"BOSTON, MASS (NEWS10) — Attorneys trying to overturn the death sentence of the convicted Boston Marathon Bomber said the jury was stacked against him.

According to a new court document, attorneys for Boston Marathon bomber Dzhokhar Tsarnaev unveiled their appeal of his death sentence, asking to reverse the sentence or his convictions and instead order a punishment of life in prison.

In total, the 2017 page appeal makes 13 points as to why Tsarnaev’s death sentence should be reversed, claiming he could not have received a fair trial because the entire Eastern Massachusets region was rocked by the April 15, 2013 twin bombings....."

Well now, isn't that special. Criminal justice system run amok. At what point in time do criminals have to face the fact that there are consequences of their actions? When the endless appeal process runs out? Meanwhile, he gets to talk to his attorneys about how society has mistreated him. Which, feeds his narcissism and criminal thinking. Instead of realizing that he is incarcerated because of his actions, the "real" enemy is the people who put him there, judge, jury...not himself.
 
I walked through a street that was cordoned off after the bombing on a regular basis. We did our grocery shopping there. We saw the roads without cars as the city ground to a halt in search of madmen. One of our daily commutes ran through the bomb site.

What he did cannot be undone, and he should never be among the general populace again. That said, the argument for state-sanctioned murder is a slippery slope at best. I don't see the practical argument for it: it's an expensive, traumatic process that exposes the victims to appeal after appeal instead of letting them get on with their lives; the perpetrator has already been incapacitated. Nor can I see the moral argument for it, because it sets a precedent used to kill 1 innocent person for every 25 murderers. And while there is some relief for some victims, there is also a study that shows better outcomes for families who did not have to deal with the ramifications of the death penalty over those who did.

It's long past time that we overturn this barbaric practice as a civilization. I hope we outlaw the death penalty sooner than later.
 
I am watching the Boston Marathon Bombing movie with Mark Wahlberg.

The family of the bombers should have been deported. They knew what was going on...

The way I read it is that Tsarnaev might still receive the death penalty based on the outcome of a new penalty-phase trial. Also the prosecutor could appeal this decision to the Supreme Court

"A three-judge panel of the 1st U.S. Circuit Court of Appeals ordered a new penalty-phase trial on whether the 27-year-old Tsarnaev should be executed for the attack that killed three people and wounded more than 260 others."

"A spokesperson for the U.S. Attorney’s office in Boston said they are currently reviewing the opinion and declined further comment at this time."

I dunno -- blaming the media coverage as the reason to overturn the accused's death penalty sentence really seemed a stretch to me. :eek:

Almost laughable if it weren't so sadly ironic. Media coverage prevented him from getting a fair trial, but media coverage and calls from a sitting Congresswoman, well, y'all know what she said, had no impact whatsoever on the fairness of Chauvin's trial? How's that work? Seems like our judicial system, blind/impartial as it's supposed to be, can't seem to do much these days but check which way the wind is blowing. AMOO

"The Justice Department has urged the US Supreme Court to reinstate Boston Marathon bomber Dzhokhar Tsarnaev's death sentence after it was overturned by an appellate court last summer.

The request was made in a 48-page brief filed on Monday and signed by at least eight members of the DOJ.

The officials argued that a lower court made the wrong decision by disregarding the jury’s recommendation in what it called 'one of the most important terrorism prosecutions in our Nation's history'.

The Supreme Court had agreed in late March to hear the DOJ's appeal first filed under the Trump administration, which carried out the executions of 13 federal inmates in its final six months in office."
