In a press conference today, Eytan pointed to the 11th Judicial District Attorney’s Office, specifically in regards to the Morphew case, as the reason prosecutorial immunity needs to end.

“Prosecutorial misconduct hurts the innocent accused,” Eytan said. “It hurts victims of crimes and it hurts the public and taxpayer money.”

In an 83-page complaint sent to the Office of Attorney Regulation Counsel, Eytan details a dozen violations of court and attorney rules by Stanley and her office, including failure to uphold victim rights, dishonest and unethical practices and the repeated failure to turn over evidence.

“They excused any evidence of innocence, concealed favorable evidence, manufactured evidence and opinions and allowed witnesses to testify falsely,” the complaint states. “The real threat to the public remains as long as they are able to continue the practice of law without any significant discipline.”

According to a motion of dismissal document obtained by FOX31, Morphew sued FBI Special Agents Jonathan Grusing and Kenneth Harris. Morphew is seeking damages from the agents’ personal assets through the U.S. Supreme Court case Bivens v. Six Unknown
Named Agents.

In that case, the Supreme Court ruled that federal courts could award financial damages in cases where a person’s constitutional rights were violated by the FBI.

Morphew is allegedly invoking the Bivens case as a reason to seek damages. However, the FBI agents’ attorney cited the 2007 Wilkie v. Robbins case and said “…the right to maintain a claim for damages against a federal official under Bivens ‘is not an automatic entitlement . . . and in most instances [the Supreme Court has] found a Bivens remedy unjustified.”

The document claims that Grusing and Harris are immune from personal liability because “Morphew fails to plead nonconclusory facts showing that they violated any clearly established constitutional right.”

For these reasons, the agents’ attorney is asking the court to dismiss the case against them.

DENVER (Scripps News Denver) — Two more prosecutors in the case against Barry Morphew, who was once charged in death of his wife, are being accused of conspiring to discredit the judge who was overseeing the now-dismissed trial.

Disciplinary complaints filed by the Colorado Supreme Court Office of Attorney Regulation Counsel (OARC) on Friday accuse Robert Wiener, the former deputy attorney general for the 1st Judicial District, and Mark Hurlbert, the deputy attorney general for the 11th Judicial District, of misconduct and abuse of power during the initial prosecution of Barry Morphew in 2022.

In the complaint, the OARC alleges Wiener, Hurlbert and Linda Stanley, the district attorney for the 11th Judicial District, felt that Judge Lama “hated them” and conspired to get him removed after learning about Lama’s ex-wife’s work as anti-domestic violence advocate.

Stanley is facing similar complaints by the OARC. The complaint, which was filed in October 2023, alleges she also violated the state’s professional code of conduct in her interactions with a YouTube influencer before, during and after Morphew’s prosecution.

Hurlbert denied the allegations and told Scripps News Denver that he “will be filing a public response.” Both Hurlbert and Wiener have 28 days to file a response to the complaint.

In its complaint, the board asked for the prosecutors to face punishment up to and including disbarment. Stanley’s trial is set for June 2024, according to Denver’s Eytan Law firm, which is representing Barry Morphew.

DENVER (KDVR) — People facing charges of first-degree murder could soon be held without bail in Colorado if a proposed bill passes through the state legislature and ends up on your November ballot.

The goal is to make sure murder suspects can’t be bailed out of jail.

All of this comes down to the language used in the Colorado Constitution and statutes. Two bills have been proposed to make changes to both.

FREMONT COUNTY, Colo. (KRDO) -- In a document obtained by KRDO13 Investigates, 11th Judicial District Attorney Linda Stanley denies allegations made against her in numerous complaints.

Now that Stanley has responded to the allegations, Jensen said a conference hearing is scheduled for Jan. 2, where a possible hearing trial date will be set.

Seven months after her remains were found in a shallow grave south of Moffat, Suzanne Morphew’s autopsy report is finished, investigative sources confirmed.

