Ya know it's not like KC has this full schedule and can't find the time to read these documents they are giving her in court before the hearings. Why can't they give these to her prior to court to read. She is suppose to be paying attention to what is going on during the court procedures. I can see her asking questions but, really, they can't take some time to prepare her. And if JB is concerned about what she writes, give her a legal pad and let her flip up the top page to cover what she writes. She paid JB $275,000 the least he can do is give her a full pad instead of a couple of sheets. Instead of flailing against the wind....cover up. Common sense here. jmo

I must find it for us, but I recall earlier on with Andrea, she saw Casey with her note pad and pen and she appeared to be telling her, no do not do that
(moments after Baez had given it to her). Casey was annoyed.

Obviously, no one should be zooming in on documents on the defense table, that is outrageous. I am shocked that the editor of the paper did not remove that shot or black out the image of the document, that is the easiest thing for an editor to do, so the spirit of the photo still depicts the idea of her reviewing something. Clearly, the judge will remind everyone of common sense on this matter. Much like a producer cutting scenes in a movie, the editor asks is the story still complete without this and if yes, you cut it.
IMO, it would actually work against Casey to have a jury see her feverishly writing notes, as she did when Jesse and Tony's lawyers were arguing on their behalf to the judge. The immediate reaction I had to that, is rut row....she is way on board with trying to insinuate them into this murder, she is actively participating. That is a far cry from pretending she could not help what her lawyers did to her boyfriend. I immediately thought, she cannot have any paper and pen at trial, it sends the wrong messages, she has very little control over her body language and it does not work in her favor! We don't need Lillian to help us with a keen grasp of the obvious.
Also, since Baez seems so very easily distracted, any nonsense notes from Casey do not help him respond when it is his turn at the podium. The judge often has to redirect him to what he is to be responding to, as he seems to select one or two points and ignore the others that the state just argued two minutes before. If anyone should be writing notes , it is the defense lawyers. I include Cheney becuase he so often makes it obvious he has a poor understanding of what has transpired in this case so far.

Does anyone have the clip from a recent hearing where Cheney stood up and told the judge basically that the state had secreted from them psychological tests the FBI had ran on mom and pop? He was righteously indignent that they just learned of this the day before in Nick's depo. Mrs. Drane-Burdick stood up to set him straight, or what I like to call, take him to SCHOOL, and told the judge that is not true. Not only did he mistate what Nick testified to in the depo, but the defense, well at least Jose, most certainly did know about mom and pop filling out the questionnaires about Casey, because ..wait for it....Baez, himself, made mention and references to them IN THE DEPO.
If anyone needs a note pad, it is the defense lawyers. Indeed if I were them I would digitally record each and every meeting, hearing, depo, phone call, etc that goes on, so I can make informed statements. We have enough easily disprovable lies coming from their client, they do not need to further embarass themselves by making bad faith accusations against the prosecutors.
They need a note pad , alright, one with some magic shooting out of it.
That was the first time we saw Linda Drane Burdick get upset. Even so she guarded her words carefully and said things like that is wholly incorrect or no , that is not true. Baez and Lyon FAILED (purposely of course) to include that Casey Anthony stated to a 911 Operator AND to LE, AND to her family and Lawyer, that she had "left" Caylee with her "ahem" nanny, ZFG, and never saw her again but did speak with her, so she claimed.

If they filed nothing recently on it, I surmize it is the latter. It is just funny; because, Baez was jumping up and down that the news station reports that they had abandoned the Kronk matter were wildly incorrect.

The hair expert for the defense, did they replace him yet? Or did they wind up listing him afterall?
It is almost time for the 45 days to be up, for the defense to have the would be DNA tests complete on the shorts, etc.

Yes they did...But no new filing to reintroduce his prior bad acts.. His Honor asked him at last motion hearing if he was going to bring this up again, Baez stated he was going to wait (to see what happens with the touch DNA results)..His Honor stated he had deadlines to meet and this was one of those deadlines..paraphrased from memory...JMHO

I could be wrong and it would not surprise me if I were but I thought Judge Perry wanted to address the Kronk issue prior to the 24th when he was on vacation? Didn't he say he had time on the 23rd to hear it? If this is so I would not think this will go over very well with his honor.
 
You know it really looks like the defense is doing all this on purpose to piss off the judge so the Judge either will make an error in his ruling for appeal or they are doing it in hopes something will stick in their favor.
 
Cheney thinks he is being sneaky by popping the Kronk issue in there. Perry TWICE warned Baez that it would be denied and not heard until trial unless the deadline was met (November 29, December 20). He can bring it up at trial when he attempts to call his Kronk witnesses: Jill Kerley, Brandon Sparks, etc.

Did anyone else notice that Cheney also has left out the heart-shaped sticker motion and that there are two motions that haven't even been filed with the Clerk of the Court? (Bock - root growth and a motion asking the judge to ORDER the JAC to pay that pesky Tennessee transcript bill)?
 
Fifteen minute mark, the judge is saying, "Non scientific motions must be heard by December 31st, 2010. If it has not been HEARD by 12-31-10, it will not be heard". It seems the defense confuses the word filed with HEARD, and they tried to file the mass documents at the end of the month, where there was no possible way they would be HEARD by then.

Well, It's still past (or is it passed :innocent:) the DDD....This will be interesting to see how His Honor handles this, I'll bet this motions hearing will be a doozie...JMHO

It could very well be that they know the judge is going to say it is too late, and later they plan claim that they had good cause for their delay and her rights to a fair trial were imposed upon due to the judge being unwilling to extend these dates. Cheney Mason himself has said the outcome of a guilty verdict is certain, so the more items they try to preserve for appeal issues, the better for their client that they lay a record, as it were.

Or as Andrea puts it in her lectures, if you don't like something, file a motion, at least it buys you time.

The irony is rich, after asking the court for privacy, he returns to his seat, near his wife, and who is beside her ....a TV movie producer who likely is paying them money for their exclusive help on his project.

They are on the defense witness list. When the judge told them that it had to be heard by the 23rd, he said it wouldn't be heard... until trial.

I believe the judge will hear the motions for one reason only. There will be a sequestered jury from out of town for a long period of time. The trial will go six days a week as well.

There's no way the judge will hold off on all these issues to arise at trial when the defense can object to the introduction of testimony. Then, the judge has to send the jury out, hear the arguments, rule and bring the jury back in.

However, let's also remember that the judge said that "come January, it will be my rules".
 
From page one of this tattoo-related motion:

Not quite as glaring as it was for them to say the duct tape was recovered "NEAR" the remains--but still, rather a factual stretch for us what have studied the facts.

I hope HHSS is not sitting on his rainbow right above HHJP's head Monday because he will get knocked cattywhompus when HHJP's chair rocks fast enough to finally achieve liftoff...

Out of everything that has been filed by the defense in this case over 2 years, this is without a doubt the most careless, glaring error I have seen yet. I have been shaking my head for 2 days about this one and still can't get over it. I am almost embarrassed for them.

I keep envisioning Ashton addressing this one. He is not even going to have to use his usual passionate voice when arguing. His biggest obstacle is going to be suppressing his laughter.

Seriously folks....It is downright scary that there are hundreds of us "bloggers" who know the ins and outs of this case SO MUCH BETTER than the defense that is now being funded by FL taxpayers.

I have no more words about this one.

Soooooooo... I can see the defense trying this, but it does not address exactly *how* Caylee became "missing" in the first place. Nor does it explain the duct tape.

"Hey, Mom, I just killed Caylee."

"Just toss her down the street and don't say a word or I'll kill you. OK, Sweetie?"
