Agreed. It was already taken as part of a previous proceeding. Even if they weren’t the judge would weigh up the magnitude of the evidence against CB’s human rights. Very unlikely it would be the latter. I have confidence that like us, the judges want all the facts & evidence to be heard. IMO Fulscher may try another technicality. Worst case it’ll delay the evidence being shown but ultimately won’t stop it
My opinion
Prior to it even being decided to charge CB with the rape of HB the argument was being made regarding whether or not CB had the birthmark on his thigh as described.
The cite below is dated 2022. Is the argument really still taking place in 2024?
Even if CB's "rights" must be protected likewise so must HB's. She introduced the evidence re. the alleged blemish and is entitled to have her evidence investigated. If that cannot be done photographically the prosecution would be entitled surely, to call evidence relating to CB's journey to Germany etc;
Anyway the intriguing issue is why he thought it pertinent to alter his appearance on two occasions following positive identification features being formally entered into official police files. As well as the omission which allowed him to drop off the police radar when other petty criminals were named in the files.

This only shows that the tabloid reporting is ordinary. Bild, with quotes from FF, is pushing the angle that there is no mark. I am honestly very doubtful that CB would have spent cash on birthmark removal surgery before there was any likelihood it would incriminate him - he has been in prison since 2018, well before he knew HaB’s statement.
Believe what you will but I am very sceptical of The Sun’s report.
Given that a judge was the person who ordered the body scan whilst CB was in custody for previous sexual offences IMO those offences related to the images found at his apartment 2014, which included the filmed abuse of Anja K's daughter in the park. It's unlikely that CB's face was on the video showing his own actions but his thigh and the mark on it may well have been visible, hence the need for a body scan.
Whilst removal of the mark sometime between 2014 & 2018 could not prevent it being used against him for any previous crimes, this identifiable feature wouldn't pose such a problem in any subsequent crimes of a similar nature.

The sun article said the defence had asked some witnesses about the alleged mark in court, as usual it wasn't followed up with reporting if it was affirmed or not seen.

I think it’s almost certainly in the original 2004 statement. As there is no forensic evidence, such a distinguishing mark is key in identifying the offender. FF knows this which is why he was so keen to say that CB had no such mark.
Han may have mentioned it publicly in 2015 but IIRC, this was only in Irish media. CB would not be aware of this so it’s unlikely he would have had surgery to remove the mark. MO.

The photos and videos in this article are the ones that convicted him of the abuse against AK’s daughter.
Therefore, I think you are suggesting that he had the removal surgery so that he could commit and film more sex crimes without being identified in the future.
Why not just cover the mark or edit it out of the videos?

It may be that HaB’s statement says right thigh. This may be why FF was so confident in saying CB had no such mark. Whether he had a mark which may or may not have been removed from his left thigh doesn’t matter because this is not what the evidence from HaB says.
It is of course possible that HaB made a mistake.

(then 72) in her house in Praia da Luz. For this, the District Court of Braunschweig sentenced him to seven years in prison in 2019.
In addition to the Irish woman's statement, there is another incriminating detail in the Process: According to BILD information, Brückner knew the house where the crime happened!
This is proven by police statements by two witnesses from Finland. They lived in the "Condomínio Clube Praia da Rocha III" where Hazel B. was raped. A few months before the act, the holidaymakers met Brückner, he visited her in her apartment in Praia da Rocha.
According to BILD information, there is even a photo showing the accused on the balcony of the apartment.
Several witnesses have so far unanimously testified that Brückner had his livelihood in Portugal mainly denied by burglaries in holiday apartments. His ex-complice Michael T. even stated that Brückner didn't care whether residents slept in the apartments when he entered there.

If there is a photograph of CB on the balcony at "Condomínio Clube Praia da Rocha III" where HB was raped it proves his familiarity with the building and perhaps the occupants.
HB felt there had been times someone had been in her room.
Remarkable that CB was familiar with rape crime scenes at quite a distance removed from each other.
My thoughts are with HB as she relives her ordeal in court tomorrow.
