One man dismissed from Spierer wrongful death lawsuit

They've never received the answers they were looking for in the search for their daughter. But the parents of missing Indiana University student Lauren Spierer hope to have better luck in a federal courtroom.

On Monday, a federal judge heard arguments on a motion to dismiss the lawsuit filed by the parents of Lauren Spierer. The lawsuit was filed in May against three men who were with her the night she disappeared in June of 2011.

A federal judge Monday threw out a negligence lawsuit against one of three men who were with missing Indiana University student Lauren Spierer the night she disappeared.

Federal Judge Tanya Walton Pratt dismissed the lawsuit against Michael Beth that had been filed this June by Spierer’s parents. Robert and Charlene Spierer of Greenburgh, N.Y., alleged that Beth, Jason “Jay” Rosenbaum and Corey Rossman owed Spierer a “duty of care” the night she went missing in 2011. The parents are hoping to force them to share more information about her disappearance.

It's been two and a half years since Indiana University student Lauren Spierer disappeared. Late Monday afternoon, a federal judge threw out one of three civil suits filed against three of her fellow classmates.

Lawyers had 30 minutes each to argue their case. The Spierer's civil suit claimed that the three fellow IU students gave their daughter alcohol, then failed to make sure she made it back safely to her apartment.

Judge denies Lauren Spierer's parent's request to seal information

A federal judge has denied a request by the parents of missing Indiana University student Lauren Spierer to keep private some evidence in their lawsuit against two men who were with their daughter before she disappeared.

In an order filed Wednesday, U.S. Magistrate Judge Tim Baker said the Spierers' request is too broad and vague as to the information they want sealed and fails to describe what qualifies as confidential.

Baker's decision is the latest development in the lawsuit that Robert and Mary Charlene Spierer filed against Jason Rosenbaum and Corey Rossman. It claims the two gave her alcohol despite knowing she was intoxicated and owed her a "duty of care."

Family wants drones used in Lauren Spierer search

A high-tech tool was to be brought in to help search for a missing college student, until officials shot down the idea, surprising her family.

Years after Lauren Spierer was last seen, her parents are taking action. They're furious the drone wasn't allowed to be used, saying that prevented a more effective search.

John Holliday pulls into the lot and climbs out of his pickup. It's a Friday only a couple of weeks ago, and he's out on the trail once more.

This time it's a small patch of scrub just north of Bloomington, along West Acuff Road and Ind. 37.

He walks across Acuff toward the stretch of private property that's covered with tall grass, briar patches and weeds seeping with spittlebug froth. He offers warnings about three things — ticks, sunburn and deep holes hidden by the overgrowth. He deftly jumps a creek to inspect an old well. A camera is strapped around his neck; he’s dressed in green and camouflage. The red laces to his sneakers come untied and remain so for the next hour.

A federal judge has dismissed a lawsuit filed by the parents of missing Indiana University student Lauren Spierer.

Judge Tanya Walton Pratt of the U.S. District Court of the Southern District of Indiana issued the decision Tuesday. It comes one year after Spierer’s parents filed the lawsuit, which accuses Rossman and Rosenbaum of giving Spierer alcohol even though she was already intoxicated. Spierer’s parents claim the men—who were among the last people to see her—failed in their “duty of care” to their daughter.

Charlene Spierer told FOX59 News a federal judge’s decision to dismiss her family’s lawsuit against two former IU students won’t stop the search for her daughter.

“Everyone still misses Lauren and we still want answers and more than anything we want to bring Lauren home,” said the missing coed’s mother.

You are right about some of this as there are elements of possible government conspiracy, ghosts, psychics, robbery, UFO's, seances, unexplained deaths of anyone we gave Don's things to,and many other things. Stonewalling, refusals of government officials to search and cooperate with my mother or I, and missing records, the list goes on and on. We were 25 years ahead of Ghost Hunters and Ghost Adventures etc., I always hesitated, or just never told anyone about a lot of this, but with proof now of "something" being there as seen on these programs ( whatever the heck it is I have no idea), I guess all of this won't sound as crazy as it would had 30 years ago, who would believe what I saw and experienced. This wasn't a large part at all, because Don had done years of research before we ever had the seance, planning his book on the Lincoln assassination and really the seance was mostly my fault, I thought it would be a kick just to see what would happen. It was also my fault that we ever went to the Surratt house in Clinton Maryland. I'm sorry I ever suggested it. The UFO thing was only suggested by a UFO group who were camped out the night my brother went missing very close to his vehicle, they were researching some cattle mutilations. They called me a couple years later telling me things, I dismissed them as a little off the wall and forgot about it until Dr. Angel told me his findings. Also a little weird, not too long before Don left on his trip, he gave me a book on the universe, he turned to a page that said The Pleiades, and said, "I don't know why, but I feel this may be of some importance, or interest". I put the book on my book shelf and forgot about it. The UFO group said they felt whatever the heck they were looking for came from a place called "The Pleiades". I'm just telling the story exactly it it happened, just the facts that really happened. People can believe of disbelieve what I say, it's of no importance to me. I never mentioned the Pleiades thing before, it was just too weird, and I don't know what all of this means. I never said UFO stuff, it was a group that were staying out there at the time who contacted me. It's hard enough to swallow paranormal stuff, but then they threw this in and it was all too much. It's an unbelievable story, and may all have been a vast coincidence from beginning to end, but I know what I lived through and experienced, and it's all the truth.
