FL - Debra Lafave for student sex abuse, Tampa, 2005

    http://news.tbo.com/news/MGBOGLVQV8E.html

TAMPA - A former teacher accused of having a sexual tryst with her 14-year- old student is expected to enter into a plea deal within the next four weeks, lawyers said in a court hearing Wednesday.

Debra Lafave's attorney, John Fitzgibbons, told the judge that his client has been analyzed by state and defense psychiatrists. In the next few weeks, he said, he and prosecutors will review the reports and try to find some mutual ground.

Teacher to Claim Insanity in Sex Case

A teacher will claim she was insane due to emotional stress and did not know right from wrong when she had sex numerous times with a 14-year-old student, her attorney said Monday.

The boy told investigators he and the teacher had sex in a classroom, her house and once in a vehicle while his 15-year-old cousin drove. He said Lafave told him her marriage was in trouble and that she was aroused by the fact that having sex with him was not allowed.

Why is it that when a custodial parent fails to provide for a child it is called neglect and is a criminal matter. But when a non custodial parent fails to provide it is called failure to support and is a civil matter?

The only "insanity" I would believe is the parents of this boy shooting her in the face and then claiming that they were so insane by the plea that they couldn't help themselves.

    from the article...

Fitzgibbons said plea bargaining broke down because prosecutors wanted Lafave to serve too much prison time, though he did not give details.

"To place an attractive young woman in that kind of hell hole is like putting a piece of raw meat in with the lions," said Fitzgibbons. "I'm not sure she would survive."

So the Lawyer is using the "She's to pretty for prison" defense lol. As long as your blonde and attractive you shouldnt do time? I hope that backfires in his face like a cannon.

Fla. Teacher to Claim Insanity in Sex Case

A teacher will claim she was insane due to emotional stress and did not know right from wrong when she had sex numerous times with a 14-year-old student, her attorney said Monday.

"What teacher in her right mind would do something like this?" attorney John Fitzgibbons said after a brief hearing for his client, Debra Lafave, a middle-school reading teacher.

The judge agreed to appoint two mental health professionals to evaluate Lafave, 24. Prosecutors have said a state psychologist already determined Lafave was not insane, while one hired by the defense concluded that she was mentally ill.

Lafave's trial was set for Dec. 5 on four felony counts of lewd and lascivious battery and one count of lewd and lascivious exhibition. Each carries a maximum 15-year prison term.

IMO The defense atty sounds as though he may have gotten a "crush" on her looks. I wonder if he is married? Wonder if his wife has seen the quotes?

I could not believe, yesterday, when I heard her attorney make that statement... unbelievable! I guess the parents of the victim didn't realize that by sending their child to school that their child was going to be treated like raw meat by their teacher!

Well at least she doesn't have to worry about about her troubled marriage any longer, http://www.thesmokinggun.com/archive..._lafave_1.html, and am I wrong or to plea insanity -- wouldn't part of the "defense" have to be that she did not know at the time that the act was "wrong" -- however, she was excited because it was "not allowed" -- huh?....

One thing I noticed today (when I saw her on tv), is that they have really made her look younger and more innocent. The first picture I saw of her, her hair was pulled back in a tight bun. She looked tough and severe. Today her hair was cut short and flouced as she walked. She definately looks more naive...at least IMO.

What I find sick, is that an adult woman can molest young boys, and somehow they seem to be looked at differently by society...but if you have a man the same age, molest a 14-year-old girl, and they'd throw away the key. They are both sick. Mary Kay L. makes me want to barf...not that this has anything to do with this case, but Mary Kay is a sick woman, as is this gal. This gal is a pervert, not insane.

Deborah LaFave Should Not Go to Prison

LaFave is accused of having sex with a 14 year old male student. Women have called this rape, I say you can’t rape the willing. I am not defending LaFave for her actions, I am saying she should not go prison. Nothing would be served.

One lady emailer said that “we don’t know what damage the boy has suffered”. Trust me sister, he is going to be just fine. He is not having nightmares, he is not suffering from an eating disorder, he will be fine.

The author of this article is an idiot. If a 14 year old boy were "willing" to try heroin would it be okay for his teacher to give it to him? There's no way of knowing how this episode might effect his life. Perhaps now he'll father a child at 17 where before he may not even have lost his virginity until he was older. The teacher took the boy's innocence. She had no right whether he was "willing" or not.

Should she go to prison? Absolutely, same as any other adult would after molesting a child. Her sentence should be even more severe being that she was in a position of authority over the boy.

Lafave's attorney tries to block photos

Everybody knows about Debra Lafave. They know about her alleged trysts with a 14-year-old student. They even know what she was wearing that day in the portable classroom. But few know about the graphic photos police took of the former Greco Middle School teacher.

On Tuesday, Lafave's attorney filed a motion to block public access to six photos taken of her last year, saying officers violated Lafave's constitutional right to privacy when they shot close-ups of her genitals.

Questioned by detectives a week before Lafave's arrest on charges of lewd and lascivious battery, the boy told them things about his teacher that only intimate contact would have revealed. He mentioned belly button rings and butterfly tattoos. Then he told them about Lafave's "V" shaped tan line along her waist and that she had shaved her pubic area in a "unique" pattern.

When detectives brought Lafave to the county jail, they told her they had a warrant to photograph her body, according to the motion filed Tuesday. A nurse draped a sheet over Lafave and a female jailhouse deputy snapped four pictures of her hips, legs and back. Then they placed Lafave's feet in stirrups and took two close-up photos of her genitals that Fitzgibbons described as "pornographic."

Under Florida's public records laws, any citizen can request access to the Lafave photos.

Wow! I wonder how they are going to present those photos in court? I mean, I agree with the taking of the photos under these circumstances, but the way it is handled in court is going to have to be very delicate.
