Formal Sentencing - August 24 2015

I was able to get to a lap top...please read the below post for link and information.

I am on ipad and cannot link....if someone can please do...

Go to Daily Mail, March 3, 2016....Holmes was transferred to out of state prison....secret as to location....he was beaten up. More info and picture of inmate that got through security.

Here is the update on James Holmes with a few snippets

http://www.dailymail.co.uk/news/art...location-jailhouse-beating-fellow-inmate.html

"Mass shooter James Holmes who killed 12 people in an Aurora, Colorado movie theater was moved to a secret out-of-state location after he was beaten up by a fellow inmate last fall."

The attack happened Oct 8 2015 by Inmate Mark Daniels. Inmate Daniels said "sorry I couldn't wipe him out''. It was to pay back to JH for killing and hurting all those people.

There were other concerns about JH along with the beating and that is why he was moved. Others have commented that this is called "dump jump" when a prisoner is passed on to another warden instead of ''placing the prisoner in a secure setting".

That was old news but thanks for posting. Prison probably gave him plastic surgery before transferring this devil for his protection.

James Holmes has been secretly moved again....here is snippet of what happened.....I do not like the secrecy and the innocent cannot get any answers.

'The man who murdered 12 people in an Aurora movie theater was transferred to an out-of-state prison as little as a day before he was scheduled to be deposed in a lawsuit, court documents reveal.' This is the second time this has happened.

Authorities will not say where he is. They say JH was moved for his protection and guards protection and not because he was to be deposed. (but it happened twice...Okay explain that one authority....he can give answers....there is always a way...wonder what is going on....is he really in prison or is he in a mental hospital? if that is so, the people will not be real happy with that move).

This is so infuriating, and I honestly don't understand how this is even legal. I looked up the "interstate corrections compact" which was the law they cited in the article but the information available about it is incredibly ambiguous. One study states that the majority of transferred inmates are moved to reduce the risk they pose to the facility and its staff, with the second most common reason being to protect the inmate.

So, I wonder what the REAL reason was for his transfer? It says in the article that it was for BOTH his protection and the protection of correctional officers. Was he posing a threat to prison employees? Posing a threat to himself? Acting erratically? Assaulted by another inmate? Was an employee harmed by an inmate in an attempt to get to Holmes? I just don't understand the secrecy or how it keeps anyone safe. IMO, it's not going to make a difference where he's incarcerated. Inmates will know who he is and what he's done or they'll soon find out. And if he's the one who poses a risk, moving him isn't going to change anything.

A new legal reckoning of the 2012 Aurora movie theater shooting begins Monday, one that's poised to put America's climate of mass shootings on trial.

In an Arapahoe County courtroom, 28 survivors of the attack and relatives of the victims will attempt to convince a jury that Cinemark, the movie theater's owner, should be held accountable for the shooting.

The trial will take place in the same courtroom where the gunman last year was convicted of murder and sentenced to a lifetime in prison. But, while the criminal trial focused on questions of mental health and motive, the first civil trial over the shooting will ask jurors to weigh the foreseeability of such attacks in an era where they are both statistically rare and terrifyingly routine.

CENTENNIAL — Seventy-six people shuffled into an Arapahoe County courtroom Monday, the final pool from which a jury will be drawn to decide whether movie theater owner Cinemark is liable for a mass shooting.

Lawyers for Cinemark and for victims of the 2012 shooting at the Century Aurora 16 theater spent the morning questioning potential jurors to whittle the group down to a panel of six jurors and two alternates.

(...)

Opening statements in the trial are expected Monday afternoon. The trial could last up to three weeks, but, unlike the criminal trial last year, few survivors are expected to testify.

Tuesday's opening statements kick off a scheduled three-week trial in Arapahoe County District Court, but the trial is expected to focus more on the theater's security plans than on the victims' injuries. The first witnesses scheduled to testify Tuesday are a security expert and an Aurora police officer who often worked security at the theater. More police officers, security experts and theater employees are expected to be called during the trial.

