The man charged with killing his girlfriend, a federal worker, in 2009 pleaded guilty Friday and has agreed to help investigators find her body.

Jose Rodriguez-Cruz will serve 12 years in prison for the death of Pamela Butler. As a part of his plea agreement, Rodriguez-Cruz will help authorities find her body.

If he doesn't cooperate, he will once again face a first-degree murder charge.

The plea agreement that ended the mystery about what happened to Pamela Butler, who was last seen outside her Brightwood apartment in D.C. eight years ago, was contingent upon her boyfriend helping investigators find Butler’s remains. But that goal is proving elusive.

WTOP has learned D.C police detectives have been searching for Butler’s remains along a highway in northern Virginia, and recently brought Jose Rodriguez-Cruz, 52, to the location to aid in the search.

Butler’s remains still haven’t been found.

Sources say they believe Butler was buried in a shallow grave near the highway.

Police plan to search for the remains of Pamela Butler, the Washington, D.C., federal worker who disappeared before Valentine's Day 2009, in Stafford County, Virginia, Friday afternoon, sources tell News4.

Multiple law enforcement sources told News4 Rodriguez-Cruz led investigators to a spot along Interstate 95 in Stafford County last week.

Rodriguez-Cruz told police he buried Butler in the median strip between the northbound and southbound lanes of I-95.

Derrick Butler said he plans to be there when police begin searching. The news of a possible burial site is bittersweet.

"The hardest part for me was just looking at my mother and knowing that this is not what she wanted to hear," he said.
 
Pamela Butler's Remains May Be Located But Too Difficult to Recover: Brother

The brother of Pamela Butler, the Washington, D.C., federal worker who disappeared before Valentine's Day 2009, said police told him they believe they got a positive hit on where his sister's remains are buried along Interstate 95 in Virginia, but they won't try to recover them because it is too difficult.

Derrick Butler, who arrived at the location before the search started, said police believe his sister's remains likely are buried in the median of I-95. He said he is very disappointed to hear it's too difficult to recover them. He said he was told the many improvements to the express lanes and the drainage in the area over the past eight years make digging there too risky and the chance of actually finding Butler's remains is too little.

Search for murdered DC woman in Stafford Co. ends without success

In 2009, when Butler’s body was disposed of, the median along I-95 in that area was wooded. During the building of the Express Lanes, trees were cut down and rocks and dirt brought in. Derrick Butler said he was told that with time and weather, her remains have been washed away.

He said police had “given it a valiant effort,” but that he believes “we’re done” in the search. He added that he was disappointed, but he realized finding his sister’s remains would be a long shot, given the time that has elapsed.
 
This search was conducted 1/2 mile from my home. The roadway had changed dramatically in recent years. It would really had been an impossible feat. Because they are unrecoverable, any deal for the defendant should be off the table.

District police organized the gathering Saturday to help families with missing loved ones meet one-on-one with detectives and forensic experts to try to find answers.

A main feature of the event included a DNA collection station, where relatives of the missing had their mouths swabbed for samples that will be run through a national database of dead but unidentified people.
Derrick Butler, 55, and his mother, 85, attended the event Saturday, each getting their cheeks swabbed to provide DNA for law enforcement.
Butler’s sister Pamela Butler disappeared before Valentine’s Day in 2009. Police made an arrest in her killing eight years later, but her remains have not been found. The ex-boyfriend convicted of her murder said he buried her body somewhere in Virginia, but when police were able to start searching for her, they found the area had mostly been covered over by an interstate highway.

Butler said that although his sister’s case is solved, he still hopes that one day remains will be found.

“We would love to have any part of her back to say she’s resting,” Butler said.

This case was the subject of NBC’s Dateline last night. I didn’t know the bodies of both Pamela Butler and his ex-wife, Marta Haydee Rodriguez were found a mile apart.

I didn’t get to see Dateline last night. But I know they never recovered Pamela’s remains from I-95. So much change, EZ Pass lanes added, years of construction in that area, I believe that week they searched they got a “ hit” on the area she was in, but no actual recovery of her remains could be done. I live right up the road from the area in question. Very sad for her loved ones.

You’re correct. The headline to the article I attached is misleading. Pam’s remains were never found. Such a tragedy for her family all around. I do hope the authorities in his ex wife’s murder bring charges against him. If not he will be out in several years. :(

Details of Disappearance
Butler was last seen talking to her boyfriend, Jose Angel Rodriguez-Cruz, at her home in the 5800 block of 4th Street northwest in Washington D.C. at 9:48 p.m. on February 12, 2009. The following day she sent two emails, one to her employer and one to a relative. She has never been heard from again.

