West begins asking about GZs injuries and what injuries his head being hit on concrete would cause. Concrete doesn't yield. May cause mild concussion, stunning to the brain, may not be a significant disability to the brain but depends how susceptible the person is to the injury and how hard you are hit, at a minimum you are stunned. When you have lacerations there is trauma.

Asks has dr. seen pictures of GZs 2 lacerations on the back of the head...yes, shows pictures..looking for pictures...can't find the one he wants...asks do you see 2 separate areas of swelling? yes....it's not that easy to get lacerations when they bang their head...caused by direct perpendicular impact, also if hit at an angle and the head slides....

Di Maio: "Stunning goes to concussion to getting worse...The thing is when you have lacerations there's been some trauma."

West finds his pictures..Dr. says he sees swelling, a little valley and then more swelling and the laceration. Is it a significant injury? It varies for different children. Has seen children with no marks but have skull fracture. The presence of the injury on outside, does not mean there is not more injury inside. Dr. more or less agrees, can get injury without marks.

TMs hands were not cut open to see if there were internal bruises..

Dr. seems to get a little confused with DLR questions...with GZ injuries, parametics are there to treat people, not diagnosing...would have been better if he had gone to ER..was hard to tell from pictures the size of lacerations due to blood on them.

DLR throught...West up for redirect...asking dr. about his notes and the photos used to make his evaluation...to determine if what GZ said was consistent with the physical evidence. Was it necessary to interview each witness? no, he's not going to base anything on a witness because they are wrong all the time...

West is describing what various witnesses said and wants to ask if dr. ....something..judge says it is up to the jury to decide if they believe what a witness says...he's leading...he asks again of dr. if an eye witness no matter how well meaning can be wrong..yes...

West goes to what John Good said...objection, sustained...tells what he said, position of TM straddling and striking at time of shot, feasible/possible, but dr. said he would not have used that in his opinion, he has to use physical evidence...

West asks about 2 lacerations on back of GZs head, 2 blows, yes...was consistent with GZs head, objections, leading, rephrase....says he is trying to figure out a way to ask about tree branches...dr. said he saw none when he looked at pictures...the cement is more possible to him...

West asking about GZ being able to walk and talk, doesn't mean he does not have a concussion...objection, leading, rephrase....does consequent of concussion show up later, no, would be there to begin with, the reason sports like to have drs. right there...does it hurt when you get a punch in the nose or head hit on concrete? of course...would the person know it was life-threatening? no they feel they are OK, that's the reason the LE should have taken GZ to ER, if he had died at the station they could be sued....

West of absence of finding blood does not mean it was present...3 hours after his death that TMs body was transported.....dr. says also depends on how wrapped, agrees can depend on how hands were handled or weather, rain...that is why the forensic pathologist should follow the body and clothing all the way, monitor what assistants are doing...another question causes as sidebar....

Did he discuss with LE before playing tapes for family. Chief Lee was informed of it. Purpose was to let the family hear the tapes before they were released to public..

Meeting was not recorded. He was in and out of room and does not recall if mayor was there the entire time. It was not city attorneys but family attorneys who were present.

DLR....bottom line..you thought this was the decent thing to do for the family...yes, that's what they thought...

Bill S....one could conclude that the police chief was excluded and all of the family being together was not good for state's determination...could have been listener bias with the parents present. Bonaparte was shooting daggers at OM and not much better with state...he did not want to testify...

Dr. was good witness for defense, but state can point out he is a hired opinion and has worked on other cases where people found guilty...they have witnesses who conflict what he says...but defense is looking not to prove their case but to bring out conflicts with the state case for reasonable doubt...

When she came up to crime scene saw people standing on the sidewalks. She looked for GZ because she saw his truck, asked another neighbor, judge stops, hearsay, sustained objection of state.

OM had a conversation with someone? yes, asked her about George. After I didn't see GZ, she was walking away, and LE asked her if she knew people involved, she told him she was not here when something happened. He asked her to look at pictures to ID people. Showed her an iphone with 2 pictures.
Was anyone else present? some other neighbors, married but she did not know names. Was there a picture where GZ had a bloody nose? yes
How long did it take her to recognize him? not long, just had the blood on his nose..next question, objection, hearsay...

Did not know the other person's name, but knows now it was Trayvon.

Was she there when other people gave their statements to LE...yes, their written statements, not verbal..how many females, males....

She herself gave her name and phone# but no statement that night.

Yes, FBI person left note on her door to call them, he came to here house and she gave a statement about what they asked. Did she ever listen to the tape with voices screaming in the background? first heard it when played on ?, how many times have heard it, 2 or 3...did she recognize voice screaming, she thinks it was GZ...

The admissibility hearing on defense expert's computer animation continues now.

Court is back in session.

