DLR talks to jury and thanks them for their attention and service. How do you arrive at a verdict. Use the witnesses, evidence, on the law, judge will provide you a copy of it, and your God given common sense. When you do those three things, I would believe you will come back with a verdict of 2nd degree murder.

When you look at that man, can you believe this was just a mistake, an argument that got out of hand? Of the 2 of them, who was the one with a gun?

Timeline will be given to you, shows the call between Rachel and TM, and you also have GZs call, and Lauer's call and we were able to time when these calls were made and the shot was heard. You can put this together and tell what happened.

Rachel was here a day and a half, I'll admit she is not very sophiscated but didn't she tell you the best she could what she heard. She was the person who was speaking to the victim. Was she speaking the truth? She could have embellished or lied, TM, she told the truth about what TM called GZ, cracker, her use of colorful language is less credible just because she is different. The defense wanted you to now believe her. You decide whether she was telling the truth. Their witnesses were more sophisticated but her words match up with the records of the calls and with the evidence. Isn't it evident that GZ assumed that TM was a criminal? I agree Rachel is colorful but on the content of her testimony, I submit what she said is the truth.

She did lie to the mother of TM because she didn't want to see the body, lied about her age because she didn't want to testify.

The NEN call, GZs comment under his breathe about TM, not made to describe TM, shows frustration, ill will, hatred, assuming someone is a criminal and a punk and was not going to let him get away. He admitted in call he was following, played audio.

I'm going to show you in the car on the walk through, GZ makes reference to a st. name and later said he did not know the name of the st. He said this to justify why he was profiling, following, tracking this young man.

Look at the testimony of Ms. Lauer, the confrontation did not begin at the T, but further down and she first thought the bigger man was on top.

To believe what defendant says, TM was just walking minding his own business, and for no reason attacked GZ, nothing was done by GZ to bring this on, then at the last moment he picked up the gun and ended it. Good is the only eye witness. He saw the victim on top of GZ but did not actually see blows, did not see the defendent's hands. Was GZ trying to get his gun out and TM was trying to stop him. GZ claims TM was trying to get the gun, there was no DNA of TM on the gun. GZ didn't say that until the next morning that TM grabbed the gun. One witness said she heard one of them say 'no', close to what Rachel heard, get off.

What the photos show is the victim a good ways from the T where the fight started, and TM must have picked him up and carried him there. But why did the fight occur? The defendant wasn't following him, was walking back to his car, trying to find out the address. Who was chasing who? who had the right to self defense here? Why isn't GZs jacket all torn up, at least scratched? If he was picked up and hit over and over. Where is the blood on his front and the sidewalk? How come there is no blood on TMs hands? showing pictures now of GZ wounds and TM and location.

Judge calls a 15 min. break...Bill S. says he thinks this is not a good closing...he says the state should be telling the jurors what to believe, but is instead of asking questions. The state should not have showed the videos of GZ statements and made him testify, then crucified him with all of his inconsistencies.

Bill...I feel like I've fallen through the looking glass.

He does agree Rachel was the best witness for the state...should tell the jury what the witness said and why she should be believed. DLR is using emotion more than using facts.

Bill, I have argue as a prosecutor and defense attorney and this is not the way it should be done. Reporter points out DLR is only half through today and also has rebuttal yet. He may be able to salvage it later.

DLR asking if GZ was so scared of TM why did he get out of his car and follow him?

DLR playing another interview by GZ about TM going for his gun, so he took it out and shot him. He says TM supposedly had one hand banging GZs head and one over his nose, so it must be that third hand TM used to grab the gun.
The gun was in GZ waist toward his back, so how did the victim see this gun.

GZ said he didn't realize he shot TM and pulled his hands out to cuff him. Trying to make the police believe he didn't mean to shot him. GZ trying to justify to the LE why he did what he did, that he was doing his job as a NW, and TM was trying to get away, this time GZ says when I walked back towards him, TM, then when he went to make a call again, he has to explain why this kid has the upper hand.

GZ is the one with the car, 2 flashlights, a gun and is following TM but he is saying the victim has the upper hand on him. Blaming the victim, caused him to be suspicious of a 17 year old boy....who was following who?

Defendant says victim was just hitting on him on the sidewalk...shows the jacket, where is all the scratches and tears on the jacket from the sidewalk, why is the victim not more injured, if TM is hitting on him, why is he not defending himself? He's making up one lie after the other.