Butler was very concerned about personal safety and her residence has a sophisticated security system with an alarm, motion-activated floodlights and surveillance cameras positioned at all the exits. She kept the home in a very neat, clean condition.

When her brother checked the house, he found the sheets from her bed were missing, the bed's comforter was on a settee in the bedroom, some real estate files were on the floor in her home office, and blinds on one of the windows in the second floor dining room were raised. It would be uncharacteristic of Butler to leave the blinds up, as she didn't want neighbors to see into her home.

That particular window was the only one in the house that was unlocked. The door alarm was turned off, and her family says she always set it before she left home.

Authorities searched her home after her disappearance and found no evidence of foul play. She left behind her vehicles, a gray Mercedes-Benz and a gold Jaguar, but her purse, credit card, driver's license and keys disappeared with her.

Jose stated Butler broke up with him on the evening of February 13. They met through an internet dating website and had been together for five months. He said the split was amicable, but sudden, and he didn't understand why Butler wanted to the end the relationship.

The surveillance videos show him leaving the house at 11:30 p.m. on February 13. He was filmed coming in and out of Butler's house three times in the days following her disappearance. He says he was removing his belongings from the home and dropping off other items; this would be consistent with the video, which showed him carrying bags away.

The video didn't show Butler leaving the house; the last time she was filmed was on the evening of February 12, when she went out to get her mail, then came back inside.

Jose initially cooperated with the investigation and allowed the police to question him and search his home. Authorities focused on him as a possible suspect. They impounded his car and some other belongings and questioned him aggressively. He agreed to take a polygraph, but then refused and walked out just before the exam was to begin. Following that incident, he ceased cooperating, saying he felt he was being railroaded by overzealous police officers.

Jose had some prior minor run-ins with the law, but no serious criminal record and has never served time in jail. Butler's relatives, including a nephew who lived with her off and on during the relationship, said she and Jose seemed happy and got along well, with only minor arguments. They said they had no idea she was planning to break up with him.

In April 2017, Jose was charged with Butler's murder. Investigators stated they had uncovered evidence of domestic violence in his background. A photo of Jose is posted with this case summary. He was given a general discharge from the Army prior to his disappearance because of instability, and he had twice previously threatened to harm his female boss.

Jose's first wife, Marta "Haydee" Rodriguez, disappeared from Arlington, Virginia on May 26, 1989. She had accused him of domestic violence and they were estranged when she went missing.

The missing persons report was canceled in 2000 after police supposedly made contact with Haydee in Florida, but authorities subsequently learned the Florida woman they'd spoken to was in fact Jose's second wife's sister and she'd impersonated Haydee, using Haydee's date of birth and other identifying information which Jose supplied to her.

In October 2017, Jose pleaded guilty to second-degree murder in Pamela's case and was sentenced to twelve years in prison. He admitted that he beat and strangled her to death after an argument about his unemployment. He lead authorities to a place where he said he dumped her body, but the area has since been paved and investigators don't know if Butler's body is recoverable.

In June 2018, Haydee's body was identified. Her body was found along Interstate 95 in February 1991, about a mile from where Jose would later dispose of Butler's body. In October 2019, over a year after Haydee's body was identified, Jose was charged with first-degree murder and the unlawful concealment of her body.

Butler had a bachelor's degree in information technology and a master's degree in public administration from American University. Her single, brief marriage ended amicably in the 1990s. At the time of her disappearance, she was employed as a computer systems analyst with the Office of Enforcement and Compliance Assurance at the Environmental Protection Agency (EPA). She earned a six-figure salary with the EPA, and supplemented her income with real estate investments.

Butler was stressed over financial problems at the time of her disappearance; her investments had declined in value due to the bad economy. She kept in close contact with her family and had a regular routine and an orderly life, and it's uncharacteristic of her to leave without warning.

Foul play is suspected in Butler's disappearance due to the circumstances involved.

WASHINGTON (7News) — "This story has so many twists and turns to it, you just wouldn't believe it," Derrick Butler told us in an interview at his home in the Temple Hills section of Prince George's County.

He's a retired Ballou High School automotive teacher, who is featured in an HBO Documentary entitled "Black and Missing," which runs tonight and tomorrow night at 8 pm.
