Assistant State Attorney Art Brown said Monday the state no longer would be seeking the death penalty, based on the jury’s findings on the verdict form regarding whether Nonnombre had carried and discharged a firearm.

You can clearly see from the home security video all three suspects were carrying a firearm. I don't think it should matter which one's fired their weapons, they all should receive the death penalty.

On Nov. 20, one of the jurors from McNear’s trial sent a letter to Circuit Judge Diana Moreland, making claims against her fellow jurors, and the defense is requesting permission to interview the juror.

“There is no way any black defendant could ever get a fair trial with racist evil people such as those that I had the unfortunate time sitting with,” the juror wrote to Moreland.

Defense attorney William Bennett said that McNear is black and the letter “causes concerns over the verdict required by rule, but undersigned counsel believes good cause exists to allow the interview,” in a motion to the court filed on Nov. 28.

After questions were raised over whether an African-American defendant could have received a fair trial by a Manatee County jury, Circuit Court Judge Diana Moreland held a hearing Friday morning to hear arguments on whether a juror could be interviewed by the defense but held off on making a decision.

Meanwhile, a second member of the panel that found Jimmie McNear guilty has written the court to dispute the first juror’s claims.

McNear, 21, was found guilty on Nov. 9 of second-degree murder, manslaughter and armed burglary by a 12-person jury. He is scheduled to be sentenced Jan. 3 and faces up to life in prison.

One of the jurors wrote to presiding Circuit Judge Diana Moreland, claiming racism had played a role during the deliberations, and that there was no way a black man could have gotten a fair trial by her fellow jurors.

On Wednesday that juror was questioned and the defense now has 10 days to file any follow up motions to conclude the interview process. Meanwhile, Moreland has reserved ruling on the allegations but has ordered the defense to reschedule the sentencing hearing.

McNear, 21, was found guilty by a jury on Nov. 9 of second-degree murder with a firearm in the fatal shooting of Brooks and manslaughter in the death of Deneus. The jury also found McNear guilty of armed burglary of the couple's home.

On Friday, McNear was sentenced to life in prison by Circuit Judge Diana Moreland. McNear is the third and final man found guilty in the 2015 fatal shootings to be sentenced.
