Gary Giordano was denied release from an Aruba jail today as ABC News obtained evidence showing Giordano's eager calls to cash in on the life insurance policy of missing woman Robyn Gardner.....

.... "(He) sounded excited, like he was about to win something," one representative from American Express insurance told the FBI.

Court documents also show that Giordano had previously taken out an insurance policy on Gardner for a trip in June. The policy, obtained by ABC News, is dated April 27 and was signed by Gardner on May 12, officially designating Giordano as her beneficiary and listing him as her "domestic partner.".....

'As long as we don't have a body, you can question whether or not she is dead,' Mr Stein said. 'On the other hand, with all the publicity on the case, if she were still alive she would have made herself known.'

Other factors also lead to the conclusion she is dead, Mr Stein told reporters. Police have recovered her passport from her belongings and don't believe she could have left the island by air with a false identity. They have also found no evidence that she left Aruba by boat.

He also said if Ms Gardner had drowned where Giordano had said she did, then the body should have surfaced by now, reported Fox News.

‘We know the spot where he said she must have drowned,’ he said. ‘We have searched there extensively and in view of the weather situation we are almost certain that the body would have come to the surface.’

US man getting out of Aruba jail but still suspect

Once back in the U.S., he would be free to file a claim to redeem the American Express travel insurance policy he took out on Gardner.

An American Express spokeswoman, Gail Wasserman, said she could not confirm that Giordano has such a policy but said anyone making such a claim would have to produce documentation such as a death certificate and any police reports. "Then we would make a determination if the claim is payable."

No claim would be paid if it turned out there was fraud or "anything untoward" that would void the policy, she said.
