Dec. 22 ruling expected on appeal of conviction in 1993 murder

A LaPorte man serving time for a 1993 murder got another hearing on the appeal of his conviction Monday, with a key witness reversing himself, now saying he was offered a deal for his testimony.

Jason Tibbs, 40, is asking for a new trial on allegations a deal or, at least an offer, was not revealed to the jury as required before his trial.

It’s not illegal to strike deals with key witnesses, but such agreements or offers as part of due process must be disclosed prior to trial so a jury can decide how much weight to give to the testimony of such a witness, said King.

‘‘It’s important for the jury in a criminal case to know about any potential bias or any motive a person may have for testifying,’’ said King.

T. Edward Page, a special judge appointed to hear the appeal, has scheduled a hearing for Dec. 22 to announce his ruling on Tibbs’ request for a new trial.

A LaPorte man convicted in 2014 of murdering a 16-year-old girl more than 20 years ago, plans to continue his appeal to the Indiana Supreme Court after being shot down this month by the state's appellate court.

On Sept. 8, the Indiana Court of Appeals ruled against a request for a new trial by Jason Tibbs, who was convicted for the 1993 murder of Rayna Rison. He's serving a 40-year prison sentence.

Preparations for appealing the decision to the Indiana Supreme Court are currently being made, according to his attorney, Scott King of Merrillville.

The state Supreme Court would have to decide whether or not to consider Tibbs' appeal.

The Indiana Supreme Court will not consider an appeal from the LaPorte man serving 40 years in prison for the 1993 murder of 16-year-old Rayna Rison.

The decision not to hear it all but assures that Tibbs, 41, will remain in prison until at least 2033, when he'll potentially be eligible for release due to time off for good behavior.
 
Although I think they got the right guy, eventually. I sure have a problem with the older sister remaining married to a man that repeatedly raped her sister. That is insane! And let's be honest, this was terrible police work, terrible. Those lousy alibis should have been easy to break from the start. Heck, the one kid even admitted he lied about the albi and the cops let it go, saying they do that sometime. The whole case is just tragic!