A woman who was in a movie theater down the hall from the theater where the shooting took place and who is representing herself in a lawsuit against Cinemark also offered an opening statement Tuesday. Her lawsuit was consolidated into the other survivors' suit.

The jury in the #TheaterShooting civil trial has found in favor of Cinemark.

A group of the shooting victims and their families argued the nation’s third-largest movie theater chain should have done more to prevent the July 2012 attack. They sued Cinemark, saying it should have foreseen the risk for violence during the packed premiere of Batman movie “The Dark Knight Rises.”

The jury decided after three hours of deliberations that there was nothing the company could have done — even having additional security precautions in place — that might have thwarted the attack that left 12 dead and more than 50 others wounded.

Thank you for this info. I believe it should be public information where he's located like other inmates. They obviously gave him a pseudo name to protect his identity because you can't find him as an inmate anywhere. This is not fair to the victims and family.

A state committee deadlocked Friday over whether victims of the Aurora theater shooting have a right to know where the gunman is locked up.

After two hours of debate, the members of the Department of Public Safety’s Victims Rights Act Subcommittee split 3-3 over whether the Colorado Department of Corrections is breaking the law by
refusing to tell theater shooting victims the gunman’s location. The tie vote means DOC officials — at least for the time being — don’t have to say any more about where James Holmes is other than what they have already said: That he was moved to an out-of-state prison earlier this year to protect his and correctional officers’ safety.

Above link is from Newsweek stating that the State of Colorado refuses to let the victims and their families know where James Holmes has been transferred to.

They probably won't say because they moved him to RJ Donovan prison is San Diego near his parents I believe it high security and has a mental section and know that would upset and enrage the victims and families because that was the one request they asked the judge prior to sentencing that he would not be in CA near his family. JMO.

Several victims of the Aurora theater shooting who lost a lawsuit against movie theater owner Cinemark say the company is trying to overcharge them for legal costs.

In Colorado, the side that wins a civil lawsuit is entitled to recover its legal expenses — including filing and witness fees and other costs but not usually attorneys’ fees. After a jury
earlier this year in Arapahoe County District Court ruled against the victims and found that Cinemark was not liable for the 2012 shooting at the Century Aurora 16 theater, Cinemark asked that the plaintiffs pay nearly $700,000 in costs.

But, in an objection filed last week, the victims argue that’s an unfair amount.

In the undisclosed location where he now lives, the Aurora theater gunman sits in a prison cell for 23 hours a day, receives no forwarded mail, has no access to the internet and is given no exercise equipment, according to answers the Colorado Department of Corrections has provided to the prosecutors who put the killer away.

After James Holmes was moved to an out-of-state prison — state officials say they are barred by the transfer agreement from saying where — prosecutors at the Arapahoe County District Attorney’s office sent corrections officials a list of questions to better understand his living conditions. Victims of the Aurora theater shooting, in which 12 people were killed and 70 wounded, say they should be able to know where the gunman is. Absent that, they and prosecutors were concerned that the gunman may have been receiving special treatment in his new state.

Aurora theater shooting victims won’t have to pay $700,000 in legal costs after Cinemark drops request
Filing resolves state-court lawsuit against owner of Century Aurora 16 theater

Cinemark, the company that owns the Aurora movie theater where 12 people were murdered and 70 people were wounded four years ago, has dropped a request for victims of the shooting to pay nearly $700,000 in legal costs after an unsuccessful lawsuit.

The move — along with several others this month — means that all the civil lawsuits against Cinemark as a result of the shooting are close to being resolved.

In a filing in state court Tuesday, Cinemark’s lawyers wrote that the company’s goal “has always been to resolve this matter fully and completely without an award of costs of any kind to any party.”

Aurora theater shooter relocated to high-security federal prison in Pennsylvania

September 28, 2017

Late Wednesday, the federal Bureau of Prisons had not announced where Holmes was transferred. Early Thursday morning, Holmes’ location was updated to USP Allenwood, a high-security federal prison in Pennsylvania, according to the Federal Bureau of Prisons inmate tracker.
