1/10/24 Update: Next arraignment hearing on 1/23/24 @ 9am for criminal case. 1/23/24 Update: Crawford plead not guilty at her arraignment hearing. Judge Thomas Flesher accepted a not-guilty plea from Crawford who was previously charged with child abuse resulting in serious bodily injury & set the case for trial while he continued to consider a motion to dismiss the case. In August, Thom LeDoux, the attorney representing Crawford filed a motion to dismiss her case based on “outrageous government conduct” by 11th Judicial DA Linda Stanley. Crawford’s felony charge of child abuse resulting in serious bodily injury was dismissed in August, 2023 for lack of probable cause. Her other charges stemming from this case were moved to County court as misdemeanors: child abuse & cruelty to animals/neglect. Judge Flesher heard motions from both sides on 12/9/23, but Tuesday he said he still wasn't comfortable issuing a ruling & needed more time to review the materials. He ordered a transcript from the previous preliminary hearing for himself, the defense & the prosecution. He also ordered that LeDoux & Deputy DA Wendy Owens submit in writing what they believe an appropriate sanction in this case would be, aside from dismissal. They also must attach reports that pertain to evidence & whether they would be admissible in trial. The parties have two weeks to submit their reports to the court. Judge Flesher said his calendar is booking up into June, so he tentatively set a two-week trial beginning July 9, 2024. In the meantime, both parties may file motions while waiting for the judge's ruling. Flesher scheduled a setting hearing on 3/18/24 @ 3:30pm.

A district court judge is considering two motions to dismiss the first-degree-murder case against the Cañon City man accused of causing fatal injuries to his live-in girlfriend’s baby in May.

Both motions stem from alleged actions on behalf of 11th Judicial District Attorney Linda Stanley, including outrageous governmental conduct and a discovery violation.

During a continued motion hearing for Jacobs on Friday, his public defender, Jake Taufer, contended that Stanley’s comments in an Aug. 1 television interview with KRDO Channel 13 regarding the case were an attempt "to weaponize the press against Mr. Jacobs and Ms. Crawford." Taufer stated that Stanley made the comments intentionally, willingly and knowingly. The intent of the interview, he said, was to sway public opinion and poison the jury pool.

A similar motion filed in August by Crawford's attorney, Thom LeDoux, claims Stanley's comments in that same televised interview were "highly prejudicial."

Jacobs' attorneys asked for the 29-minute raw interview footage during a Feb. 1 hearing, when Deputy District Attorney Wendy Owens said it hadn't been placed into evidence and that Stanley was the only one in possession of it. District Court Judge Kaitlin Turner ordered the video be released by Feb. 15.

FREMONT COUNTY, Colo. (KKTV) - After nearly 11 months in custody, a Colorado man facing child abuse charges related to the death of a baby in Canon City in May 2023 was released on a PR bond Tuesday afternoon.

During a court appearance for William Jacobs on Tuesday in Fremont County, a judge ruled to change Jacobs’ $100,000 cash bond to a no-cost PR bond, with stipulations of GPS monitoring and protection orders put in place for those impacted most directly by the case.

Also discussed during Tuesday’s hearing was a motion for sanctions on the case, including potential dismissal of the case.

Jacobs’ lawyers argued that comments made by 11th Judicial DA Linda Stanley during a local interview in July 2023 and then a misrepresentation of her intent following that interview warranted some sort of dismissal in the case, either of the case as a whole or of specific charges.

Prosecutors argued that the dismissal of the case would be “an extreme sanction and certainly not warranted.”

The judge in the case did not immediately rule on this motion and said that a written decision would be made at a later date.

Personal Recognizance bond (PR bond): A PR bond is a signature bond that involves no money or property as long as the defendant appears at all future court dates. The defendant's signature acts as the promise to appear in court.

Tuesday, April 23rd:
*Setting Hearing (@ 1:30pm MT) - CO - Edward Hayes (10 mos.) disciplined like a dog by mom’s boyfriend, was found unconscious at Motel 6. The child was transported to the Children’s Hospital in Colorado Springs, May 21, 2023 & died on May 23, 2023, Cañon City - *Brook N. Crawford (20) arrested (6/13/23) & formally charged (6/28/23) & arraigned (1/23/24) with child abuse (F3) (This charge was dismissed on 8/28/23), child abuse (Class 1 misdemeanor) & cruelty to animals/neglect. Plead not guilty. She was released on a personal recognizance bond by the Court.
Trial set to begin on 7/9/24 (thru 7/19/24).
District Court Judge Kaitlin Turner. Asst. DA Wendy Owens. Defense attorney Thom LeDoux.

3/18/24 Update: District Court Judge Kaitlin Turner is considering two motions to dismiss the 1st-degree-murder case against Jacobs. Both motions stem from alleged actions on behalf of 11th Judicial DA Linda Stanley, including outrageous governmental conduct & a discovery violation. During a continued motion hearing for Jacobs on Friday [3/22/24], his public defender, Jake Taufer, contended that Stanley’s comments in an Aug. 1 television interview with KRDO Channel 13 regarding the case were an attempt "to weaponize the press against Mr. Jacobs & Ms. Crawford." Taufer stated that Stanley made the comments intentionally, willingly & knowingly. The intent of the interview, he said, was to sway public opinion & poison the jury pool. A similar motion filed in August by Crawford's attorney, Thom LeDoux, claims Stanley's comments in that same televised interview were "highly prejudicial." Jacobs' attorneys asked for the 29-minute raw interview footage during a Feb. 1 hearing, when Deputy DA Wendy Owens said it hadn't been placed into evidence & that Stanley was the only one in possession of it. District Court Judge Kaitlin Turner ordered the video be released by Feb. 15. Turner watched the video March 21. She said one part of the interview that wasn’t broadcast was Stanley lamenting that "Fremont County is against me, the sheriff is against me, judges are against me" & it's not like that in the other counties. "The consequences couldn’t be higher," Taufer said. " ... Our position for outrageous governmental conduct is dismissal.” Jacobs is scheduled to attend his next motions hearing on 4/9/24 when bond is expected to be addressed. Crawford will appear next 4/15/24 for a setting @ 1:15pm.
