Well, this is the best possible news so far about this case. Crime Watch Daily has contacted John Chiv about being part of a show on Faith and Kiya! He has agreed to be interviewed and help them with resources and contacts. Way to go, John!! He will keep everyone updated on the progress.

Both the article and comments have info from John.

Good! I've always wondered why this case did not get more national media attention. This woman and her attorney make me ill, I've never quite seen anything like it. It appears she just went about her life, vacations, birthday parties, etc., with no consequences until now.

HOW Can People Be So Heartless.

Heartless indeed! I think she is a narcissist (based on her actions during and after the fact). And I think if you combine that personality disorder with substance abuse (legal and/or illegal) and add in anger, you have a person without a conscience or a heart who is capable of the unthinkable...and thinks it's OK to try to protect herself from legal consequences. Sadly, it's become all too common and it's both heartbreaking and infuriating to see these children's lives snuffed out by those who are supposed to protect them. I hate to say it, but I really don't think this was an accident.

Oops, I've been slacking! John Chiv posted this 4/20. MK's preliminary hearing is scheduled to start 5/8 and last five days.

The charges are:

Count 1 Vehicular manslaughter without gross negligence; Jane Doe # 1 and Jane Doe #2 with special allegation that she fled the scene and a second special allegation that she caused great bodily injury to Jane Doe #2.

Count 2 Driving Under the Influence of an alcoholic beverage causing injury with special allegation of great bodily injury to Jane Doe #1. It is alleged in the complaint filed that the brain injury caused Jane Doe #1 to become comatose and suffer paralysis. Second special allegation that is alleged is that Kitchen caused great bodily injury or death to Jane Doe #2

More about the preliminary hearing from LoCO....

Kitchen allegedly was driving drunk on Eel River Drive the night of July 12 when her Jeep struck and killed two 14-year-old girls skateboarding in the road. One of them was her own daughter, Kiya. She also is charged with fleeing the scene afterward.

Some commenters are concerned that it will be hard to prove she was behind the wheel of the Jeep or prove she was intoxicated, since there was no test on the scene. The officer did observe her impairment, however. His training should count for something. Here's hoping she neglected to adjust the seat to look like a tall person was driving when she hid the Jeep.

Can't wait to read Chiv's coverage of the hearing.

Me too. He's so thorough. Are preliminary hearings open to the public? Do we have any locals who plan to attend and take notes? I remember WSer Katiecoolady reporting to us daily from the Jodi Arias trial. This isn't a trial, but having our own "reporter" there would be awesome!

Marci Kitchen's preliminary hearing finally started today in Courtroom 1.

The courtroom was packed with family and friends of Joe and Kiya Kitchen and Faith Tsarnas. They took up almost 4 rows in the courtroom. Also present were Mr. Zachary Zwerdling for Joe and,Jevin Kitchen and Ms. Elan Firpo for another family member.

Sgt. Jason Kadle of the Fortuna Police Department was only a minute away from the location when he received a dispatch call at "approximately 9:16 p.m. in the evening" on July 12, 2016.

He was dispatched to the "Eel River area" for a collision with possible deceased female lying in the roadway."

Sgt. Kadle described the location where he went as near the Eel River Track Club.

He arrived just seconds after FTO Gabe Charlton was on the scene. "A gentleman in the middle of road was flagging us,down."

"I observed a body," said Sgt. Kadle. "Officer Charlton could not find a pulse. I could not find a pulse. Victim was lying face down. We rolled her over on her back. Still could not find a pulse."

"She was face down, head to North, feet to South, no breathing, no pulse. "

Courtroom testimony will continue after a lunch break.

Thanks so much, Knox. This is heartbreaking testimony. Chiv will report on the rest of it this evening.

From the link...

"The legs of the victim #1 were deformed. They appeared twisted. The neck was in an elongated position. There were marks on the torso, head and hands of the victim.

<snip>

Marci Kitchen listened to all the testimony, including the discovery of her daughter's body who was taking agonized breaths and still showed no visible emotion.

But the Sgt. Kadle did!

Towards, the end of the testimony, Sgt. Kadle was asked to describe three photos of Victim #1 (Faith Tsarnas) by Ms. Eads. Sgt. Kadle had to pause before he responded as he was choked with emotion looking at the photos.

From the Times Standard...Sgt Kadle described MK as she arrived at the scene "demanding to see her daughter." Who told her that it was her daughter who was hit?

“She was visibly upset and crying; her speech was slightly slurred,” Kadle said. “I could smell the odor of an alcoholic beverage coming from her as she spoke.”

Interesting comments on the TS FB page by SR and someone who knows MK.

I am going to judge. This woman has not right being a called a mother. How the heck does a person (a mom none the less) not show emotion? How? There is something terrible and wrong with her.

Yep, I don't think this falls anywhere near the old excuse of "Not everyone grieves the same." Nope. Maybe my age is showing but my friends and I usually refer to this kind of flat emotion as... psychopathy. JMO.

I hate reading the heartbreaking testimony but I'm glad the community is as horrified as we are here. It makes me sick that Marci may very well end up with probation. Are there so many drunk drivers in California who run over and kill innocent people that it's become acceptable? I don't understand the logic behind such laws and probably never will.

Please, please put her in jail or she's going to kill again. And as for her "boyfriend" who apparently is okay with her actions, well... :censored:

OMG, from here:

http://johnchiv.blogspot.com/2017/05/she-noticed-jeep-was-badly-damaged-she.html#more

"Ms. Kitchen requested Ms. Rex go to her residence, which is short distance from the collision, and pull out seven pounds of marijuana from the Jeep." Rex agreed to that, said Officer Adams. "Ms. Kitchen said she was in Oakland and Kiya had just died."

When Rex arrived at the Kitchen residence, "she was surprised to see that the Jeep wasn't where it was normally parked."

"She got the hideaway key and called Ms. Kitchen back on her cell phone. When she entered the residence, she saw a male she did not recognize lying on the couch. She asked the male who he was. The male provided a first name. She continued to the backyard and located the Jeep in the side yard area."

"She noticed the Jeep was badly damaged. She started exclaiming, "Omg Omg Marci."

"Ms. Kitchen's response was, "That Marci told her, 'I did it; I did it; I hit the girls."

Rex opened the driver's side of the Jeep and began looking for the bag of marijuana. "Ms. Rex was unable to find such a bag."

Rex was also asked to retrieve all alcohol from the Jeep. She found one bottle of unopened beer. "Ms. Rex placed it on the kitchen counter inside the house."

"Ms. Rex asked Ms. Kitchen, 'Were you drinking?' Ms. Rex said that Ms. Kitchen said, 'I had a couple. I thought I hit a deer, Rhonda. I thought I hit a deer."

I don't like this. She might totally get away with it using the deer defense.

The deer defense won't work because she hid the Jeep. You don't hide your vehicle if you hit a deer.