Mantei asking him about how many times he has used the animation in court testimony, 2, including this one. The other one was Greenburg case, an ex police officer, shot someone in a vehicle, he determined the position of each person, not a victim where you are trying to describe an ongoing struggle. Wants to concentrate on cases where this type of case will have been accepted in court. This is only one...

He previously said he had always had to go thru an evidence hearing before being qualified. He is actually the only person doing this type of work. He does not have a degree in this, has taken ongoing training....

When he was at scene he directed the players in their actions...one the size of GZ and one approximately the size of TM, was 5'11'', weight is not relevant, similar stature to GZ and TM...how long were their arms, not measured...got into poses as he directed..

How does it work? 16 somethings go into the software and blah, gooblygok to me....the program does what it does, there is a green light! to tell whether the telleramaters are working right!!!

He used witnesses but changed the scenario according to what GZ told him, to be more accurate...has been changed twice...

Mantei wants to know how he figured out where to place the witness..he said not just based on one of the 911 calls but also during consultation with the attorneys...He used John Good's call and can tell where this other person was...if you back track from the gunshot you can tell when he went out and when he went inside...Good's estimation used.

IOW...garbage in, garbage out...IMO

Mantei...nothing in that animation is according to witness and evidence. Which witness and which evidence came out in court? He says also consultation with the attorneys. Good was gone from outside before Lauer's call and the gunshot...but the animation purports to show what happened, so it is trying to be more accurate than we know it can be.

Witness says Good's estimation is based on when the gunshot occurred.

Mantei: you are not pretending it is an accurate animation but basing it on witness estimation, who you've never heard in testimony? correct.

Mantei...you put the figures in certain positions? Yes, still figures are based on Good's testimony and consultation with attorneys..

How did you place where the shell casing, flashlight, etc.? based on where witnesses placed evidence...proximity of shell casing can't be that far to where TM was located. There are a lot of variables that involved...Mantei: we know where the casing was found but we don't know where it came from. Witness, based on their last positions, after GZ shot TM and where they ended up, correct.

Judge says it would be helpful to her to see the animation and let him explain how he determined the postitions. Now they seem to be looking for a certain picture, Mantei looking also.

From overhead, Mantei asks the placement of the yellow circles are estimates of where the casing, etc. were...positioning relative to the victim.

Can you tell me what this is an estimation of? It's not an estimation, it's from Dr. di Maio...how far did he say TM head was off the ground? you can't say exactly because it is an estimation.

Judge asks to see animation as cross examination continues.

Is the any reason you only used the video walk through of GZ to place things? I also used other witnesses, Lauer said where the confrontation begin. What other validations studies on the motion capture suit? How accurate is it? to a hundredth of an inch..what did you set it for? just what was relevant to what he needed..

How did he tell the posers to move? according to what the witness said, police report, evidence on the scene, he was directing. The swing and the motion after the swing, it was as the actor decided to do it. Mantei, you can't tell me for sure that is how TM and GZ acted that day. It's just a presentation of one person striking another with their height and position.

My presentation is based on discovery, created based on evidence and in consultation with the attorneys...Mantei all the actual action out there is based on his interpretation of evidence funneled through the attorneys? yes

If I came to you with a new piece of evidence, would you go back and adjust the animation. yes, the whole purpose is to get it as accurate as possible.

Have I given you updated evidence to adjust the program? it's not a change but an adjustment...in consultation with me and West, you would do this?

Have you ever waited until the middle of a trial to start working on it? no, likes to do it as soon as possible. Do you incooperate new information into the animation. He tries to make sure there is no conflicting info.

What extent did GZ help in starting the animation? GZ stating he was struck and where, positioning where the conflict started, along with Lauer's statement? yes

Any other information you used in positioning the people? GZs flashlight and location of other witnesses.

If you have the location of the shell casing does that help? yes, but with any estimation method there will be variables.

Judge has a question, Mr. Good also made a 911 call, did you compare his statement that he heard the shot as he was making his call...did you use that info. in making this timeline for the animation, compared with Lauer's time? Did you use his 911 connection in doing the estimation? no

OM...backtracking, if you had the time of that phone call, could that help you recalibrate the timeline? yes, OM...I can give you that time...It would require simply moving the timing of Lauer's call. Witness...it would also affect Good's time that he went back into the condo.

Judge...my notes is that the only time Good gave was he heard the shot when he was watching TV, it was 8-10 seconds, after he was dialing...problem she is having related to that is how the timeline is coming from Good based on when he said he went out, between 7:05 and 7:15, she is reciting his entire testimony, but he never gives another time, when does the 8-10 seconds begin? He was waiting for the 911 call to connect.

Mantei says it's still an estimation. She says that it doesn't have to be exact, but since the timeline is based on Good's statement, if it overlays with Lauer's call, it should be as close to exact as possible. OM wants to do something to get the info tomorrow. Judge, we are having this hearing now and I need to make a decision and I don't want to extend this much longer.
