"MONTREAL — The Luka Magnotta murder and dismemberment case that made headlines worldwide last year is back in court Wednesday, but it's not clear if the defendant will appear.

"MONTREAL -- A shackled Luka Rocco Magnotta remained impassive as he made his first court appearance since last June on a first-degree murder charge in the gruesome slaying of a Montreal university student.

Magnotta kept his eyes on the ground when not looking at the Crown or the judge as lawyers set the stage Wednesday for a preliminary hearing that will begin March 11.

The hearing, which will determine whether the 30-year-old Ontario native is sent to trial, is scheduled to last at least two weeks and possibly resume in June"

I'm sure we're all sad to read that Magnotta's alleged charismatic personality seems to have been suppressed while in jail...

Apparently, a Canadian film company is making a documentary, which should prove to be a daunting task if done thoroughly. They are going to interview Kadir (the internet cafe guy) tomorrow.

"The Unrepentant

They are marked by their ability to kill without passion and without remorse. Some are called psychopaths - a term that evokes nightmare images of murderers and monsters. But the label can also apply to men and women who are successful, intelligent, charismatic, charming and amusing - and so all the more dangerous. This week on the fifth estate, Linden MacIntyre looks at what makes a psychopath through the fifth estate's close encounters with of four of Canada's most frightening criminals."

The attention w***e doesn't want attention? :what:

Jellybeanz you just made me laugh out loud, I used attention who're on another thread yesterday...

He probably doesn't want attention because he likely doesn't have access to his Proactiv in jail; remember how bad his blemishes were upon his return from Germany.

This just falls in line with his defence. If his online presense was created by imposters, then of course he wouldn't crave any sort of court sensationalism.

"MONTREAL - Quebec criminal lawyer Robert La Haye said it likely won't be difficult for the Crown to prove that Luka Magnotta butchered Chinese student Jun Lin.

The Crown is expected to present a video purported to show the murder. The real work for Magnotta's defence team will be to prove that their client wasn't aware of what he was doing the night Lin was murdered.

"In a case like this, what else will you do?" asked La Haye.

Magnotta, 30, is charged with first-degree murder and indignity to a human body after Lin was cut into pieces last May in Montreal.

La Haye said he suspects both sides will present psychiatrists to argue whether or not Magnotta is criminally responsible for Lin's murder.

"It will be a battle of experts," La Haye said"

"MONTREAL — Sitting at a cafe in this city, Benjamin says he will never forget his friend Jun Lin. And he will never be able to shake how gruesome his death was. Sometimes, he says, he has nightmares.

"What happened in (Luka) Magnotta's apartment?" He asks. "Was my friend drugged? Did he call for help? I'm not a member of the family, so I don't have that information."

He planned this murder. There was clear premeditation and he was aware of what he was doing. Sigh. I hope this will be demonstrated in trial.

MONTREAL - For the first time, Diran Lin will be in the same room as the man accused of killing and dismembering his son. Their eyes may meet, but nothing more.

"I have no clear message to give him," the father of murdered and butchered Jun Lin, 33, told QMI Agency in an exclusive interview Sunday.

"The pain of losing a loving son will never fade. There is nothing to say about Luka Rocco Magnotta."

Is his name officially Luka Magnotta or Eric Newman? If it's EN, I wish the media would use that name and add his AKA. JMO

His name has legally been Luka Rocco Magnotta since 2006, so that should be the only name he is referred to by the media and otherwise.

I am hoping the media will NOT be banned! I guess we will know tomorrow morning. :please:

http://www.torontosun.com/2013/03/11/judge-to-rule-on-luka-magnotta-courtroom-ban-on-tuesday
"Defence lawyer Luc Leclair wants the public gallery emptied under a rarely-used provision of the Criminal Code.

Section 537 allows a judge to bar onlookers and media from a courtroom "where it appears to him that the ends of justice will be best served by so doing."

Leclair told the judge Monday that reports about court hearings, high security and even Magnotta's body language and wardrobe could taint the jury pool.

"There's been so much bad publicity about Mr. Magnotta," said Leclair. "It was reported that there was a glass (prisoners') box, that there were guards, (that) the public has to watch out for this man. So how do we rectify this?"

As Leclair spoke, the accused killer sat in the glass-enclosed prisoners' box, shackled hand and foot and dressed in a white T-shirt"

The public and media better not be banned!! I have vacation coming up soon and will be going to check this circus out. There is no reason why the court would award him this. It's unheard of!!! What's he hiding??? Hopefully I will be able to attend a couple of days atleast..
