The lawyer for homicide suspect John Brickman Wall says detectives’ lies and other interview tactics went too far the night Wall’s ex-wife Uta von Schwedler’s body was found in her bathtub.

"They weren’t being truthful to where they were being coercive," attorney G. Fred Metos said.

A former Utah pediatrician’s statement that his life would improve if his ex-wife "got hit by a bus" can be used as evidence of a motive when he stands trial for her murder in February, a judge ruled Tuesday.

A four-week trial is scheduled to being Feb. 17 in 3rd District Court. If convicted of the crimes, Wall could spend the rest of his life in prison.

Before the murder charge was filed against Wall in April 2013, he was involved in a civil lawsuit with his teenage son, Pelle von Schwedler Wall. The father sued Pelle Wall for possession of scrapbooks made by his late mother, and the now-21-year-old son filed a wrongful death counterclaim, claiming that his father gave von Schwedler a lethal dose of a controlled substance and drowned her in a bathtub.

SALT LAKE CITY, UTAH – The long-awaited trial for a Utah pediatrician accused of killing his ex-wife begins Tuesday.

Uta von Schwedler was found dead in her own bathtub in Sugar House on September 27, 2011. She was a 49-year-old researcher at the University of Utah. The medical examiner called it a drowning, but she had cuts and bruises–and family members suspected her ex-husband John Wall.

“His behavior, I think, immediately after was very unusual, highly unusual, very suspicious,” Pelle Von Schwedler-Wall said of his father.

The couple divorced in 2006 and engaged in a heated custody battle. When von Schwedler drowned, the medical examiner found a high amount of Xanax in her system. Wall had written and filled a prescription for Xanax a few months before her death. The defense claims she overdosed and drowned.

“The medical examiner couldn’t say this was a homicide,” Wall’s Defense Attorney Fred Metos said. “In looking at the DNA evidence, it’s consistent with other members of his family that were living in the house.”

A coveted scrapbook the mother created for her children was found in the bathtub, along with a knife. Friends and family say von Schwedler would not want to hurt her scrapbooks and that she was not suicidal at the time of her death. <more in link below>

Curious to see just how this case ends up. :thinking: Usually by the time trial starts, I am leaning one way or the other. Starting this one with a clean slate, so I am looking forward to the evidence to steer me to a decision.
 
Does anyone know if this will be live streamed anywhere? This seems like a very interesting trial to watch.

Wall was arrested in April of 2013 and is facing a first degree felony murder charge and a charge for first-degree felony aggravated burglary.

Does Utah have the DP and would this qualify Wall for the DP? (murder during the commission of a felony)

Don't know if everyone has already read this but I found it an interesting read.

"A renowned criminal psychologist believes University of Utah scientist Uta von Schwedler's death was the result of an "anger-retaliatory type" of murder.

The psychologist calls John Brickman Wall "arrogant" and a "narcissistic parasite" who had the motive and opportunity to kill his ex-wife and could kill again. He believes the woman was attacked while she was sleeping and was forced to swallow Xanax."

This Dr did not speak directly to Wall, but reviewed Wall's depo, crime scene photos, ect. DT is fighting to keep this report out of trial.

(KUTV) Jury selection began on Tuesday in the murder case of Johnny Brickman Wall, a Salt Lake City pediatrician accused of killing his ex-wife, Uta Von Schwedler, in September 2011.

Von Schwedler, 49, a University of Utah biologist and mother of four, was found dead in the bathtub of her Sugar House home. The medical examiner’s report determined the cause of death was drowning, as well as a lethal dose of Xanax. The manner of death, however, could not be identified.

Their son, Pelle Von Schwedler Wall, a teenager at the time of the alleged murder, said his father tried to convince him she committed suicide.

“He basically said that your mom chose to leave you,” Von Schwedler Wall told CBS’s 48 Hours last year. “I was absolutely, 100-percent convinced that he was responsible for my mother’s death.”

Opening arguments are expected to begin on Wednesday.
 
This is so much like the Martin McNeill trial! Both were Dr.'s living in Utah. Both their wives/ex-wives were heavily sedated and found drowned in a bathtub....eerily familiar.
I really want to follow this trial, but I can't find very much information on it. It starts today right?
 
OK, Was just told by reporter that the only other Utah trial that was live streamed was the Martin McNeill trial. (We all remember that one. The Wall/von Schedler murder is pretty much a copy-cat case). The streaming was done by national news. Local news doesn't have equipment. Apparently MSM is not interested in steaming this trial.
