Wesh just reported that TB is not Casey's lawyer and is not bound by Client privelege

I don't understand how he can possibly NOT be bound by atty/client privilege. that's like the number one thing they teach you when you join a law firm. doesn't it ALWAYS apply? is there a Florida law I'm missing here? in what circumstances would it not apply? someone enlighten me please...

maybe because he is not a lawyer?

Here's my understanding:

Todd B is Jose B's public relations person/firm. Todd is not an attorney.

Todd may have signed an agreement with Jose not to discuss anything he hears in regards to Jose's clients. That agreement is not, and can not be made, with the courts.

Todd can only plead the 5th if he would be incriminated by his own testimony in a criminal action.

Non-disclosure agreements (which I've signed myself for various things) are civil, not criminal.
 
Maybe LE needs to take a little trip to see Mr. Black in the flesh. hehehe I guess first they would have to find him. They could start by looking on the moon since he appears to be foreign to the planet on which the rest of us live. ;)

I'm with you. I do not feel the little trip under the bridge has been properly reported. Each news source seems to have a different story. I have not seen official quotes by LE on it yet. Who was driving the SUV she got into? What was their purpose? That would be odd even for a bondsman that was filming a tv show.
Also, Cindy just saw her daughter for the last time and all she can think of is spewing venom at a media vehicle? They had just given her a squeezably soft interview allowing her to spread wild accusations and half-truths. I think most moms would have had to stay in their own vehicle and gather their composure for about a half hour. Cindy came flying out of hers wailing like a scalded banshee. Under FL law the driver could have said his life felt threatened and shot her. She was beating on the vehicle and screeching at the driver.

But I guess my main point is, what was Casey and the driver of the transfer car up to?

I reckon they were going to Disney world to get some tea. Tea and strumpets.

They claim the driver of the transfer car was the bail bondsman. He just put $51.26 into her commisary account at the jail so whatever went on under that bridge was worth that much to the bondsman.

I personally think that TB had a slip of the tongue. I think he meant to say the ALLEGED loss of life. I do think he believes Caylee is dead and that came though in his statement.
I do NOT think he is privy to any of the information that JB has been given.

Todd Black is not an attorney. He is a PR person that Jose hired. He can not invoke the attorney client priviledge because he is not an attorney.

Actually he can IF he is an employee of JB the attorney of record. In much the same way prosecution cannot subject the defense attorneys secretary, receptionist or office staff to questioning. It is very dependent on who is paying TB what his status is regarding client privelege. If JB is paying him out of his business funds either as a regular employee or an independent contractor (such as an investigator would be) then the privelege most likely applies. (remember the privelege is Casey's, not TB's or JB's). But if TB is either not being paid, or is being paid by some other source such as the family, then he is a third party and privelege does not apply.
 
If I were TB, I wouldn't start spilling my guts about KC's guilt or innocence just on the say-so of a television statement.

I agree w/ you 100%. I think the media, esp. CNN (and I like CNN & NG, too) is making a big deal out of nothing. They know his written media alerts or whatever are full of mistakes, what did they expect to come out of his mouth?! DUH! :eek:

LOL, well, you do have a point, that's true, but I dont think he should get a pass for it. He is JB appointed spokesperson..

I have NEVER believed the "under the bridge story" and will NOT believe it until LE says it is true. If it were really the bondsman and they were not concerned that she was trying to run, they would have waited until he took her to the jail. LE didn't wait..........the stopped him and arrested her on the spot.

The story does not wash in my eyes.

I believe it has to be ruled as "work product" for it to carry privilege and PR work I don't think could qualify.

I think I as I understand it, he has to be a licensed PI in Fla, for that to hold, or obviously another attorney. There are a few other instances for Bailbondsman, I believe.
