In a days-long suppression hearing, Troconis’ defense team argued that some evidence should not be allowed to be presented by state prosecutors, including certain interviews with investigators and evidence obtained from her cell phone after it was seized by detectives.

Judge Kevin A. Randolph has yet to decide on some of the evidence but ruled that evidence from Troconis’ cell phone will not be allowed at trial. Randolph ruled that “the exigent circumstances exception to the warrant requirement does not apply to the warrantless seizure of the defendant’s cell phone.”

Law enforcement had secured a warrant to search the defendants’ phone records as early as May 27, Randolph’s decision said, but there was no warrant for the seizure of her phone as of May 31.

During the interviews shown in court, Troconis said that they made the timelines to make sure they documented where they had been that day. Some were written by her and some by Dulos, she said.

Troconis was reportedly in the vehicle during the Albany Avenue trip, which was captured on surveillance footage but told investigators in the interview that she was primarily on her phone and not paying much attention to what they were doing. When she asked, she said Dulos told her to “relax.” She told investigators she just went along for the ride as a companion and that she would not have gone if she knew what he was doing.

Troconis said that she had slept in her daughter Nicole’s bed from midnight on the night before the disappearance so could not say for certain whether or not Dulos was home or in bed. She told investigators she never actually saw him that morning. She also told investigators during the interview that she had never even met Farber Dulos.

Troconis became visibly emotional multiple times during the interview, including when she was told that Dulos had allegedly been speaking with Farber Dulos about a potential reconciliation.

Detectives told her that, in their opinion, Dulos was manipulative and controlling and wouldn’t hesitate to pin the murder on her.

“I could be in prison because of him,” she said at one point in the interview. She said she was worried about going to jail and being away from her daughter

Investigators asked Troconis where she thought Farber Dulos was.

“I think that she’s still somewhere, I hope, hiding,” she said.

“I didn’t do it,” she said through sobs at one point in the interview.

In the interviews shown Thursday, investigators also questioned Troconis about pairs of shoes that were missing from the Farmington house and why Dulos decided to shave his head and entire body around the time of Farber Dulos’ disappearance. She told investigators that she shaved his head and that, before then, he had never asked her to do that.

The suppression hearing continues this week. Troconis’ trial is expected to begin at 10 a.m. on Jan. 8, 2024.
 

STAMFORD — “You guys haven’t done anything, at least you haven’t,” Michelle Troconis’s mother told her as the two spoke over the phone while Troconis sat in an interview room at the New Canaan Police Department on June 2, 2019.

The brief exchange was caught on camera in hours of footage taken of Troconis in the wake of her arrest in connection to the disappearance of Jennifer Dulos in 2019.

Witnesses have wrapped up testimony in a suppression hearing ahead of Michelle Troconis’ trial in January.

Troconis’ lawyer wants statements made in her interviews with police suppressed for the trial, arguing they were given because of coercive tactics and Troconis’ constitutional rights were violated. But investigators into the disappearance of Jennifer Dulos deny any wrongdoing, and maintain everything was relevant to the investigation.

“We have been checking out every aspect we can of your story and your story has some significant problems,” then-detective John Kimball said in Troconis’ second interview with police following her arrest in June of 2019.

Kimball wrapped up his testimony Monday with Troconis’s lawyer Jon Schoenhorn pressing him on tactics used in interviews.

The state maintains no harm by investigators was done, saying Troconis understood what investigators needed. Investigators' say their issue was with her changing story during the thick of the investigation.

“We noticed that her statements were providing alibis for herself and there were inconsistencies in her statements, which lead us to believe she was lying,” Kimball said.

When Kimball wrapped testimony, two more witnesses were called. The first was tossed out - the judge deciding he was irrelevant to the suppression hearing. The second, a state police sergeant in 2019 at the Litchfield troop L barracks.

The judge still must watch a third interview investigators conducted with Troconis back in August of 2019 and oral arguments need to be heard before he can make a decision on the motion to suppress the first two interviews.
Schoenhorn is hopeful for a decision on suppression by the end of the year.

Michelle Troconis' motions to suppress her DNA and police interviews was denied by a judge on Wednesday.

Judge Kevin Randolph denied motions to suppress Michelle Troconis’ police interviews and to suppress DNA evidence at her upcoming trial in connection to the disappearance and presumed death of Jennifer Dulos.

Troconis' defense attorney had argued that statements on Troconis' first two interviews should be suppressed for the full trial in January, and that Troconis’ constitutional rights were violated.

According to documents, Judge Randolph concluded the search warrants for Troconis’ DNA were valid and did not lack probable cause, and that Troconis’ had assistance of "competent council" during her interviews.

[Michelle] Manning will have to prove that Troconis engaged in an agreement between two or more people and one of them committed an overt act to further the crime to get a conspiracy to commit murder conviction, Hussey said.

"That's going to be tough for the state to prove," Hussey said. "This is a circumstantial case."

