Found Deceased Australia - Matthew Leveson, 20, Cronulla, NSW, 24 Sept 2007

Police are now searching a location in the Royal National Park, not far from where Mr Leveson lived before he disappeared in 2007, for the 20-year-old man's body.
Officers have been led there by his former partner, Michael Atkins, who was found not guilty of the murder and manslaughter of Mr Leveson following a trial in 2009.

It is understood that Mr Atkins led police to that spot in the early hours of Thursday but no remains have so far been found.
The search comes after Mr Atkins was compelled to give evidence at the coronial inquest last week but had been granted immunity from prosecution for any admissions he might have made.
 
So what happens if they find Matthew. Is Atkins going to be completely immune to this murder?!?!
 
He can't be charged again being under protection of immunity. Feels like an OJ Simpson situation but with a confession. Serious legal consequences---a murderer walks. And he's had 9 years of freedom since the murder...

Deputy state coroner Elaine Truscott compelled Mr Atkins to give evidence and granted him immunity from prosecution, which means any evidence he gives cannot be used against him in a criminal trial.

What if the police find evidence that wasn't submitted by Atkins, surely they can bring charges against him? I don't know how it works but there must be a loophole. Wishful thinking.... :(

Mr Leveson's mother Faye said: "The main objective is to bring Matt home - to bring him home to say our goodbyes - and to lay him to rest like a normal human being should be laid to rest when they die.
"If he (Mr Atkins) walks, so be it. We just want Matt home."

It's sad the trial was unsuccessful. The evidence seemed strong yet unable to convict him. :gaah:
 
So, Atkins is now back at the inquest while detectives are searching for Matthew in in the RNP.

This morning, he was due to resume giving evidence for a sixth day at an inquest in Sydney but the hearing was adjourned until 2:00pm.
It is believed homicide detectives have been negotiating with Mr Atkins and his lawyers since Friday.
 
I saw a 60 minutes report with Matthews poor parents a while ago. They spend all their time digging in this park for their son. Heartbreaking.:(

It is understood that police used Mr Atkins confession to having lied as leverage to get him to confess to where Matt’s body is.
He had told police when he was interviewed after Matt’s disappearance, he claimed to have been asleep in the couple’s flat and woke up to find Matt missing but he was confronted with CCTV footage of him buying a mattock and duct tape at Taren Point Bunnings.

Mr Atkins had first told the inquest last week that he had told police the truth in the interview.
Then on Friday he admitted that he had lied to them because he was “scared” of them — and therefore lied to the inquest.

9NEWS understands Mr Atikins was given indemnity from prosecution on contempt of court and perjury charges on the condition he lead police to Mr Leveson's body.

Is he likely to live longer outside prison ? He be scared for a while . Imo that he was so loaded on drugs he only vaguely knows where exactly matt is

This is the deal:

The office of NSW Attorney-General Gabrielle Upton confirmed a deal had been struck with Mr Atkins.
Under the deal, he was given indemnity from prosecution for perjury and contempt of court during his evidence at the inquest.
But the deal is dependent on him providing information to police leading to the recovery of Mr Leveson's body.
Ms Upton said she granted the indemnity following discussions with the Leveson family earlier this week.
"I had the privilege to speak to Matthew's parents Mark and Faye Leveson earlier this week who told me they support the granting of this conditional immunity," she said.
"Importantly the conditional immunity only covers prosecution for any perjury and contempt of court offences."

He'd want to hope he's remembered where Matthew is.
Inside or outside of prison, won't be safe.
Maybe he'll decide go to Thailand if he gets away with it.
He did say thats where he thought Matthew disappeared to. :worms:

The jury in the MA trial did not get to hear much of the critical evidence due to multiple police stuff ups by police & than alot of video evidence went "missing" & was only this year found in a detectives house. :gaah:

They didn't know about having him on CCTV buying the mattock & tape & his denials & the last known video of Matt leaving etc........