The autopsy took longer than usual because forensic testing had to be completed, a source said, who asked not to be identified because they're not authorized to speak publicly.

Some of that testing was done at the FBI training and research center in Quantico, Virginia. The autopsy report was not immediately available to the public. Autopsies are public records.

Sources said that the actual autopsy was done by the El Paso County Coroner's office.

Mallory and Macy Morphew reportedly still support him. Barry Morphew and Morphew's daughters will be having a celebration of life for Suzanne Morphew on May 4 at Trinity Baptist Church in Westfield, Indiana.

Morphew maintains his innocence in the case. He has moved from Colorado to Indiana, where he and Suzanne first met when she was in high school and he was in college.

DENVER (KDVR) — The autopsy for Suzanne Morphew has been completed, FOX31 has learned, nearly seven months after her remains were discovered in Saguache County.

The Colorado Bureau of Investigation confirmed that the autopsy was complete but said it could be several more days before it is released.

Her husband, Barry Morphew, was arrested on May 5, 2021, and charged with first-degree murder. However, those charges were dropped in April 2022 just before the case went to trial.

In September 2023, remains were found in Saguache County and confirmed to be Morphew.

CHAFFEE COUNTY, Colo. — The Colorado Bureau of Investigation confirms with News5 that the autopsy of Suzanne Morphew has been completed.

News5 has requested a copy of the report from the Chaffee County Coroner, but is awaiting a response.

Suzanne Morphew was found in September of 2023, nearly three years after her disappearance on Mother's Day 2020.

CHAFFEE COUNTY, Colo. (KKTV) - As the search for answers continues into how a Colorado mother died, the autopsy for Suzanne Morphew has been completed.

Morphew, who was living in the Salida area, was reported missing on May 10, 2020, Mother’s Day. Her body was found during a search in September of 2023 in Saguache County. At one point, Suzanne Morphew’s husband Barry was a suspect in the case but charges were eventually dropped.

Since she was reported missing her family and members of the community have been searching for answers.

KKTV 11 News has been requesting her autopsy report every week for months. On Wednesday, 11 News confirmed with the Colorado Bureau of Investigation that her autopsy has been completed.

11 News is working to learn more about the results of the autopsy and where Suzanne’s remains currently are. As more information becomes available we will be providing updates.

TIMELINE OF THE CASE:

- May 10, 2020: Suzanne Morphew reported missing.

- May 11, 2020: Search crews are called to the area she was believed to be in near her Chaffee County home.

- May 15, 2020: Items belonging to Suzanne were found.

- May 17, 2020: Barry, the husband of Suzanne, shares a video with the public asking for help with finding her. It can be viewed at the bottom of this article.

- May 19, 2020: Authorities search the Morphew home.

- May 22, 2020: A separate residential property is searched, where a concrete foundation had just been poured

- May 5, 2021: Barry Morphew is arrested

-April 18, 2022 Murder charges dismissed

-Sept. 27, 2023 CBI announces the El Paso County Coroner identified remains found in Saguache County as belonging to Suzanne

According to the Colorado Bureau of Investigation, the report from the Chaffee County Medical Examiner is expected to be released next week.

The Colorado medical examiner has completed an autopsy for Suzanne Morphew, a mom of two who went missing in 2020 before her remains were found in October 2023. I have maintained that what she was wearing at the time of her disappearance will point to when she was killed. I believe she will have on the bathing suit. That means she was not in bed sleeping when Barry left.

 
Justice for SM. She did not receive justice in this life. The DA only made matters worse and SM did not receive justice after she was murdered. I hope that this autopsy gives some answers and that SM will belatedly get some justice. The Prosecutor made a complete disaster of this case. ALL MOO.
 
The former judge in the Suzanne Morphew case is speaking out for the first time about what went on behind the scenes as the first-degree murder case of Barry Morphew wound its way toward a trial that never happened.
