No, I didn't pay a great deal fo attention but I agree it sounded like more females than males. And LOL @ the public execution. He's been a bad boy, eh? 4 felonies, guess that'll give him a stiffer sentence.

Bad boy his entire adult life and beyond. This sounds like a mostly paperwork procedural rubber stamp by the jury that because of his history NOW presented to them, he more than qualifies for LWOP. Nice backup for the judge when the jury says so. No idea if juries have real power in penalty phase in Idaho.

So will be be sentenced still today, or judge do that at a later date? Can't speak to murder trials in Idaho, but I do know they love to separate cases into as many different sections and court dates as possible.

I'm all for moving on. Sentence away.

No surprise the jury agrees he has prior felonies. But I wonder if they were shown the substance of them, in particular that aggravated battery conviction.
 
I thought he'd be sentenced after the jury returned with this latest verdict but it'll be quite a while, according to the live blog:

2:57 p.m. Kerrick says he thinks sentencing with be set in the next 2 1/2 or 3 months.

It didn't sound like they went into any details about his convictions, just the certified copy that he had been convicted.
 
The jury was 7 men and 5 women (don't know about the alternates).

Capone will never walk free again in his entire miserable life.

I was surprised to see a good video out of KXLY (about damn time). KLEW has done a consistently good job. Best is the LM Tribune but too bad they charge for their news.

I'm not done updating the Case Archive for today, I have not gotten to the late news, will do that tomorrow.

Hey all!

So I only got to go to the trial one day, i was bummed.

After just the bit i watched, although i have always thought that Charles was capable, I am VERY unsure that he did it now. I only got to hear one voice message but I am 100% sure that he did not make and was not behind the one I heard.

I completely do not believe anything DS says. The bridge dumping and even the fishermen reporting seeing the body are from cold cases here. As was the Yukon drop sight. I don't think he had anything to do with it. I think that he was questioned because he was close to CC and the police liked him for a helper. Once he was charged he lied about being there at all to get out of a 1st degree murder charge.

I am not sure though I am comfortable saying what I do believe.

I need to go back and really go over the last days of the trial and i will be back to go over the things that don't add up.
 
Watching this on Datelinenow and am literally sick to my stomach over David Stone. Listening to him explain what happened and how they threw the "package" her body over into the water is so disturbing. I will never understand how he will be out in little to no time. Just sick.
 
Agreed. It is sickening to say the least.

At least his wife got away from him (divorced him) and she said Rachael's family had been through so much far worse that she had.

As for Capone, his January sentencing was moved to Feb 23 so that he could be mentally evaluated. Just throw away the key. Or better yet, throw him into the river. Both of them.
 

I shed no tears for the SOB. Some measure of justice for Rachael's family. Sad they had to listen to him blabber on and on and blame everybody but himself. Do love the extra 20 years tacked on and zero chance for parole.

Charles Capone's attorneys have filed a motion requesting a new trial.

This is based on the accomplice, David Stone, telling a cellmate they did not put Rachael into the Snake River.

Comments made by a cellmate aren't enough to persuade Latah County prosecutors that Charles A. Capone should get a new trial for Rachael Anderson's murder.

Latah County Prosecutor William Thompson Jr. and Senior Deputy Prosecutor Mia M. Vowels filed a response this week to Capone's motion for a new trial, asking Senior Judge Carl B. Kerrick to deny the man's request based on substantial evidence proving Capone killed his estranged wife. Capone's attorneys, D. Ray Barker and Mark Monson, filed the motion earlier this month, claiming statements made by David C. Stone's former cellmate "would likely produce an acquittal in this matter."
