testing is needed.

The purpose of today's pre-trial hearing was to receive an update about the trace evidence examination. DPS forensic chemist Amber Moss provided the update.

The defense and state told the court they'd come to an agreement on what additional evidence will be tested.

"This is not a decision we took lightly. We want this case tried," Bingham said. "It's our duty to seek justice and do the right thing."

A Department of Public Safety evidence analyst said he would need 60 days to go through the 10 clothing items from the victim and suspect. He started the process but will need another 53 days, he said.

The next pretrial hearing is scheduled for July 12, and 241st District Court Judge Jack Skeen said he would know then whether the scheduling order would need to be altered.

Skeen has indicated he intends to keep the case on the current scheduling order, but would need to know if DNA testing would affect the trial beginning in October.

This happened in 2016!!! And they are just starting to talk about dna testing? Come on now. This case makes me so angry. Ts time to move so justice can be served for this sweet little girl, who was just going to church and playing with babies.
