Knox awaits verdict from Italy's highest court

ROME (AP) — Amanda Knox was "very anxious" as Italy's top criminal court heard arguments Monday from prosecutors appealing her acquittal in the murder of her roommate, her lawyer said.

"She's carefully paying attention to what will come out," attorney Luciano Ghirga said as he arrived at Italy's Court of Cassation. "This is a fundamental stage. The trial is very complex."

Prosecutors are asking the high court to throw out the acquittals of American Knox and her Italian ex-boyfriend in the murder of 21-year-old British student Meredith Kercher, and order a new trial...

The question makes sense. I have chosen to address one of the items in the list, rather than the entire list. That is, one of the reasons given for calling a prosecutor an imbecile is based on the opinion that it was inappropriate to include a computer generated re-enactment during the trial. I have to wonder if all prosecutors, or only Italian prosecutors, that use computer generated re-enactments can be considered to be "imbeciles".

Your comprehension of the matter is way off, Otto. Do you think he is being investigated solely for the reason that a CG re-enactment was made? Of course not. You keep ignoring, as you did 9 months ago, that the issue is misuse of government funds and the Italian government has launched an investigation into why so much money was put into it. It seems to be a simple audit, the reasons for which are fairly obvious. Apparently you think the investigation is unwarranted. As I said in previous discussions, let's wait and see what comes of it.

Latest from TJMK:

The ruling from the Court of Cassation should be at 10:00 am tomorrow.

I haven't followed the life of the prosecutor (simply not interested), so I have no idea what is happening in terms of the cost of the trial. I was merely responding to your comment that one of the reasons that any prosecutor can be considered to be an imbecile is due to the use of computer generated re-enactments during trial.

IMO, Amanda Knox was present when her room mate was brutally tortured and murdered.

I don't know the personal life of the prosecutor, and frankly do not understand what it has to do with the guilt/innocence of Amanda Knox.

Very much agree and hoping the court will see to it that Meredith is given true justice

Yes you do. You and I discussed it here last May:

No one is discussing his personal life. Otto and I have been discussing a reenactment video used in the trial.

The acquittals were cancelled. There will be a retrial and the murderers of Meredith Kercher won't get away with it this time. Fantastic news!

Sooooooooo ...

Was the conviction upheld?

So the conviction was upheld.

And it's a bit like she was released from jail while the courts considered the arguments.
... so a new trial is ordered to reconsider the evidence?

Will this result in more criticism of the Italian judicial system, or will the higher court decision be respected? I sure hope the panel of judges is squeaky clean and that no one sitting on the jury has had a legal complaint, attended a party with the politicians, or stood on a subway platform discussing the case.

Nothing in the news. Are they still trying to figure out how to word the decision in English?

Just heard it on the BBC news ... overturned the acquittal.

They face a re-trial.
I hope Knox hasn't been relieved of all of her 4 million in book money ... yet.

Meredith's family must be so relieved to finally have a good amount of justice for her murder.

BBC RADIO:

Judges in the highest court in the land found that the appeal was unsound and inappropriate, so the appeals process will be repeated; essentially a new trial. It could be years ... Knox left Italy as soon as she was released from jail and has been in Seattle getting on with life and writing a book. Now that the verdict is in, Italy doesn't expect her to voluntarily return. She can be extradicted after the next verdict. Sollecito has different circumstances because he lives in Italy and could face 25 years in jail.

Nadeau on BBC: She thought it was going to a re-trial after the delay - a hint that it would go this way. She describes this part of the process as a "twist in the case". Meredith's family is good with it because it gives them some sense of closure. They believe that Knox and Sollecito were complicite in the murder. Because of treating the murderer as a celebrity, the family felt that the victim was so forgotten.

Re-trial will review all forensic evidence.

I guess whatever they publish in their books can be used in the re-trial. I wonder how the story has changed between the book and the original story about being stoned, or was it cutting Meredith during an imaginery dinner at his house, or was it failed memory?

It seems similar to a hung jury and an appeal (eg: Jason Young). The only difference seems to be that the Italian courts spend a lot more time in making the decisions ... and the prosecution has the right of appeal.
