2009.10.12 Defense's Motions In Limine-Preclude Murder Case Evidence, Prior Bad Acts

i have a question for the people who know this legal stuff. if casey anthony has a trial and the death penalty is on the table, then it would be possible that the jury find her guilty and recommend death? as opposed to if she took a plea bargain that would say she gets life?
so if she is going to trial, the possibility of her getting the death penalty by a jury would remain possible?
this case is sooo well known it would be hard to find jurors that haven't heard about it i'd think.

There is no plea bargain being offered by the SA now, so that is not an option. Long ago, (..before Caylee's remains were found???) the SA did make an offer, but JB/KC chose to reject it.

If the jury finds KC guilty after listening to all the evidence presented at trail , the death penalty phase will begin. The jury will hear more evidence - often very emotional testimony from family, friends, character witnesses, etc. representing each side. The jury must then decide whether to impose the death penalty or sentence her to life-without-parole (LOP).

A motion made before a trial begins, asking the court to decide whether particular evidence will be admissible. A motion in limine is most often made to exclude evidence by a party who believes that evidence would prejudice the jury against him or her. For example, a defendant in a criminal trial might make a motion in limine to exclude evidence of previous crimes.

The very arguments they use in their Motion in Limine are going to work against them when trying to have Jill Kerley's testimony introduced into evidence. Check out the cut and past job in this document, page two ( there is a mention of a different case...supervising students). Sad, tired and pitiful!!!
