Thank you for sharing this, Kimberlyd125. Justin was a precious little guy and and this video shows he was well loved by his family and friends.

I can also see that he had a good sense of humor as did his family. This video did move me to tears.

I honestly do not know WHY pedophiles and sex offenders are ever let out in society once they are identified as such. As many as we know exist, there are likely just as many not even known about.

When and where will it end?

I just viewed this beautiful video and cried all the way thru it. What a wonderful memorial to this young man!!!! Do these 's even stop to consider that this child is a son, a brother, a friend????? Bravo to the state of Louisana for the new law----but wouldn't it be nice if we didn't have to pass laws like this to protect our children and ourselves. Life was much simpler and safer when I was a child. I miss it.

MANSFIELD — Attorneys will meet at 9:30 a.m. today in District Judge Robert Burgess' chambers for a status conference in the first-degree murder case of Brian Douglas Horn.

No trial date has been set, and DeSoto District Attorney Richard Johnson does not anticipate one will be set today. "But whenever the judge sets it, we'll be ready."

Today's conference is designed to "see where we are," Johnson said. Of concern to Johnson is that no pre-trial motions have been filed so far.

Horn's attorneys are, however, seeking records from various agencies such as the state's social services and prisons, and prisons in other states, according to court records.

Also seeking records is Horn. Two hand-written letters — one dated Aug. 8 and the other Aug. 18 — have been received by the DeSoto Clerk of Court's office. In one, Horn sought a printout of the docket sheets and court minutes and in the other he wanted copies of the grand jury indictment, arrest warrant, pre-trial pleadings and motions.


AND:
Horn has acted as his own attorney in previous and unrelated court matters taking place in other jurisdictions.

AND:
Horn has pleaded not guilty. Johnson is seeking the death penalty.

Judge denies Brian Horn's motions to suppress

MANSFIELD — Homicide suspect Brian Horn's attempt to suppress statements made to DeSoto Parish sheriff's investigators during two interviews along with evidence seized from his home were unsuccessful.

District Judge Robert Burgess denied Horn's motions, saying in both instances the state met its burden in proving Horn's comments were voluntary and a subsequent search of his home was permissible

Horn's only acknowledgment was to admit being a taxi driver who ran out of gas, walked to Kickapoo to retrieve gas, then walk back. He also denied having a boy in his taxi and being near the crime scene. But Horn said if he was in the area, then he took a wrong turn.
The statements are not a confession. Still, prosecutors maintain the admission shows Horn's involvement. Horn suggested the comments were made under duress.
Burgess rejected the claim, noting Horn was read his Miranda rights on multiple occasions and voluntarily participated in the brief interviews, which were stopped once he asked for an attorney.


No date has been set for Horn's trial. Prosecutors are seeking the death penalty.

Prosecutors amend indictment against Brian Horn in Bloxom murder


MANSFIELD, LA (KSLA) - DeSoto Parish prosecutors have amended their indictment against Brian Horn, the sex offender accused in the killing of 12-year-old Justin Bloxom.

They say the change gives the state more flexibility in presenting evidence when the first degree murder case goes to trial.


Horn is due back in court on January 3rd, when he will be re-arraigned on the amended indictment.

Prosecutors are asking for the death penalty.

State amends Horn's murder indictment

The move is a legal technicality and won't change the focus of the trial against Brian D. Horn.

"We're going with the simplest form of indictment that the law allows," said Caddo Parish Assistant District Attorney Brady O'Callaghan.

District Judge Robert Burgess set a Jan. 3 court date.


The original indictment "alleged certain aggravating circumstances," O'Callaghan said Thursday after a court hearing. The new one "allows us to use the evidence to prove the particulars of the case."

Taxi cab owner released from Bloxom lawsuit

The owner of a Bossier City taxi cab business is removed from personal liability in a wrongful death lawsuit filed by the mother of a Stonewall boy allegedly killed by one of the cab drivers, according to a court ruling released Wednesday.

The 2nd Circuit Court of Appeal's ruling affirms a DeSoto District Court summary judgment dismissing Action Taxi owner David McFarlin from the lawsuit filed in May 2010 by Amy Bloxom Fletcher on behalf of her son, Justin M. Bloxom, 12, of Stonewall.

On Tuesday, the process of selecting jurors who will hear the evidence and testimony will begin in East Baton Rouge. That's 3 hours away from DeSoto Parish, where the trial itself will be held, thanks more than three years of pre-trial publicity.

"3 years, 11 months and 10 days," said Justin's mother, Amy Witham Fletcher on her Facebook page Monday. "Tomorrow starts our next chapter of this nightmare. Justice for Justin Bloxom is all I ask and pray for."

Opening arguments could get under way as early as next week.

The trial starts tomorrow, March 11 Tuesday, with jury selection in an East Baton Rouge Parish courtroom. The goal is to seat a jury with little if any knowledge of the highly publicized 2010 homicide. Jurors then will be shipped to DeSoto parish for the actual trial.

Prosecutors are going for the death penalty in this case which means the people who are picked for this jury will have to ask themselves, "Can I send a man to his death?"
