CO - Custer Co., Partial female remains found, Nov'09 - Rebecca Magallanes

Investigators do not believe that skeletal remains found Sunday are those of a 22-year-old Colorado Springs woman who disappeared under suspicious circumstances in March 2008, the Teller County coroner said.

Dr. Earl Byrne said an examination of the remains point to a different person — although he declined to say who.

“All we can say is what it’s not, and it’s not Becky Elshani,” Byrne said, referring to a missing woman who may have been murdered by her boyfriend before he took his own life nearly three years ago.

From the wording of their statement, it sounds like they have an idea of who it is.

I'm thinking Maria Rosario Olea

Sorry I am moving and just have not had any time to look into this, but my first thought was Paige B... something. She was from the Grand Junction area, about 3 hours away. And has been missing for a few years, pretty sure she has a thread on here.

Teller County is not the most convenient dumping area from Grand Junction. The perp would have to drive up I-70, through Denver, and south to Colorado Springs, before cutting west to Teller County. The mountain routes from Grand Junction to Teller County are even more complicated.

That is, unless PB had some reason to go to Colorado Springs before encountering her killer. I saw the ID Channel "Disappeared" episode about her case, and apparently, she was running a clandestine "escort" business, so this very well may be plausible.

Cutting across the mountains might be more likely. That area is pretty remote from all directions.

There's a lot of business in Colorado Springs for an "escort"...

When I moved from OR to Colorado Springs, we googled directions, and they put us through the mountains, cut off of i-70 and went the back way, we totally avoided Denver. So I guess if someone looked up directions, they could easily end up in that area.... We didnt realize til we were here that it was the hard way to go.

The skull belongs to Rebecca Magallenes, whose other skeletal remains were found in November 2009.

CRIPPLE CREEK, COLO. (AP) -- The results of DNA tests have confirmed that a human skull found by a hunter in the woods near Cripple Creek is that of a 44-year-old woman believed killed and dismembered by her boyfriend.

Teller County Coroner Al Born tells The Gazette in Colorado Springs that the skull found in November belonged to Rebecca Magallanes (mah-gah-LAH-nis) of Florence. Her torso was found in Custer County shortly after she disappeared in 2009.

Three months after the alleged murder, Williams, 62, suffered a left hemisphere stroke, which damaged his ability to understand and use language. He has been found incompetent to continue in court proceedings during each hearing since November 2010.

In 2010, District Attorney Thom LeDoux said this finding does not mean Williams is not guilty by reason of insanity, only that he is unable to either mentally understand what is going on or to assist his attorney in his defense.

The case stems from an investigation into the murder of Rebecca Magallanes, 44, who reportedly had a lengthy, intimate relationship with Williams.

Defense Attorney Riley Selleck told the court at Williams' last hearing he was planning to file a motion to dismiss the charges because the latest evaluation from the state hospital in Pueblo determined that he is not competent to proceed...

Williams was arrested July 23, 2010, in Penrose and has since been housed at the Colorado Mental Health Institute in Pueblo.

Slaying suspect remains incompetent

CANON CITY — A man accused of murdering his girlfriend and dismembering her body in 2009 remains incompetent to proceed in court, a judged ruled Wednesday.

John Paul Williams, 66, is charged with first-degree murder, first-degree assault, tampering with physical evidence and abuse of a corpse in the death of Rebecca Magallanes, 44. Her dismembered body was found in 2009 in Custer County and skull in 2010 in Teller County.

Since the slaying, Williams suffered a stroke, which has rendered him unable to speak and unable to comprehend legal questions as they relate to his case, according to earlier court testimony. He has been found incompetent to proceed in court based on several state hospital reviews.

Dr. Rose Marie Manguso, a neuropsychologist at CMHIP, Dr. Thomas Gray, director of training for court services at Colorado Office of Behavioral Health and a licensed psychologist, and Dr. Emily Inman, a clinical neuropsychologist who formerly was a competency evaluator at CMHIP, each testified Tuesday and agreed that Williams is incompetent to proceed and is unlikely to be restored to competency in the foreseeable reasonable future.

"Based on those findings - I am not making a determination as to guilt or innocence, or evidence or lack of evidence - it is simply a statutory requirement that the case will be dismissed," Wenner said. She stayed the dismissal for 21 days for civil commitment proceedings for the mental health cases, which will be closed to the public.

"I do find as a result of the circumstances that the defendant remains a potential danger to the victims and to the community, but he is also listed disabled and that is the basis for the certification requirements pursuant to Colorado Revised Statutes," Wenner said.