In arrest warrants, investigators believe they pieced together how Fotis Dulos killed his estranged wife and tried to get rid of evidence on the day she vanished. Arrest warrants also detail how investigators believe Troconis and Mawhinney may have played a role in the death.

Troconis is accused of trying to create an alibi for her former boyfriend the morning of the disappearance, first by being in his office to answer a phone call from Greece while Mawhinney was also there and by having her photo taken with "Marty," a robot at a nearby Stop & Shop grocery store, arrest warrants said.

Troconis also initially lied to police that she had been with Fotis Dulos in bed that morning and then later changed her story, saying she didn't know where he was until he arrived that afternoon at one of his properties associated with his real estate development company, The Fore Group, the warrants said.

A former TV host in South America and a mother herself, Troconis has denied several offenses including conspiracy to commit murder, tampering with physical evidence and hindering prosecution.

During hours of police interrogation over several days in June 2019, she was grilled about her then-boyfriend's whereabouts.

When she couldn't disclose whether he was at their Farmington home at the time of Jennifer's disappearance, one detective tried to encourage her to spill anything she knew about his movements by touting it as a 'golden ticket' to save her reputation.

'Have you looked at the news at all? Have you seen your face plastered (everywhere)?' he asked Troconis as she sat beside her attorney Andrew Bowman on June 6.

'I'll be honest with you. You're probably one of the most hated woman in America right now. And I'm not being mean. So this is like the golden ticket.

'If you know where he could have done something it could have where he frequented if you could tip us off, or if he said something in jest.'

Troconis wore a pained expression and placed her fingers on her temples while muttering something inaudible as he made the comment.

Almeida is still the nanny for the 5 Dulos children. Their current ages: Twin 17 year olds, twin 15 years olds and a 13 year old. (two sets of twins).

The Dulos' nanny is taking the stand. Lauren Almeida has told authorities about multiple altercations she witnessed between Jennifer Dulos and Fotis Dulos. She also told police she arrived at the house that morning and when she looked in the pantry she noticed only 2 paper towel rolls, it was immediately odd to her because the night before she had just stocked the pantry with 12 paper towel rolls.

NEW: Alternate juror has been DISMISSED. Apparently the juror spoke to the a member of the prosecution team, "We love you."

"We love you." Marshall testifies that he was on the elevator with two jurors. It made a stop, two prosecutors were standing there. They saw jurors were on the elevator and they turned to walk away. The marshall said, "Thank you, Liz." Then a male juror poked his head out and said "We love you."



My question would have been who is 'we'? The juror said to the prosecutor, "We love you"...does that mean jurors are talking with each other about how they love the prosecution?

The jury got some personal insight into Jennifer Dulos’ life Wednesday as a majority of testimony in Michelle Troconis’ trial came from the prosecution’s first non-law enforcement witness. Lauren Almeida, the nanny for Jennifer Dulos’ five children, returned to the stand, where she spoke about the contentious relationship between Jennifer Dulos and Fotis Dulos, along with the incidents leading up to Jennifer Dulos’ disappearance and presumed death almost five years ago.

Remember this paper towel roll shown by the state with a pinkish color? Nanny testified the holder was empty the morning Jennifer went missing and she put a new roll on. That would have been long before police were there, so nanny was the last person and only person to presumably touch that roll? No testimony that the pink is blood...at this point.

BREAKING: Another juror problem in #MichelleTroconis trial. Judge: The court received a note, unsigned. Judge then sent the jury out.


JUROR PROBLEM: Anonymous note (from a juror) sent to judge says one of the jurors spoke about the case and it's all over social media. "One of the jurors discussed something about the case. It was all over social media. Said it was like 'Gone Girl'. Several other jurors said, don't discuss this."



Judge is closing the courtroom again. This is not right. He can order no video/audio of a juror being questioned, the to seal a courtroom is extreme. But, that is what is happening right now.

TROCONIS TRIAL: If you've just tuned in, there's been no testimony today and everyone has been sent out for the courtroom so the judge and both sides can question each juror following a note that alleged one of the jurors briefly brought up the case.

The note read: "One of the jurors discussed something about the case and it was all over social media. Said it was like Gone Girl. A brief mention. Several other jurors said don't discuss this.”

The juror who sent the note is being questioned outside the presence of the media/gallery and then each juror will be brought in and individually questioned about whether they were influenced.


We are not in the courtroom so I can't speak to what that juror was talking about. Hopefully we'll get an explanation when we're allowed back in.

A sidebar from me on this: Last night, I finished the Netflix docuseries, "American Nightmare." It's been ALL over social media. The case featured in it was referred to in the media as the "Gone Girl Case.”

As soon as I heard the note said "all over social media" and "Gone Girl case," I immediately thought about "American Nightmare." Could the juror have been talking about that and other jurors misheard/misunderstand? Again, just a thought. We hope to get clarification.
