    IANAL… but economic status does not exempt one from DP eligibility. Many domestic terrorists have been assigned to (and represented by) public defenders. The Boston Marathon bomber and Dylann Roof are two examples. Honestly, federal DP-qualified public defenders are some of the very best in the business.

    No mention of a stabbing or that DB's ex was the victim of a stabbing or proof that a knife was involved.

    Thanks for bringing this link to us because it does show that shortly after this alleged dispute DB decided to purposely run over the innocent pedestrians.

    Economic status has to do with qualifying for a public defender. It has nothing to do with sentencing/death penalty. (When people say life without parole is much cheaper than death penalty, they’re largely referring to legal costs, including public defenders and appeals). JMO.

    I don't think it means he had never thought before about possibly ramming into a crowd.

    We know that he was arrested for ramming his ex-girfriend with his car. He ran her over with his SUV. :eek:
    So it was not a new idea for him to decide to do it again.

    I think he had a lot of repressed anger, since we know he shot at his nephew, ran over his girlfriend and threatened to bomb a casino, and I am sure many other things.

    I am pretty sure he had thought about or fantasised about driving through a crowd before he actually decided to make it a reality. JMO

    I don’t like the wording of the article title, but it does lend credence to the assertion that DB was attacking a group of innocents using a vehicle as the weapon. DHS covers it in their documentation about security awareness for soft targets and crowded places.

    The use of a vehicle as a weapon in a terrorist attack is not new. Recent terrorist incidents and violent extremist propaganda demonstrate that the use of vehicles as a weapon continues to be of interest by those wishing to cause harm. Attacks of this nature require minimal capability, but can have a devastating impact in crowded places with low levels of visible security.

    Scanner traffic and discussion is allowed, but not on the main thread. There is a scanner thread in the “parking lot”.

    That said, MSM discusses the Frame Park knife incident in this article.

    There was an incident relating to knives on the police scanner right before the parade incident. Two citizens told an officer there was a possible fight near the boat launch at nearby Frame Park with possible knives involved, and the scanner audio includes the sound of a few officers responding with sirens. Then an officer gets there and says there’s no one there after he checks the boat launch and the nearby baseball field and rotary building. Just a minute later another officer first spots the SUV speeding toward the parade route. It’s not clear, though, whether the incident reported at the boat launch is related to what happened at the parade.

    Thompson said in the November 22 press conference that Brooks was involved in a “domestic disturbance” before driving through the parade but police hadn’t confirmed whether a knife was involved.

    DB was charged with intentional homicide, NOT reckless homicide.

    Premeditated And Deliberated Murder

    Under Wisconsin law, a premeditated and deliberated murder is charged as a first degree intentional homicide. Under Wisconsin laws, the attempt to commit a crime is also charged as the completed crime. First Degree Intentional Homicide is defined as intentionally causing the death of another person or unborn child. Intentional murder is sometimes called wanton disregard for human life or depraved heart murder.

    (1)  Offenses.
    (a) Except as provided in sub. (2), whoever causes the death of another human being with intent to kill that person or another is guilty of a Class A felony.
    (b) Except as provided in sub. (2), whoever causes the death of an unborn child with intent to kill that unborn child, kill the woman who is pregnant with that unborn child or kill another is guilty of a Class A felony.

    940.02  First-degree reckless homicide.
    (1)  Whoever recklessly causes the death of another human being under circumstances which show utter disregard for human life is guilty of a Class B felony.
    (1m) Whoever recklessly causes the death of an unborn child under circumstances that show utter disregard for the life of that unborn child, the woman who is pregnant with that unborn child or another is guilty of a Class B felony.

    Survive DURING

    Run to Safety
    • Seek safety. Getting away from the attacker is the top priority.
    • Leave your belongings behind and get away. If you are not wearing a mask, do not stop to put one on. It is more important to run to safety.
    • Call 9-1-1 when you are safe and describe the attacker, location and weapons.
    Cover and Hide
    • If you can’t evacuate, cover and hide. Find a place to hide out of view of the attacker and if possible, put a solid barrier between yourself and the threat. If you are hiding with people who are not part of your household, wear a mask and maintain a distance of six feet between yourself and others, if possible. Children under 2 years old, people who have trouble breathing, and people who cannot remove masks on their own should not wear them. Do not leave your hiding place to retrieve your mask.

    Good points regarding the capabilities of Federal public defenders.

    As a further side note, on rare occasions, the government will take extra steps to ensure that a defendant has quality representation.

    - To avoid far right conspiracy accusations of a predetermined conviction and execution, the Federal government provided Timothy McVeigh with one of the best private criminal defense attorneys in the country- free of charge.

    - To avoid accusations that California had tried, retried and re-re tried the Menendez brothers until they no longer had funds for a good defense- and until the State could find a jury willing to convict, California paid all the fees for their team of top notch defense attorneys during the third trial.

    I believe that it was initially referred to as a "stabbing" by MSM and those on Twitter before we had the full details about what happened when he entered the parade route.

    Either way, we have his location confirmed as being at Frame Park - specifically the White Rock Ave side of the riverwalk - and that he was doing something violent that was classified as a "domestic disturbance" which likely involved knives, when something (likely a call to either the womens center or LE) made him get into his vehicle and start driving toward the parade route. I am unsure if we will ever know what the nature of said domestic incident was, but something must have set him off when he turned onto Hartwell from White Rock.

    I'm attaching a file with the pin drop of where he would have turned off of White Rock onto Hartwell... had he turned the other way when Hartwell hit Main he would have gone towards 164 and avoided the parade completely.

    @steeltowngirl sbm for focus gbm :)Thanks for your post w link & quote to highlight that WI has statute for first-degree reckless homicide. I hope the evd is strong enough to support intentional, homicide --- sure seems like it is--- not just reckless homicide.

    Just noticed other part of your post. If under WI statutes, an attempted crime is charged as completed crime, per gbm abvoe, then DB could face additional first degree intentional homicide charges, for ppl who were injured, as well as ppl who died.
    Just considering possibilities. my2ct.

    I think they may be waiting to see if the death toll rises. God I hate thinking about that but that seems to be the logic of the prelim not being until January - giving people time to heal and finding out whether or not some of these people make it past Christmas.

    But I do see he's decked out in a safety smock.* I wonder if he showed warning signs of being at risk of self-injury or if the safety smock is standard issue at this jail's intake.
