GA - Ex-POTUS Donald Trump and others indicted, 13 counts in 2020 election interference, violation of RICO Act, Aug 2023 *4 guilty* #4

“I’m not embarrassed by anything I’ve done,” Willis said. “I guess my greatest crime is that I had a relationship with a man, but that’s not something I find embarrassing in any way.”

ETA: The train is still coming for Trump.

Sounds as if Jeffrey Clark's disciplinary hearing is happening now.

"What Mr. Clark was attempting to do was essentially a coup at the Department of Justice," Hamilton "Phil" Fox, the District of Columbia Bar disciplinary counsel said in his opening argument.

Clark sought to send a letter to Georgia officials in December 2020 falsely claiming that the Justice Department had "identified significant concerns" that may have led to Trump's loss in that state, according to ethics charges filed in 2022.

Justice Department leaders found no evidence of widespread voter fraud and refused to send Clark's proposed letter.

3/2/24 Update: Next Fulton County Board of Ethics meeting on ethics complaints against DA Willis regarding her relationship with special prosecutor Nathan Wade on 3/7/24 @ 10am.
3/7/24 Update: The Fulton County Board of Ethics was expected to hear two complaints against Willis after her romance with a special prosecutor on the election interference case involving Trump raised concerns of a conflict of interest. The Ethics board determined it does not have jurisdiction over Willis, who is a state constitutional officer in her role, The Atlanta Journal-Constitution reported. The Hill requested comment from the Board of Ethics’ secretary & the clerk to the Fulton County Board of Commissioners. McAfee said at last Friday’s [3/1/24] hearing that he plans to make a decision by the end of next week on whether Willis & special prosecutor Nathan Wade will be allowed to remain on the Georgia case.
3/13/24 Update: Order on Defendants’ Special Demurrers – Fulton County Superior Court Judge Scott McAfee wrote Wednesday in an order that six of the charges in the indictment must be quashed, including three against Trump. But the order leave intact many other charges in the indictment & the Judge wrote that prosecutors could seek a new indictment on the charges he dismissed. The six charges in question have to do with soliciting elected officials to violate their oaths of office. That includes two charges related to the phone call Trump made to Georgia Secretary of State Brad Raffensperger, a fellow Republican, on Jan. 2, 2021.
The six counts are as follows:
• Count Two alleges that multiple Defendants solicited elected members of the Georgia Senate to violate their oaths of office on December 3, 2020, by requesting or importuning them to unlawfully appoint presidential electors;
• Count Five alleges that Defendant Trump solicited the Speaker of the Georgia House of Representatives to violate his oath of office on December 7, 2020, by requesting or importuning him to call a special session to unlawfully appoint presidential electors;
• Count Six alleges that Defendants Smith & Giuliani solicited members of the Georgia House of Representatives to violate their oaths of office on December 10, 2020, by requesting or importuning them to unlawfully appoint presidential electors;
• Count 23 alleges that multiple Defendants (Guiliani, Lee, Smith & Cheesey) solicited elected members of the Georgia Senate to violate their oaths of office on December 30, 2020, by requesting or importuning them to unlawfully appoint presidential electors;
• Count 28 alleges that Defendants Trump & Meadows solicited the Georgia Secretary of State to violate his oath of office on January 2, 2021, by requesting or importuning him to unlawfully influence the certified election returns; and
• Count 38 alleges that Defendant Trump solicited the Georgia Secretary of State to violate his oath of office on September 17, 2021, by requesting or importuning him to unlawfully decertify the election. Judge McAfee let most of the charges stand & wrote that the Fulton county DA Fani Willis can seek reindictment on these specific charges from the grand jury while extending the statute of limitations on the charges for six months. McAfee’s order leaves Meadows facing only a RICO charge.

