On Monday, Matheny-Willard sent a motion to clarify to Hampton courts. In the filing, she says Bigsby disagreed with his former attorney, Jeff Ambrose, on legal strategy, so Bigsby fired Ambrose on April 7. That was before Ambrose asked the court to leave the case because of an ethical conflict.

This new motion to clarify also asks the court to seal or redact Ambrose's motion to withdraw to only include Ambrose's name and the words, "I wish to withdraw."

Matheny-Willard argues the language used in current court filings could taint a future jury pool.

Where is Codi Bigsby? It has been 100 days since the 4-year-old was reported missing from his home off of Old Buckroe Road in Hampton.

Now, the City of Hampton's attorney, Cheran Cordell Ivery, has responded on behalf of Mayor Donnie Tuck and Hampton Police Chief Mark Talbot.

In response to requests made in the cease and desist, the City has made the following responses:

  1. They say Chief Talbot will not retract any of his statements about the disappearance of Codi Bigsby and the police's ongoing investigation into his whereabouts;
  2. The city states that no statements made by Chief Talbot have obstructed justice or tampered with a potential jury pool.
  3. According to the letter, the City does not endorse or condone harassment or threats made against anyone. They say if this occurs, then it should be reported to law enforcement immediately.
  4. Lastly, the City denies that Chief Talbot made statements that put anyone's life in danger.

In response to the attorney's claims that the police department did not seek to initiate an AMBER Alert, City of Hampton says that is not true. They state in the letter that State Police have criteria of when to issue an alert. The city says they made a request for one, but State Police denied it for not meeting every criterion.

In a separate letter, Matheny-Willard put the city on notice of the family’s intent to file suit against Hampton city officials. Ivery wrote that a “notice of claim” against the city — asserting that the city is liable for damages to the Bigsby family — would be responded to by the city’s insurance risk manager.

“The City of Hampton and the Hampton Police Division’s efforts remain focused on finding Codi Bigsby and will continue in this regard until such time as he is located,” Ivery wrote.

Codi Bigsby’s family attorney files formal complaint against Hampton police chief

On Wednesday morning, Attorney Amina Matheny-Willard filed an internal affairs complaint on behalf of Codi Bigsby’s family against Hampton Police Chief Mark Talbot.

The complaint alleges Talbot made reckless and false statements about the Bigsby family’s lack of cooperation.

It says the way he made these statements at a public town hall meeting provoked verbal life-threatening attacks by community members.

Hampton police said the complaint will be passed on to their Professional Standards branch for follow-up. They declined to comment further.

I'd say the sister did a good job of ruining the family's reputation all by herself, not to mention her brothers actions. Looks like someone is looking for deep pockets, JMO.

On Tuesday, Bell revealed a military investigation shows Bigsby went AWOL for three weeks.


 
Is that unusual? For a lawyer to request removal for ethical reasons after the person they were representing fired them?
It's a procedural thing. For a lawyer to be removed from a case in a criminal matter, especially one that has progressed, they need the Judge to sign off on it, and new representation to come in. Sometimes, if the proceedings are that far in, the Judge won't allow the lawyer to withdraw.

From all I'm seeing about Bigsby is that I have my doubts about him as a parent. But as a former member of the military I'm wondering if the AWOL, UA (Unauthorized Absence) in USN/USMC, is much ado about nothing. What bothers me is what they're NOT saying. IOW, was this a court martial? OR was it a Article 15 hearing? And if there was either what was the decision or outcome? There may something serious there. But it is just as likely it could be something benign.