3/14/24 Update: McAfee is also expected to deliver a decision this week on the effort to have Willis removed from the case. The judge heard three days of testimony related to the allegations, including testimony from Willis & Wade.
3/15/24 Update: Judge Scott McAfee has ruled that Fulton County DA Fani Willis **WILL NOT** be disqualified from prosecuting the racketeering case against Trump — but because of the appearance of impropriety she or the special prosecutor she had a relationship with must step down from the case.
3/15/24 Update: Either Fani Willis goes or Nathan Wade does – that was the ruling from Fulton County Superior Court Scott McAfee on Friday in the Georgia election interference case. Fulton County District Attorney’s Office has accepted special prosecutor Nathan Wade’s resignation from the election interference case.
3/18/24 Update: Defendants’ Joint Motion for a Certificate of Immediate Review filed 3/18/24. Trump & seven of his co-defendants (Guiliani, Meadows, Cheeley, Roman, Shafer, Floyd & Latham) are seeking an immediate appeal of last week’s ruling that allowed Fulton County District Attorney Fani Willis to remain on the sprawling racketeering case. To appeal the matter immediately – before trial – defendants must obtain Fulton County Superior Court Judge Scott McAfee’s permission. If he approves the request, the Georgia Court of Appeals would decide whether to take up the matter.
3/20/24 Update: Judge Scott McAfee on Wednesday ruled that the defendants can appeal the decision last week to allow the prosecutor Fani Willis to remain on the case despite a past romantic relationship with her deputy. His order means that Georgia’s court of appeals now has 45 days to consider the appeal (5/4/24) – another delay. If the court agrees to overrule McAfee & force Willis off the case, it could be stalled indefinitely.
3/26/24 Update: Jeffrey Clark's [a former senior official in the U.S. Justice Dept.] disciplinary hearing, Day 1. Clark is facing a disciplinary hearing which could see him lose his license to practice law. Trump tried to put Clark in charge of the Justice Dept. in his administration's final days as Clark sought to pursue the former president's false claims of widespread voter fraud. Clark, who served as acting head of the Justice Dept's civil division under Trump, faces a multi-day hearing on ethics charges that accuse him of attempting to take actions "involving dishonesty" & that "would seriously interfere with the administration of justice." "What Mr. Justice Dept. leaders found no evidence of widespread voter fraud & refused to send Clark's proposed letter. Harry MacDougald, a lawyer representing Clark, denied that Clark had violated attorney ethics rules. He said Clark was engaged in "internal debate and disagreement" within the department about the impact of voter fraud on the election. The D.C. Office of Disciplinary Counsel, which investigates lawyers accused of violating legal ethics rules, brought the case against Clark. Two of Clark's Justice Dept. superiors - former acting Attorney General Jeffrey Rosen & former acting Deputy Attorney General Richard Donoghue, have cooperated with the ethics probe & are expected to testify during the hearing. Republican congressman Matt Gaetz, an outspoken Trump ally & former Trump White House Chief of Staff Mark Meadows may testify on Clark's behalf, his lawyers said.
3/27/24 Update: Trump & Shafer: Hearing on 3/28/24 at 10am on (1) Trump post-hearing brief in support of his adopted demurrers & motions raising First Amendment as-applied challenges, and (2) David Shafer (a) general special demurrer to the indictment, and (b) general demurrer & motion to strike legal conclusions.

@vls12345 & @Chelly- since I can not access ANY of the articles that you all posted - was there a next hearing date in any of them? TIA!

All I have is 6/21/24 as a final pretrial hearing - and the Fulton County court site is still down due to the hackers...

No, no dates listed in either article.

The gist of the articles...

From the article on 11alive:
The judge overseeing the Georgia 2020 election RICO case has denied former President Donald Trump's motion to dismiss the case on First Amendment grounds.

In his order, the judge also denied similar First Amendment challenges raised by other co-defendants in the case.

[snip]

The order issued Thursday by Judge Scott McAfee ruled that constitutional First Amendment protections "do not reach the actions and statements alleged by the State."

Citing precedent, Judge McAfee wrote that "although the First Amendment is 'a broad umbrella that shelters all political points of view and shields a wide range of avenues for expression,' free speech -- including political speech -- is not without restriction."

"Even core political speech addressing matters of public concern is not impenetrable from prosecution if allegedly used to further criminal activity," the judge continued.

However, Judge McAfee left open the possibility for future challenges "at the appropriate time after the establishment of a factual record."

And from the Channel 2 article:
Fulton County Superior Court Judge Scott McAfee ruled Thursday that statements made by Trump and 14 others charged in the indictment handed down last year were made “in the furtherance of criminal activity” and not protected by the First Amendment.

“After considering the extensive briefing, the argument of counsel, and the indictment, the Court finds these vital constitutional protections do not reach the actions and statements alleged by the State,” McAfee wrote in his order. “Nor do the statutes themselves facially violate the First Amendment. The Defendants’ motions are therefore denied.”

That pretrial hearing in June doesn't seem likely to happen due to appeals.
From CBS News:
"The former president and the seven co-defendants asked the Georgia Court of Appeals last week to review McAfee's decision not to disqualify Willis and her office. The court has 45 days to decide whether to hear the appeal."

Yes, I figured it would not be... Still can not access the Fulton County court site-so can not get the latest motions & hearings coming up. I do go to that "Master Calendar" but they have not updated their site since 3/26/24.
